Back2round: In November 1989, voters approved Measure I authorizing San Bernardino Associated Governments (SANBAG), acting as the Transportation Authority, to impose a one-half of one- percent retail transaction and use-tax applicable throughout the county. This tax can only be used for transportation improvements and traffic management programs authorized in the expenditure plans set forth in Ordinance No. 89-1 of the authority. Measure I. was originally set to expire in 2010 however, it was extended by the voters In November of 2004 for an additional 30 years beyond the 20 I 0 expiration date. Ordinance 89-1, which established the expenditure plans, requires each local agency to expend funds based on a 5-year Capital Improvement Program and 20-year Transportation Plan adopted by resolution. The Expenditure Plan only relates to Measure I funds and their expenditure; it is mandatory that each agency updates its plan and program once each fiscal year or more frequently if changes occur during the fiscal year. Each year SANBAG audits the City's financial records of the use of the Measure I local pass through funds. On June 30, 2004, SANBAG auditors completed an audit of The City's Measure I financial records and determined that the City is not in compliance because Measure I funds had been expended on projects that were not indicated on the City's Measure I 5-year Capital Improvement Programs for fiscal years 2002-2007 and 2003-2008. SANBAG indicated that this is a minor issue of non-compliance and can be corrected by an action of the Mayor and Common Council amending the Measure I 5-year Capital Improvement Programs for FY 2002-2007 and 2003-2008. The proposed Amendment No.2 to the 5-Year Program for Measure I Local Funds expenditures for Fiscal Years 2002-2007 is detailed in Attachment "A". The auditors identified an expenditure made using $50,451 in Measure "I" funds to rehabilitate pavement at Richardson Street and Hardt Street which was not listed in the 5-Year Measure ''['' CIP for FY 2002-2007. The proposed amendment corrects that discrepancy. The proposed Amendment No.2 to the 5-Year Program for Measure I Local Funds expenditures for Fiscal Years 2003-2008 is detailed in Attachment "B". The auditors identified an expenditure made using $18,986 in Measure "I" funds to rehabilitate the Santa Fe Depot Building which was not on listed in the 5-Year Measure "I" CIP for FY 2003-2008. The proposed amendment corrects that discrepancy. CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION ST AFF REPORT (Continued) In addition, changes have occurred to the current 5- Year Program for Measure I Local Funds expenditures for FY 2005-20 I 0 due to transfers that were necessary to adjust the budgets of various capital improvement projects based on actual bid amounts and to adjust for change orders. Amendment I to the 5-Year Program for Measure I Local Funds expenditures for FY 2005-2010 addresses these changes, the details of which are indicated in Attachment "C". The proposed amendments have been reviewed by SANBAG and will bring the City's 5-Year Measure I CIP into compliance prior to the upcoming audit as of June 30, 2006. On May 17, 2004, the Mayor and Common Council adopted resolution no. 2004-128 approving Amendment No. I to the Five-Year Capital Improvement Program (2003-2008) for Measure "I" Local Expenditures. The current action is being submitted separately because amendments are required to 5-Year Measure I CIP's for previous fiscal years. Financial Impact: The financial impact related to the adoption of the Expenditure Plan is reflected in the 5-year Capital Improvement Plan for the City. RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING A:\'IENDMENT NO.2 TO THE FIVE-YEAR CAPITAL IMPROVEMENT PROGRAMS FOR FY's 2002-2007 & 2003-2008 Al\D AMENDMENT NO. I TO THE FIVE-YEAR CAPITAL IMPROVEMENT PROGRAM FOR FY 2005-2010 FOR MEASURE "I" LOCAL EXPENDITURES. WHEREAS. San Bernardino County voters approved passage of Measure "I" in November, 1989, authorizing San Bernardino Associated Governments, acting as the San Bernardino County Transportation Authority, to impose a one-half of one percent retail transactions and use tax applicable in the incorporated and unincorporated territory of the County of San Bernardino; and, WHEREAS. San Bernardino County voters approved an extension of Measure ''I'' in November, 2004, extending Measure "I" for an additional 30 years beyond the previous expiration in 20 I 0; and, WHEREAS, revenue from the tax can only be used for transportation improvements and traffic management programs authorized in the Expenditure Plans set forth in Ordinance No. 89- I of the Authority; and, WHEREAS, Expenditure Plans of the ordinance require each local jurisdiction receiving revenue from the tax to expend those funds pursuant to a Five-year Capital Improvement Program and a Twenty-Year Transportation Plan adopted by resolution of the local jurisdiction; and.
