Box 2459 San Bernardino, CA 92406 909.206.5263 Applicant: WF Land Systems 417 Nottingham Drive Banning, CA 92220 909. 845.5022 BACKGROUND The applicant, WF Land Systems, requested a General Plan Amendment to change the land use designation from RU-l, Residential Urban to CG-l, Commercial General on a 9.8-acre parcel ofland located on the north side of Kendall Drive, about 1,250 feet east of Palm Avenue. In conjunction with the General Plan Amendment, the applicant requested approval ofa Conditional Use Permit to construct a self-storage facility on 7.8 acres of the 9.8-acre site. The balance of the site, a total of2.0 acres, is not proposed for development at this time. (Exhibit I). At their meeting of January 22, 2003, the Planning Commission considered staffs recommendation for approval as outlined in the Planning Commission Staff Report. (Exhibit 2). However, the Planning Commission did not concur with staffs findings. During their deliberations, the Planning Commission expressed concerns about the aesthetics of the project and the views of the RV storage by future residents across the flood control channel to the northeast. The Planning Commission also expressed concerns about the potential for a convenience store or fast food, drive-thru restaurant on the 2.0 acres site although the applicant/developer did not express any plans to do either. After considerable discussion, the Planning Commission recommended that the Mayor and Common Council deny General Plan Amendment No. 02-07 and Conditional Use Permit No. 02-13. Commissioners Coute, Enciso, Morris, Sauerbrun, and Welch voted in favor of denial and Commissioners Lockett and Thrasher voted in favor of approval. Planning staff subsequently talked with the owner about the concerns raised by the Planning Commission, and revised the Conditions of Approval as included in Exhibit 4. FINANCIAL IMPACT None, the applicant has submitted the application filing fees for this project. The self storage facility will include 650 storage units of varying sizes in several buildings, a manager's unit, an outdoor Recreational Vehicle Storage area, and ancillary facilities. Conditions ::J Denial ::J Continuance to: General Plan Amendment No. 02-07 Conditional Use Permit No.02-13 Hearing Date 1/22/2003 Page 2 REQUEST AND PROJECT DESCRIPTION The applicant requests a General Plan Amendment to CG-l, Commercial General for a 9.8 acre site on the north side of Kendall Drive, approximately 1,250 feet eaSl of Palm A venue. The parcel is somewhat isolated and irregularly shaped. The General Plan Amendment is required in order to conditionally allow the use proposed for 7.8 of the 9.8 acres. The applicant proposes the construction of a self-storage facility, with a total of 650 storage units in 8 buildings. The north boundary of the site, on which structures cannot be built because of a flood control restriction of 100 linear feet, would be used for unmarked Recreational Vehicle storage. The number of vehicles to be stored has not been specified by the applicant. The applicant proposes a chain link fence covered in vegetation for the northern boundary of the site. The buildings are located in an east-west direction of the site, with the outside walls of buildings I and 8 forming the southern boundary of the project. At, D/ERC's request, the applicant has added free-standing trellis work to break up the continuous building planes. A manager's unit is proposed, which as submitted would allow two residential units. SETTING/SITE CHARACTERISTICS The site is bordered on the north and east by the Cable Creek Flood Control Channel, with RU-l, Residential Urban lands further east, on the west by vacant lands designated CG-I, Commercial General, and on the south by Kendall Drive and vacant Commercial General lands. The parcel is relatively flat, and currently vacant. Residential development occurs to the north and east. The site is sandwiched between the Cable Creek Channel and the 1-215 right of way. BACKGROUND Self storage facilities are allowed with approval of a Conditional Use Permit in the Commercial General land use designation. The DERC reviewed the project at its meetings of November 21 and December 19,2002, and asked for design changes to the project, which have been undertaken by the applicant. The DERC also reviewed the Initial Study prepared for the project, and recommended that the project be moved to the Planning Commission on December 19,2002. General Plan Amendment No. 02-07 Conditional Use Permit No.02-t3 Hearing Date 1122/2003 Page 3 FI'iDl:\'GS A'iD A\'AL YSIS A. GENERAL PLAN AMENDMENT 1. Is the proposed amendment internally consistent with the General Plan? Yes. The General Plan encourages a mix of land uses in all categories, as demonstrated below: GoallA Provide for the continuation and development of sufficient land uses to serve the housing, commercial, educational, cultural, recreational and social needs of existing residents and population growth. The General Plan Amendment is proposed for a parcel which is bordered on two sides by Commercial General lands (west and south), and on the other two sides by a flood control facility. The relative isolation of the parcel makes an extension of a commercial land use designation logical for this area. 2, Is the proposed amendment detrimental to the public interest, health, safety, convenience of welfare of the City? No. The proposed self-storage facility will provide a service to residents of this area of the city. Future development on the remainder 2 acre parcel, although undefined at this time, will be required to comply with all City standards for the land use designation. 3. Will the proposed amendment maintain the appropriate balance of land uses within the City? Yes. The proposed amendment eliminates only 9.8 acres from the potential residential land available in the City. The parcel's location, as well as surrounding land use designations, are not conducive to single family residential development. The elimination of 9.8 acres does not affect the City's ability meet its RHNA. 4. Is the subject parcel physically suitable for the requested land use designation and the anticipated land use development? Yes. The proposed parcel is relatively flat and currently vacant, and has no physical feature which would prevent the successful construction of a self storage facility or other commercial use. Parking standards are discussed in further detail under item 5, below. With the adoption of the General Plan Amendment, the proposed project will be conditionally permitted, and will therefore be consistent with the General Plan. 3. /5 the approval of the Conditional Use Permit for the proposed use in compliance with the requirements of the California Environmelllal Quality Act and Section /9.20.030(6) of the Development Code? Staff prepared an Initial Study. and found that potential impacts associated with the project could be mitigated. A Mitigated Negative Declaration is proposed (Attaclunent E). A Mitigation Monitoring and Reporting Program was prepared for the project (Attachment F) 4. Are there potentiallv significalllnegative impacts upon environmelllal quality and nalural reSOllrces that could not be properly mitigated and monitored? No, as identified in Finding #3 above. all environmental impacts can be mitigated, and a Mitigated Negative Declaration is proposed. 5. Are the location, size, design, and operating characteristics of the proposed use compatible with the existing and future land uses within the general area in which the proposed use is to be located and will it create significant noise, traffic or other conditions or situations that may be objectionable or detrimental to other permitled uses in the vicinity or adverse to the public illlerest, health, safety, convenience, or welfare of the City? The location and size of the proposed project are compatible with existing and potential land uses in the area. The project is to be located on a relatively isolated parcel, in an area designated for commercial development. The size of the project appears to be typical of such projects recently approved in the City. Design and operational issues associated with the proposed project which require additional discussion are itemized below. Design The design of the proposed project meets the Development Code Amendment requirements for the CG-l district regarding lot area, lot dimension, building setbacks, and building height. The following discussion addresses architectural style, fencing and parking Architectural Stvle The buildings proposed for the project site will result in long expanses of wall along Kendall Drive. In order to minimize the appearance of these solid surfaces, the applicant has added parapet roofs at intervals along the frontage, and has also offered two options for trellises to be placed at intervals along the fa~ade. The landscaping plan proposed to alternate deciduous and evergreen trees along the fa~ade, also to break up the plane of the structure. In order for all these elements to work effectively together, the conditions of approval include provisions that the evergreen trees be located in areas where the trellises do not occur, and that the trellises be free-standing and planted with General Plan Amendment No. 02-07 Conditional Use Permit No.02-13 Heaflng Date 1/22/2003 Page 6 t10wering vines. The purpose of the conditions is to ensure that as little of the building fa~ade is visible as is possible. at all times of the year Fencing The applicant has proposed chain link fencing for the Cable Creek Flood Conlrol Channel boundary. The applicant further proposes that the chain link fencing be planted with vines as an aesthetic improvement. The north property line, however, faces residential neighborhoods located to the north, northwest and northeast. Since the northern portion of the property is also the area where R V storage is proposed, the combination of chain link fencing and RV storage may result in unpleasant aesthetics for the residential neighborhoods. A condition of approval has been added which requires that either wrought iron fencing with narrow spacing between bars, or a chain link fence with sufficient evergreen plantings to assure coverage year-round be provided for this area. It is expected that either of these options will provide sufficient screening to eliminate the potential aesthetic impacts to the residential neighborhoods. Operational Characteristics Two operational issues are associated with the proposed project. First, the Manager's unit and office currently include two residential units. A condition of approval has been added which requires that one of the units be eliminated. The Development Code only allows one residential (caretaker's) unit. The second operational issue relates to the RV parking shown on the site plan. The applicant has not delineated the number of RV parking spaces proposed for the site. Given that the area involved is approximately 100 feet deep by almost 1,000 feet long, the potential exists for the parking of over 120 RVs in this area (assumes a width of 15 feet per RV, parked two deep). With the size of current RVs, this could represent an excessively large mass to be observed from the residential lands to the north, northwest and northeast. A condition of approval has been added which limits the use of the northern portion of the site to a total of 40 RVs. 6. Is the subject site physically suitable for the type and demity/intensity of use being proposed? Yes, the site is physically suitable for the type and intensity of the project being proposed, as conditioned in item #5, above. 7. Are there adequate provisions for public access, water, sanitation, and public utilities and services to ensure that the proposed use lVould not be detrimental to public health and safety? All agencies responsible for reviewing access, and providing water, sanitation and other public services have had the opportunity to review the proposal, and none has indicated General Plan Amendment No. 02-07 Conditional Use Permit No.02-13 Hearing Date 1/22/2003 Page 7 an inability to serve the project. The proposal will not be detrimental to the public health and safety in that all applicable Codes will apply to the construction of this project. AGENCY COMMENTS AND CORRESPONDENCE The Plan Check Division, Refuse and Recycling Division, Public Works Division, and Fire Department have submitted standard conditions for this project. In addition, a letter was received from the County Flood Control District. Their requests have been included in the conditions of approval for the proposed project. CONCLUSION The General Plan Amendment and Conditional Use Permit (as conditioned), are consistent with the General Plan. The Conditional Use Permit, as conditioned, meets the standards of the Development Code. RECOMMENDA nON Staff recommends that the Planning Commission recommend that the Mayor and Common Council: I. Adopt the Mitigated Negative Declaration and Mitigation Monitoring/Reporting program, 2. Adopt General Plan Amendment 02-07, and 3. Approve Conditional Use Permit 02-13 subject to the Conditions of Approval and Standard Requirements. Within two years of development approval, commencement of construction shall have occurred or the permit/approval shall become null and void. In addition, if after commencement of construction, work is discontinued for a period of one year. then the permit/approval shall become null and void. Expiration Date: Two years from Mayor and Common Council Approval 2. The review authority may, upon application being filed 30 days prior to the expiration date and for good cause, grant a one-time extension not to exceed 12 months. The review authority shall ensure that the project complies with all current Development Code provISIons. 3. In the event that this approval is legally challenged, the City will promptly notify the applicant of any claim or action and will cooperate fully in the defense of the matter. Once notified, the applicant agrees to defend, indemnify, and hold harmless the City, the Economic Development Agency, the Redevelopment Agency, their affiliates, its officers, agents and employees from any claim, action or proceeding against the City of San Bernardino. The applicant further agrees to reimburse the City, the Redevelopment Agency and the Economic Development Agency of any costs and attorneys' fees which the City, the Redevelopment Agency or the Economic Development Agency may be required by a court to pay as a result of such action, but such participation shall not relieve applicant of his or her obligation under this condition. 4. Construction shall be in substantial conformance with the planes) approved by the Director, Development Review Committee, Planning Commission or Mayor and Common Council. Minor modification to the planes) shall be subject to approval by the Director through a minor modification permit process. Any modification which exceeds 10% of the following allowable measurable design/site considerations shall require the refiling of the original application and a subsequent hearing by the appropriate hearing review authority if applicable: a. On-site circulation and parking, loading and landscaping; b. Placement and/or height of walls, fences and structures; c. Reconfiguration of architectural features, including colors, and/or modification of finished materials that do not alter or compromise the previously approved theme; and, d. A reduction in density or intensity of a development project. 5. No vacant, relocated, altered, repaired or hereafter erected structure shall be occupied or no change of use ofJand or structure(s) shall be inaugurated, or no new business commenced as authorized by this permit until a Certificate of Occupancy has been issued by the Department. A temporary Certificate of Occupancy may be issued by the Conditional Use Permit No. 02-13 Hearing Date !l22/03 Page 2 Department subject to the conditions imposed on the use, provided that a deposit is filed with the Public Works Division prior to issuance of the Certificate, is necessary. The deposit or security shall guarantee the faithful performance and completion of all terms, conditions and performance imposed on the intended use by this permit. 6. This permit or approval is subject to all the applicable provisions of the Deyelopment Code in effect at the time of approval This includes Chapter 19.20- Property Development Standards, and includes: dust and dirt control during construction and grading activities; emission control of fumes, vapors, gases and other forms of air pollution; glare control; exterior lighting design control; noise control; odor control; screening; signs, off-street parking and off-street loading; and vibration control Screening and sign regulations compliance are important considerations to the developer because they will delay the issuance of a Certificate of Occupancy until they are complied with. Any exterior structural equipment, or utility transformers, boxes, ducts or meter cabinets shall be architecturally screened by wall or structural element, blending with the building design and include landscaping when on the ground. 7. The trellises depicted on the site plan shall be freestanding and detached from the walls. 8. The trellises shall occur in all areas where there is no tile roof. 9. The landscaping plan shall be modified to assure the following: a. The evergreen trees (Mondel pine) shall be planted in areas where there is no trellis. b. The deciduous trees shall be planted behind the trellises. C. The trellises shall be planted with flowering vines which are hardy and do not die back in the winter season. The landscape plan shall be modified and submitted to the Public Works Division for review and approval prior to the issuance of site improvement permits. 10. Fencing along the north property line shall be either wrought iron, with no more than I inch separation between bars; or chain link planted with evergreen shrubbery on both sides, sufficient in size to cover the fence within two years ofreceipt of the certificate of occupancy for the site. The fencing and landscaping plan shall be submitted to the Planning Division for review and approval prior to the issuance of site improvement permits. II. The office and manager's unit shall include only one residential unit and a two-car garage. Conditional Use Permit No. 02-13 Hearing Date 1/22103 Page 3 12. The area along the northern boundary of the site shall be striped for no more than 40 RV parking spaces. No more than 40 RVs shall be permitted to be stored on the site. 13 The site shall be entirely paved, except for structures and landscaping. No dirt and/or slag is permitted. 14 All on site lighting shall be energy efficient, stationary and directed away from adjoining properties and public rights of way. IS. The gates shall be maintained in good working order and shall remain closed except when in use. 16. No business activity shall be conducted other than the rental of storage spaces for inactive storage use. 17. No flammable or otherwise hazardous materials shall be stored on site. 18. Hours of operation shall not exceed 7.00 a.m. to 9.00 p.m., Monday-Saturday, and 9.00 a.m. to 9.00 p.m. on Sunday. 19. Prior to any encroachment onto San Bernardino County Flood Control District right of way, a permit shall be obtained from the District's Flood Control Operations Division, Permit Section. A complete drainage analysis, including construction plans and hydrologic/hydraulic data will be required. In order to mitigate this impact, the City requires the preparation and approval of PM 1 0 management plans, which shall be reviewed and approved by the Public Works Division. In addition, the project proponent shall implement the following mitigation measures to mitigate the potential impacts on air quality during construction activities: 1. The project proponent shall ensure that construction equipment shall be properly maintained and serviced to minimize exhaust emissions. 2. The project proponent shall ensure that existing power sources are utilized where feasible via temporary power poles to avoid on-site power generation. 3. The project proponent shall ensure that construction personnel be informed of ride sharing and transit opportunities. 4. The project proponent shall ensure that any portion of the site to be graded shall be pre- watered to a depth of three feet prior to the onset of grading activities. 5. The project proponent shall ensure that watering of the site or other soil stabilization method shall be employed on an on-going basis after the initiation of any grading activity on the site. The project proponent shall ensure that SCAQMD Rule 403 is adhered to. insuring the clean up of construction-related dirt on approach routes to the site. 9. Mini-storage facilities, as proposed in the Conditional Use Permit, will generate 244 average daily trips on 7.8 acres of the 9.8 acre site. The balance of the site will be developed in the future, potentially for a retail use. Based on the City's Development Code maximum building coverage in the CG-I district, the balance of the property could generate 43,500 square feet of retail space. Utilizing the Institute of Transportation Engineers' 6th Edition "Trip Generation" Manual, for the Shopping Center category, the 2 acre site could generate 1.867 trips per day. When added to the mini-storage facility trip generation, the entire site could generate 2, III trips per day. Should the mini-storage facility not be developed, the entire 9.8 acre property, with approval of the General Plan Amendment, could be developed for a shopping center. IS 14 CITY OF SAN BERNARDINO DEVELOPMENT SERVICES I:'\ITIAL STUDY Utilizing the same assumptions as described above, the site could support as much as 196,020 square feet of retail space. This space would generate 8,413 trips per day. Under the current General Plan designation of RU, the site could support as many as 78 housing units These housing units could generate 746 trips per day. The proposed General Plan Amendment, therefore, will result in more traffic generation than current land use designations. The mini-storage, however, is a lower trip generator than most, and by itself will generate less traffic on the 7.8 acre site than housing units would. Because Kendall Drive is designated a major arterial roadway in the City's General Plan, it is designed to have a high capacity. However, the potential for impacts to this major roadway exist, should the self storage facility not be constructed. In order to mitigate this potential impact, the following mitigation measure shall be implemented: 1. A traffic impact study shall be prepared for any portion of the site developed for any use other than mini-storage. The traffic impact study shall conform to the City's standards for such studies, and shall be submitted, reviewed and approved by the Public Works Division prior to the approval of any commercial land use on any portion of the site. This program has been prepared in compliance with the California Environmental Quality Act (CEQA) and the State and City of San Bernardino CEQA Guidelines. CEQA Section 21081.6 requires adoption of a monitoring and/or reporting program for those measures or conditions imposed on a project to mitigate or avoid adverse effects on the environment. The law states that the monitoring or reporting program shall be designed to ensure compliance during project implementation. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Recitals (a) WHEREAS, the General Plan for the City of San Bernardino was adopted by the Mayor and Common Council by Resolution No. 89-159 on June 2, 1989. (b) WHEREAS, General Plan Amendment No. 02-07 to the General Plan of the City of San Bernardino was considered by the Planning Commission on January 22, 2003, after a' noticed public hearing, and the Planning Commission's recommendation has been considered by 15 the Mayor and Common Council. 16 (c) WHEREAS, General Plan Amendment No. 02-07 was reviewed under the California 17 Environmental Quality Act (CEQA) and a Mitigated Negative Declaration was considered by the 18 Mayor and Common Council. 19 20 21 (d) WHEREAS, the Mitigated Negative Declaration has been reviewed by the Planning Commission and the Mayor and Common Council in compliance with the California 22 Environmental Quality Act (CEQA) and local regulations. 23 (e) WHEREAS, the Planning Commission conducted a noticed public hearing on 24 January 22, 2003, in order to receive public testimony and written and oral comments on General 25 Plan Amendment No. 02-07 (a proposal to change the General Plan Land Use Designation from 26 RU-l, Residential Urban, to CG-l, Commercial General, for 9.8 acres located on the north side 27 28 of Kendall Drive, approximately 1,250 feet easterly of Palm Avenue, and fully reviewed and 1 considered the Planning Division staff report and the recommendation of the Environmental 1 2 Review Committee. 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 Bernardino that: 23 A. 24 25 26 27 28 (I) WHEREAS, the Mayor and Common Council held a noticed public hearing and fully reviewed and considered proposed General Plan Amendment No. 02-07 and the Planning Commission and Environmental Review Committee recommendations and Planning Division Staff Report on February 18, 2003. (g) WHEREAS, the adoption of General Plan Amendment No. 02-07 is deemed in the interest of the orderly development of the City and is consistent with the goals, objectives and policies of the existing General Plan. SECTION 2. Miti~ated Negative Declaration NOW, THEREFORE BE IT RESOLVED, FOUND AND DETERMINED by the Mayor and Common Council that the proposed amendment to the General Plan of the City of San Bernardino could have an impact on the environment, but that there will be no impact which cannot be mitigated to a level of insignificance, and the Mitigated Negative Declaration heretofore prepared by the Environmental Review Committee as to the effect of this proposed amendment is hereby ratified, affirmed and adopted. SECTION 3. Findings BE IT FURTHER RESOLVED by the Mayor and Common Council of the City of San The proposed amendment is internally consistent with the General Plan in that it meets General Plan Goal I A, and provides for the continuation and development of sufficient land uses to serve the housing, commercial, educational, cultural, recreational, and social needs of existing residents and population growth. 2 1 B. 2 3 4 5 C. 6 7 8 9 10 D. 11 12 13 14 15 16 17 18 A. 19 20 21 22 23 24 25 B. 26 27 28 The proposed amendment would not be detrimental to the public interest, health, safety, convenience. or welfare of the City in that all activities are conducted within an enclosed structure. Furthermore, all future commercial development will be required to comply with all applicable provisions of the Development Code. The proposed amendment would not impact the balance of land uses, within the City in that the proposed property is adjacent to other commercial uses in the CG-l district and is consistent with General Plan Goal 1 A. The General Plan Amendment does not adversely impact the balance ofland uses within the City. In the case of an amendment to the General Plan Land Use Map, the subject parcel(s) is physically suitable (including, but not limited to access, provision of utilities, compatibility with adjoining land uses, and absence of physical constraints) for the requested land use designation(s) and the anticipated land use development(s) in that all required utilities and public services can adequately serve the site. SECTION 4. Amendment BE IT FURTHER RESOLVED by the Mayor and Common Council that: The Land Use Plan of the General Plan of the City of San Bernardino is amended by changing the land use designation from RU-I, Residential Urban, to CG-I, Commercial General, for 9.8 acres located on the north side of Kendall Drive, approximately 1,250 feet easterly of Palm Avenue. This amendment is designated as General Plan Amendment No. 02.07 and its location is outlined on the map entitled Attachment A, a copy of which is attached and incorporated herein for reference. Map Notation This resolution and the amendment affected by it shall be noted on such appropriate General Plan maps previously adopted and approved by the Mayor and Common Council and which are on file in the office of the City Clerk.
