2 A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNAR-
DINO AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN SAID CITY AND MORRISON-
3 HOPE, INC. FOR THE REPAIR OF PUBLIC BUILDINGS LOCATED AT 453 NORTH ARROWHEAD
AVENUE, SAN BERNARDINO, CALIFORNIA.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNAR-
DINO AS FOLLOWS: .

SECTION ONE: That the City of San Bernardino execute an agreement be-
tween said City and Morrison-Hope, Inc. for the repair of public buildings
(Re-roofing Hall of Justice building) located at 453 North Arrowhead Avenue,
San Bernardino, California.
SECTION TWO: That said agreement, a copy of which is attached hereto,
marked lixhibit "A" and referred to and made a part he~eof as fully as though
set forth at length herein, is hereby approved.
SECTION THREE: That the Mayor and City Administrator of the City of
San Bernardino are hereby authorized and directed to execute said agreement
on behalf of said City.

THIS AGREEMENT is made and entered into at San Bernardino,

California, this 21St day ofSepl;eliiber' '
, 197 3by and
6 between the City of San Bernardino, a municipal corporation, here-
7 inafter referred to as "City" and MORRISON - HOPE, INC., Contrac-
8 tors License No. 147306, hereinafter referred to as "Contractor".
9 WITNESSETH:
10 WHEREAS, Contractor has heretofore made a bid for roof
11 repairs at the Hall of Justice Building and for removing and
12 re";installing the air conditioning units, and
13 WHEREAS, the work to be performed under said bid was for
14 the rehabilitation of the original condition of the building, and
15 WHEREAS, said bid as previously made by Contractor included
16 all of the work required thereunder and is hereby incorporated
17 herein by reference as though set forth in full and at length.
18 NOW, THEREFORE, in consideration of the mutual covenants,
19 conditions and promises herein contained, .the parties hereto
20 agree as follows:
21 I. Duties and Responsibilities of Contractor.
22 A. Contractor shall furnish all labor, equipment and material
23

necessary to furnish and install built up roofing includin
composition base flashings at intersection of roof and
vertical walls, covering of interior face of parapet walls
and walls of roof ventilators. Contractor shall remove

and re..;install the exterior air conditioning equipment in
conjunction withre";roofing project.

1. Areas to be re-roofed.
Contractor shall re-roof all roof areas of Hall of
Justice Building, 453 North Arrowhead Avenue, San
Bernardino, California, with the exception of lower
deck (slag surfaced built-up roof) at northwest
corner of building. Contractor shall also re-roof
complete roof area of small concrete block building
(approximately 22' x 50') located at rear and south
of Fire Station.
2. Preparatory work.
(a) Wood Decks:
Contractor shall remove existing gravel sur-
facing and existing felts to bare roof sheathing.
(b) Concrete Decks:
(RoOf area over Personnel and Training - two
story section at northeast corner of building).
Contractor shall remove existing roofing to
bare concrete deck.
3. Materials Required Per 100 sq. ft. roof area:
(a) Base sheet: One (1) layer 45 lb. asbestos base
sheet.

Roofing gravel shall be clean, dry, natural color
and shall be washed and screened bank or river
gravel ranging in nominal size from 3/8 to 5/8 in. .
All. gravel shall pass a 3/4 inch screen. Not
more than 15 percent by weight shall be ratained
on a 1/2" screen nor shall any pass a 1/4" screen.
All shall be ratained on a No. 8 screen. Roofing
slag will be acceptable in lieu of gravel, and
shall be in the same sizes and shall be clean
and dry.
4. Composition Base Flashings:
Contractor shall strip existing composition base
flashings, prime walls with asphalt primer and apply
one (1) layer 15 lb. asbestos felt and one (1) layer
45 lb. asbestos set in moppings of H.M.P. asphalt.
5. Parapet Walls:
Contractor shall remove existing wall coverings,
loosen existing metal parapet wall cap, prime wall,
and apply one (1) layer 15 lb. asbestos felt and one

Contractor shall strip wall coverings at perimeter of
ventilator 1 install 24 'gage metal flashing with two-
inch (2") leg and three quarter. inch (3/4") drip edge
fastened to lower edge of existing heavy metal flash-
ing with sheet metal screw at eight inches (8") on
center ,cover ventilator walls with one . (1) layer
15 lb. asbestos felt and one (1) layer 45 lb. asbestos
set in moppings of H.M.P. asphalt 1 covering to extend
up under new metal flashing strip.
7,'. Roof JaCks:
Contractor shall furnish and install new galvanized
roof jacks where existing openings, vents, etc. occur
through roof. Existing gravel guard at front canopy
roof and at rear carport are to be re-used.
Contractor and any subcontractors under him shall pay
wages. to all laborers, .workmen and mechanics employed by
them in the eXecution of the contract not less than those
specified prevailing rates of wages as outlined by
Resolution No. 5718 and amendments thereto. Said prevail-
ing rates of wages shall conform to "Wage scales for the
Six Basic Trades", filed in the Office of the City Clerk,
and "Sub-Trades Hourly Wage - Rates of Building and Con-
struction Trade Council of San Bernardino and Riverside
Counties", filed in the Office of the City Clerk, which

are made a part of said Resolution No. 5718 and amendments

thereto.
3 C. Contractor and any subcontractors under him shall prevent
4
discrimination in the employment of persons because of
5
6
race, creed, color, or national origin, as set forth in
7
the provisions of Resolution No. 7414 of the Mayor and
Common Council of the City of San Bernardino.
8 D. Contractor shall obtain all licenses, permits and the like,
9
pay all fees necessary to complete work and shall maintain
10
a City of San Bernardino business license.
11 E. Contractor, at his own expense, shall maintain legally
12
sufficient workmen's compensation insurance, contractor's
13
liability insurance, property damage insurance, and shall
14
15
hold harmless the City of San Bernardino and all of its
officers, agents and employees from any claims arising
16
out of injury to persons or property in connection with
17
the operations and performances of the Contractor under
18
19
20
the terms of this Agreement.
F. Contractor shall furnish a faithful performance bond to
City in the amount of thirteen thousand six hundred and
21
seventeen dollars ($13,617.00). Said bond shall be in
22
accordance with Ordinance No. 821, Section 2400, and the
23
corporation issuing said bond shall have a rating in
24
Best's Most Recent Insurance Guide of "A" or higher. Said
25

bond shall be subject to approval of City.
G. Contractor shall insure that all materials, equipment and
work operations are in conformity with OSHA standards. It
shall be the Contractor's responsibility to take all neces-
sary precautions at all work areas which may constitute a
hazard to property and/or life.

1 H. Contractor shall provide a two (2) year guarantee for all

materials and worknianshipand specifically a two :(2) year
. guarantee against any leaks caused by faulty materials
and/or worknianship. Said twoCn year period shallcommen e

from date of project completion according to specification
contained in this Agreement. Repair of such leaks shall
be prompt and without additional cost to City.

8 I. Contractor, .at the completion of project shall at his own
9
expense remove or cause to be removed from preniisesall
10
debris. Contractor shall also remove all asphalt dripping
from face of gravel guards , metal flashings, .walls or walk
of building and shall leave premises clean.
J. Contractor shall call Department of Building and Safety
for first roofing inspection when job is approximately 50%
complete, and shall call for final roofing inspection upon
completion of job. Contractor shall perform and complete

work in accordance with trade standards and all applicable
. governmental laws,' rules , regulations and orders.
K. Contractor shall commence work on this project within
seven .(?) calendar days from date of contract execution an
shall complete project according to terms of this agreemen
within twenty-one (21) calendar days from date of contract
execution or by October 8, 1973,'whichever date is earlier
Time is of the essence. Should it rain on contractor's

normal working day and such rain prevent contractor from
performing work in accordance with this agreement, then
for every such day , .contractor' s scheduled completion day

shall be extended one additional day.

L. Contractor shall perform all work set forth hereinabove
and any additional work as set forth in his bid dated
February 23" .1,97 3 which is incorporated herein by
refer:ence. Any other duties and responsibili ties of
Contractor not set forth herein but which may be set
forth in his bid are also part :of his duties and
responsibili ties pursuant to this Agreement.
M. Contractor shall execute and file with the City a good
and sufficient surety company, bond for labor and
materials, in the sum of not less than six Thousand,
Eight Hundred and eight dollars .rid.fifty cents
($6,808.50). The provisions of said bond shall be in
accordance with the requirements of Ordinance No. 2386
of the City of San Bernardino and the provisions of
,general law incorporated therein.
II. Payment By City
That for and in consideration of the faithful performance of
all terms of this Agreement, Contractor specifically agrees
to the sum of Thirteen Thousand Six Hundred and seventeen
dollars ($13,'6.17.,00) as full and complete payment for all his
materials, equipment, ,and services.
III. Amendment
This Agreement may be amended or modified only by written
Agreement signed by both parties and failure on the part of
either party to enforce any provisions of this Agreement
shall not be construed asa waiver of the right to compel
enforcenientof such provision or provisions, nor act to re-
lease any surety from its obligations under this Agreement.
