Subject: Appeal of Denial by planning Commission for an
Extension of Time for Tentative Tract 13822
Mayor and Common council Meeting of

REOUEST
The applicant, Dukes - Dukes and Associates, Inc., is appeal-
ing the denial of the extension of time request for Tentative
Tract 13822 by the Planning Commission. The applicant
requests that the Mayor and Council uphold the appeal and
approve the one year extension of time request for Tentative
Tract 13822 until March 15, 1991.
BACKGROUND
Tentative Tract No. 13822 is a proposal to subdivide 9.57
acres into 38 single family lots at the northeast corner of
16th and California Streets in the RS, Suburban Residential
land use designation. The subdivision was originally ap-
proved by the Planning Commission on March 15, 1988 with a
two year approval period.
On October 4, 1990, an extension of time request was received
by the Department. At the October 23, 1990 Planning Commis-
sion meeting, the city Attorney's Office informed staff and
the applicant about the legal issue of not receiving the
extension request prior to the extension date, and because of
State and Municipal Code law the Planning Commission could
not legally approve the time extension. It was agreed to
continue the matter to the November 7, 1990, Planning Commis-
sion meeting so that the applicant could have time to present
any evidence that such a request was made prior to March 15,
1990. At the November 7th Planning Commission meeting, no
such evidence was submitted, so the Planning commission
denied the application based on advice of the City Attorney's
Office.
On November 20, 1990, an appeal of the Planning Commission
decision was filed by Reid & Hellyer on behalf of Dukes -
Dukes and Associates, Inc. The basis for the appeal is that
the applicant did, in fact, request an extension of time
prior to March 15, 1990 through negotiations leading to a
Joint Development Agreement, and that off-site public im-
provements for this tract were in excess of $125,000.
(According to Government Code Section 66452.6 the expiration
date of an approved Tentative Tract is automatically extended
three years after each filing of a qualified multiple final
maps for Tentative Tract map.) This second point about off-
site improvements is not valid for a number of reasons. The
main reason is that qualified multiple final maps for Tenta-
tive Tract 13822 are not being proposed and have never been
proposed, and that off-site (not adjacent to or within the
tract) improvements were not required.

The first point is a matter of legal interpretation concern-
ing implied or verbal requests to another city Department or
Agency prior to the March 15, 1990 expiration date. The city
Attorney's office will provide input on this determination at
the council meeting.
MAYOR AND COUNCIL OPTIONS
The council may uphold the appeal and approve the extension
of time (if it is legal to do so as determined by the city
Attorney's Office), or it may deny the appeal and deny the
extension of time for Tentative Tract 13822.
RECOMMENDATION
Staff's recommendation depends solely on the legality issue.
If it is legal to approve the extension of time, then staff's
recommendation is to approve the extension" request.

Dear Mayor Holcomb:
We represent Dukes-Dukes and Associates, Inc., and respectfully
appeal the above-referenced denial by the Planning Commission of the
Ci ty of San Bernardino regarding extending the expiration date for
Tentative Tract Map No. 13822. Tentative Tract Map No. 13822 is a 38
lot single-family subdivision located at the northeast corner of 16th
street and California street.
The Tentative Tract Map No,. 13822 was approved by the city on
March 15, 1988 with an expiration date of March 15, 1990, and contained
the following standard condition on page 12:
"TT Map fj 13822 shall be in effect for a period of 24 months
from the date of approval by the Planning Commission and/or
planning Department. However, if no development has ,been
initiated at the end of the 24-month time period, the
approval shall expire. Additional time may be approved by
the Planning Commission upon request of the applicant prior
to expiration of the llli-month time period. Expiratior,
date: March 15, 1990."

In essence, this provision provided an option to Dukes-Dukes and
Associates either commence development or request an extension of time
within 24 months.
Dukes-Dukes and Associates was effectively prevented by the City
from commencing development within this time frame and did, in fact,
request an extension prior to March 15, 1990.
On october 2, 1989, Dukes-Dukes and Associates was awarded the
right to develop city owned property (TT 11259 and 11261) adjacent to
the tract. During the following months, a joint development agreement
was negotiated and signed (on May 1, 1990) between the Redevelopment
Agency, the City and Dukes-Dukes and Associates. Under the agreement
all three tracts were combined into one construction package whereby
TTM 13822 would be built as phase II.
Under these circumstances, it makes little practical or economic
sense to require phase II (TTM 13822) to be built out of sequence.
Moreover, DukeS-Dukes and Associates entered these negotiations and
executed the Joint Development Agreement in reliance upon the
representations (expressed or implied) by the agency and the city that
TTM 13822 was "alive" and viable as of May 1, 1990.
Between October 2, 1989, and March 15, 1990, Dukes-Dukes and
ASf:oclates and the City/Agency carried on a series of negotiations
leading to the above-referenced Joint Development Agreement. During
these negotiations, Dukes-Dukes and Associates requested an extension
of time beyond the March 15, 1990 date for TTM 13822.
This oral request was confirmed in writing on March 26, 1990.
(copy enclosed).
As noted in the above quoted language approving the tract map:
"Additional time may be approved by the Planning Commission
upon request of the applicant prior to the expiration of the
(24}-month time period."
There is no requirement under this condition that the request be
in writing. Yet that is the sole criterion upon which the Planning
Commission based its denial. We believe such basis is in error and
inflicts an overly harsh result.
Perhaps even more important than either of the foregoing
~onsiderations with respect to our appeal is Government Code section

tract map three years when the applicant is required to expend $125,000
or more on public improvements outside the boundaries of the tentative
tract map. As noted above, TTM 13822 is linked with TTM 11259 and TT~
11261. It is our understanding that the required off-site public
improvements for this combined development far exceed the $125,0000
amount.
In summary, we believe that the Planning Commission's denial of
our request to extend the expiration date of TTM 13822 was done in
error. However, even if no request (written or oral) was made the
linking and phasing of this tract with the other two tracts and/or the
expenditure of over $125,000 in off-site public improvements warrants
the granting of the extension.
Accordingly, we respectfully request that the City Council
overrule the decision of the Planning Commission and grant the
requested extension.

for construction on tract 113822, it was selected by the City of
San Bernardino, as the developer to complete construction of the
Orangewood Estates, tracts 11259 & 11261, 5eventy six lots'(U6)
owneo by the city. These tracts are adjacent to tract 113822 which
is owned by Dukes-Dukes & Associates consisting of thirty eight lots
(38) programed to be built before the selection was made as developer
of the city o~~ed property. In order to develope all three (3) tracts.
negotiations with the city, prolonged the time and prevented us from
starting at the time we' had scheduled to begin construction.
We are requesting an extent ion of time because the property
deeds need to bc cleared by the city and we will be building the
homes i~ three (3) phases.

The 9.57 acre site is located at the northeast corner of
California and 16th Streets in the RS, Residential Suburban
land use designation.
ANALYSIS
The proposal was approved prior to the adoption of the
General Plan (June 2, 1989) and adoption of the Interim
pOlicy document (IPD). The findings of consistency of the
project were based upon conformance with Titles 18 and 19 of
the Municipal Code. At that time the proposal satisfied
these requirements under the R-1-7200 zoning standards.
Subsequent to project approval on March 15, 1988, the General
Plan was adopted by the Mayor and Common Council. The
General Plan designates the project site RS, Residential
Suburban.
The proposed 38 lot single family subdivision is a permitted
use under Section 19.83.300 of the Interim zoning Ordinance.
In addition, under Section 19.83.140, Extension of Time, "no
extension of time application may be approved unless a
written finding is made by the City that the development
project is consistent with the General Plan..."
The RS, Residential Suburban land use designation allows 4.5
dwelling units to the acre with a minimum lot size of 7,200
square feet. The minimum lot width and depth specified are
60-feet and 100-feet respectively. Corner lots must maintain
a 66-foot lot width. The proposed subdivision proposes 4.0
dwelling units to the acre and complies with the lot width,
lot depth, and lot size criteria. (Attachment A)

General Plan and Municipal Code in that a single family
subdivision is permitted under the RB, Residential
Suburban land use designation and all proposed lots meet
or exceed the minimum development standards.

neering, and Planning.
6. The design of the subdivision will not conflict with
easements acquired by the public at large for access
through or use of the property within the proposed
subdivision. The legal owner of record has agreed to
make all street dedications as required by the Public
Works/Engineering Department.
7. The discharge of waste from the proposed subdivision
into the existing community sewer system will not result
in violation of existing requirements prescribed by the
California Regional Water Quality Control Board,
pursuant to Division 7 (commencing with Section 13000).

RE: Extention of time for Tract. #13822
Dear Sir:
The purpose of this letter is to clarify a number of
matters regarding the above tract. Dukes-Dukes & Associates
had planned to draw final tract maps for tract #13822 before
this date. However, at the City Council meeting of October
2, 1989, Dukes-Dukes & Associates were awarded the right. to
~evelope city owned properties including tracts 11259 and
11261. These tracts were part of Orangewood Estates.
These properties consist of 76 vacant lots which were
creating problems in this residential community. The City
of San Bernardino wanted the developer to upgrade the area
and at the same time eliminate continuing problems.
During the following months a joint agreement was
signed by the Redevelopment Agency, City of San Bernardino
and Dukes-Dukes & Associates. This agreement combined three
tracts, 11259, 13822 and 11261, into one construction
package. They were to be built in phases beginning with
tract #11259 followed by tract #13822 and tract #11261.

We concluded that since tract #13822 was part of the
joint agreement with the Redevelopment Agency and the City,
we are requesting engineering to draw our final tract map.
However, if an extent ion is required, we are requesting it
from your department to prevent any further delays. We feel
this request is justified because of the prescribed order of
the development outlined in the agreement.

include a statement that no radio frequency antenna shall
be included within the complex except for central antenna

b. No lot or dwelling unit in the development shall be sold
unless a corporation, association, property owner's group,
or similar entity has been formed with the right to assess

have any rights. or interest in the use of the common areas
and common facilities in the development, such assessment
power to be sufficient to meet the expenses of such entity,
and with authority to control, and the duty to maintain,

Such entity shall operate under recorded CC & R's which
shall include compulsory membership of all owners of lots
and/or dwelling units and flexibility of assessments to
meet changing costs of maintenance, repairs, and services.
Recorded CC & R's shall permit enforcement by the City of
provisions required by the city as conditions to approval.
The developer shall submit evidence of compliance with this
requirement to, and receive approval of, the commission
prior to making any such sale. This condition shall not
apply to land dedicated to the City for public purposes.
Every owner of a dwelling unit or lot shall own as an
appurtenance to such dwelling unit or lot, either (1) an
undivided interest in the common areas and facilities, or
(2) a share in the corporation, or voting membership in an

COMPOSITE DEVELOPMENT PLAN
A composite Development Plan (COP) shall be filed with the
Engineering, Planning, and Building & Safety Departments prior
to Final or Parcel Map processing by the city pursuant to
Ordinance No. MC-592. The COP shall provide additional survey
and map information including, but not limited to, building
criteria (e.g. setbacks), flood control criteria, seismic and
geological criteria, environmental criteria and easements of
record. The COP shall be labeled with the title "Composite
Development Plan", and contain a section entitled "Composite
Development Plan Notes". The applicant shall have listed
under the COP Notes section the following conditions or
mitigating measures required for the development of the
subject property:
11. The property owner shall sign a' covenant running with the land
agreeing that if the required landscaping is not maintained,
the City may enter on the the property and install and main-

1. REQUEST
The applicant requests approval of a 38-lot single-
family subdivision in the R-1-7200 Single-Family Resi-
dential District. Lot sizes range from 7,200 square
feet to 12,440 square feet. Extensions of Clyde Street
and Glenview Street will provide access to the subdivi-
sion from 16th Street. A new segment of 17th Street
will connect the extensions of Clyde and Glenview
Streets (see Tentative Tract Map, Attachment Fl.
2. SITE LOCATION
The subject property consists of two parcels encom-
passing 9.57 acres of relatively flat land. The site is
located at the northeast corner of 16th Street and
California Street in the Northwest Redevelopment Project
area and as such, as exempt from the moratorium. It is
currently vacant and contains no trees or other unusual
features worthy of preservation (see Location Map,
Attachment Gl.

MUNICIPAL CODE AND NORTHWEST REDEVELOPMENT PLAN CON-
FORMANCE

Approval of the proposed Tentative Tract Map is con-
sistent with the letters dated June 11, 1987, July 3,
1987, August 18, 1987 and February 5, 1988, from the
State Office of Planning and Research to the City of San
Bernardino which stipulate that ....land uses proposed
during the period of the extension will be consistent
with the purpose of the updated general plan pro-
visions..... The proposed subdivision is consistent
with the Municipal Code and the Northwest Redevelopment
Plan as shown in Attachment A.
4. CEQA STATUS
At its regularly scheduled meeting of February 11, 1988,
the Environmental Review Committee recommended that a
Negative Declaration be adopted for Tentative Tract
13822. The recommendation was based on an Initial Study
prepared by staff. The proposed Negative Declaration
was advertised for a public review period from February
20 through March 2, 1988. No comments were received.

The site of the proposed subdivision is located in the
Northwest Redevelopment Project Area. The Redevelopment
Plan calls for single-family residential development in
the area in which the site is located.

Contact with the police Department confirmed that the
proposal will not impact the Department beyond its
ability to provide adequate levels of sevice.
The site of the Tentative Tract is less than a mile from
the Fire Station at'Medical Center Drive and 21st
Street. The developer will be responsible' to provide
adequate water flow for fire-fighting purposes and to
install fire hydrants per City standards when the tract
is developed.
The site of the proposed tract is located approximately
a half mile from Rio Vista and Orangewood Parks.
School impaction will be addressed by school impact fees
assessed at a rate of $1.50 per square foot of covered
or enclosed area when the tract is developed.
Sewer connection rights are available, and the Water
Department does not expect the proposed subdivision to
exceed its capacity to provide adequate levels of
service.
The Redevelopment Agency's Report on the Redevelopment
Plan _ Northwest Redevelopment Project, proposed in
1982, did not anticipate a need to widen California or
16th Streets as a result of new development or re-
habilitation in the area. The standard traffic genera-
tion factor for a single family residence is ten trips
per day. A 38 lot single family development would
generate an average of 380 vehicle trips per day.

install landscaping in the right-of-way where the
project abuts 16th Street and California Streets. A
portion of the homeowners' property taxes will be

A wall must be erected along the rear property lines
abutting California Street per Code Section 18.40.230
which states that where lots back up to a street or
highway and where it is intended that there be no access
from the lot to the street or highway against which they
back, a six-foot decorative masonry wall shall be

tion between the lot and the street or highway. The
.commissionmay require an eight-foot high decorative
masonry wall to mitigate noise as deemed necessary.
Traffic on California Street is not heavy, and the noise
level is not sufficient to warrant an eight foot wall
for noise mitigation. A wall abutting 16th Street shall
also be required in order to provide a continuation of
the existing wall east of the site on the north side of
16th Street and a reflection of the existing wall on the
south side of 16th Street.

However, if no development has been initiated at the end of the2~-month
time periOd the approval shall expire. Additional time may be approved
by the Planning Comnrission upon request of the applicant prior to expira-

COVENANTS, CONDITIONS AND RESTRICTIONS FOR P.R.D.
a. The Covenants, Conditions and Restrictions (~R's) shall be reviewed
and approved by the Planning Oepartment prior to final approval of the
tract maps. The CC & R's shall include liability insurance and methods
of maintaining the open space, recreation areas, parking areas, private
roads, and exterior of all buildings. The CC&R's shall also include
a statement that no radio frequency antenna shall be included within
the complex except for central antenna systems.
b. No lot or dwelling unit in the development shall be sold unless a cor-
poration, association, property owner's group, or similar entity has
been formed with the right to assess all properties individually owned
or jointly owned which have any rights or interest in the use of the
common areas and common facilities in the development, such assessment
power to be sufficient to meet the expenses of such entity, and with
authority to control, and the duty to maintain, all of said mutually
available features of the development. Such entity shall operate under
recorded CC&R's which shall include compulsory membership of all
owners of lots and/or dwelling units and fleXibility of assessments to
meet changing costs of maintenance, repairs, and services. Recorded
CC&R's shall permit enforcement by the City of provisions required by
the City as conditions to approval. The developer shall submit evi-
dence of compliance with this requirement to, and receive approval of,
the Commission prior to making any such sale. This condition shall not
apply to land dedicated to the City for public purposes.
c. Every owner of a dwelling unit or lot shall own as an appurtenance to
such dwelling unit or lot, either (1) an undivided interest in the com-
mon areas and facilities, or (2) a share in the corporation, or voting
membership in an association, owning the common areas and facilities.
d. Maintenance for all landscaped and open areas, including parkways,
shall be provided for in the CC&R's.
e. The CC&R's shall contain wording prohibiting the storage or parking
of trailers, boats, campers, motor homes, and similar vehicles outside
of the specified common areas.

Where lots occur on the bulb of the Cul-de-sac, a minimum lot depth of
feet will be permitted. If the proposed depth is less than feet, a plot
plan must be submitted to demonstrate that a buildable lot area is possible
and to justify the lesser depth.
Variable front building setback lines of at least 20 feet and averaging

The developer shall obtain Planning Department approval of the visual or
engineering design of the proposed wall.
