Background: The Public Services Department Street Division utilizes unit #501, a 1980 Caterpillar D-4E Dozer and Disc for sewer line maintenance. The cost to maintain this twenty-six- year-old Dozer & Disc has increased with age and use, and some repair parts are no longer available, or are non-stock items and must be special ordered. Because of these factors, in conjunction with the manpower and cost to transport this track type machine to job sites, this Dozer & Disc have become too costly to operate. This unit is included in the FY 2005/2006 approved Sewer Line Maintenance budget account # 132-431- 5704 Miscellaneous Equipment; therefore, unit #501 will be placed in surplus for auction. Staff demonstrated several different manufacturers, during this demo period it was determined that the Caterpillar MT455B 4WD tractor 1 loader with Disc & Box Scraper was the best unit for the City at the best price. Johnson Rental Services of Fontana, California is the Regional dealer for Caterpillar rubber tire equipment and is considered a sole source dealer; there are no local dealers for this particular equipment. Through a negotiated purchase as referenced in section 3.04.070-1 of the Municipal Code the City has been offered the purchase price of $68,539.23, including tax from Johnson Rental Services (see Exhibit I). Fleet staff contacted four dealers for demonstrations, the quotes include tax and are as follows: (see exhibit 2). RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF A PURCHASE ORDER TO JOHNSON RENTAL SERVICES FOR A CATERPILLAR MT455B 4WD TRACTOR I LOADER COMPLETE WITH DISC AND BOX SCRAPER TO BE UTILIZED BY THE PUBLIC SERVICES DEPARTMENT STREET DIVISION. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That Johnson Rental Services is the Regional dealer for Caterpillar rubber tire equipment and is considered a sole source dealer for the purchase of a Caterpillar MT455B 4WD tractor I loader. Pursuant to this determination the Purchasing Manager is hereby authorized to issue a purchase order to Johnson Rental Services for said purchase in the total amount of $68,539.23. SECTION 2. The Purchase Order shall reference this Resolution No.2006-_ and shall read, "Caterpillar MT455B tractor I loader with Disc and Box Scraper" P.O. not to exceed $68,539.23 and shall incorporate the terms and conditions of the pu rchase order. SECTION 3. The authorization to execute the above referenced Contract is rescinded if not issued within sixty (60) days of the passage of this resolution.
