In August of 1986, the City entered into an agreement
with the County of San Bernardino and City of Colton to study
Project 3-5, of the Comprehensive Storm Drain Plan No.3. At
that point in time, the City of Colton and the County Flood
Control District were suggesting that all development on the
west side of the City of San Bernardino be deferred until such
time as adequate drainage facilities were constructed, or
financed.
The area in question is basically south of 6th Street
and east of the Southern Pacific Railway. While the County
maintains several drainage basins in this area, they are con-
sidered inadequate. Additionally, there is presently an
inadequate drain under 1-10 for the necessary outlet to the
Santa Ana River. This causes storm water to back up along the
north side of the freeway.
After several meetings and much discussion, the County
has completed the study report. In general, it suggests that
the County, City of San Bernardino, City of Rialto and City of
Colton impose a fee of $7,159 per acre on all development in the
Project 3-5 drainage area. This fee has the potential to
generate $5.56 million of the $8 million estimate of cost to
construct adequate improvements to meet the needs of the area.
The request further suggests that other forms of agree-
ments be adopted to fund the remaining $2.44 million. These
figures allow for existing improvements to be added to the
overall cost and are stated to be in compliance with AB 1600
with the proper nexus and accounting. This fee would only apply
to undeveloped lands, and the dollar figure is based on collec-
tion of monies from all of the participating agencies. The City
of San Bernardino has 31% of the total drainage area and 26% of
the available vacant land to be charged.
The majority of this area within the City of San
Bernardino is designated as RS, with a maximum density of 4.5
units per acre. Therefore, the proposed drainage fee of
$7,159/gross acre equates to $1,591 per lot. Our present
drainage fee is $ 0.11/ sq. feet of net area, which amounts to
$792 for a 7,200 sq. ft. lot. The proposed fee represents an
increase of $809 per lot, from $792 to $1,591. We anticipate
that these fees would be held in a trust account until the
County is ready to start work on a project.

The Cooperative Agreement provided that each of the
three agencies would participate to the extent of $2,500 in the
estimated cost for preparing the Drainage Report. Payment has
been made for the City of San Bernardino's share.

cities. The increase to $7,159 per acre in this area should not
have a significant detrimental effect on development.

Section 54992 of the Government Code requires that a
meeting be held to receive oral or written presentations
levying any new fee or service charge. This public
must be held during a regularly scheduled Council

SECTION 1 :
Resolution No. 79-425, Subsection 2 (B)
is
amended as follows:
"(b) Prior to building permit approval within Project 3-5
(Pepper / Randall) Surcharge Area), the following special fees
shall be paid, which shall include the normal storm drainage fee
imposed by Resolution No. 79-425.
(1) For all construction or land development,

multiple residential, Single Family Residential, and including
additions or extensions, paving and other impervious areas, a fee
of $7,159 per gross acre of development.
(2) Said special drainage fees shall be adjusted
annually each July 15, in the amount of the change in the yearly
Construction Cost Index as published in the Engineering News
Record as of July 7 of each year."
SECTION 2.
The Project 3-5 (Pepper / Randall) Storm
Drain Surcharge Area is proposed:
As all that area within the comprehensive Storm Drain
Plan project Area 3-5, lying within the city limits of
the City of San Bernardino, the easterly boundary being
generally described as the north/south extension of the
Southern Pacific Railway, the east/west prolongation of
the Atchison, Topeka & Santa Fe Railway and the north/
south prolongation of Pepper Avenue and the east/west
extension of 6th Street to the westerly/southerly City
Limits line.
SECTION 3.
Funds collected from the special drainage
fees shall be deposited in a special line item account, for
disbursement to the San Bernardino County Flood Control District
when a project for storm drain improvements in Project 3-5 is
ready to be advertised for bids.
