HomeMy WebLinkAbout1981-650 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1 RESOLUTION NO. 81-650 2 A RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION TO ORDER WORK IN PORTIONS OF WALNUT STREET, MUSCOTT STREET, PICO 3 STREET, BELLEVIEW STREET, CONGRESS STREET AND RIALTO AVENUE, IN THE CITY OF SAN BERNARDINO, TO BE KNOWN AS "ASSESSMENT DISTRICT NO. 949". 4 5 6 WHEREAS, as an exercise of its municipal affairs powers, the Mayor and Common Council of the City of San Bernardino, by Ordinance No. 2063, established a procedure for finding and determining whether the public convenience and necessity require certain improvements or acquisi- tions of property, and authorizing notices and hearings to be combined and held concurrently with the hearing required by the improvement act pursuant to which the improvement proceeding is proposed, and WHEREAS, a letter from the Deputy Health Officer, Environmental Health Services of the County of San Bernardino has been filed recommending that proceedings be instituted as necessary as a health measure, NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO RESOLVE AS FOLLOWS: SECTION 1. Pursuant to Ordinance No. 2063, said Mayor and Common Council hereby elect to combine the hearing required therein with the hearing required by Section 10301 of the Streets and Highways Code of the State of California. SECTION 2. It is the intention of said Mayor and Common Council to order the improvement of portions of Walnut Street between Pico Street and Muscott Street; Pico Street between Walnut Street and Oregon Street; Muscott Street between Walnut Street and Rialto Avenue; Belleview Street between Muscott Street and a pOint approximately 700 feet East thereof; Congress Street between Muscott Street and a point approximately 700 feet East thereof; Rialto Avenue between Muscott Street and a point approximately 700 feet East thereof in said City, in the following manner, to-wit: The construction of Sanitary Sewers and appurtenant facilities in said portions of said streets. SECTION 3. That said Mayor and Common Council, in making the improvement, elects to proceed under and in accordance with the provisions of the "Municipal Improvement Act of 1913", being Division 12 of the Streets and Highways Code of the State of California. 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1 SECTION 4. The Public interest and convenience require and said contemplated work and improvement is of more than local or ordinary public benefit. Said Mayor and Common Council do hereby make the expense of such work and improvement chargeable upon a district, which district is hereby declared to be the district benefited by said proposed work and improvement, and to be assessed to pay the cost and expense thereof, and which district embraces generally all that real property situate in the City of San Bernardino, County of San Bernardino, State of California, lying South of Rialto Avenue; East of Muscott Street, and West of Pico Street, which fronts on those portions of streets hereinabove mentioned to be improved, and is to be designated for convenience as "Assessment District No. 949". Reference is hereby made to that certain map designated "Proposed Boundaries of Assessment District No. 949" which map, attached hereto as Exhibit "A" and made a part hereof, is on file in the office of the City Clerk and indicates by a boundary line the extent of the territory included in the proposed assessment district and shall govern for all details as to the extent of the assessment district. SECTION 5. Serial bonds, bearing interest at a rate not to exceed the legal limit and extending over a period ending nine years from the second day of July next succeeding ten months from their date, will be issued hereunder, in the manner provided by Division 10 of the Streets and Highways Code, the Improvement Bond Act of 1915, to represent assessments remaining unpaid for thirty days after the date of mailing of the statement to the property owners pursuant to Section 10404 of the California Streets and Highways Code. All public Streets or alleys, or portions thereof, and all property belonging to the City of San Bernardino are hereby excepted from said district. SECTION 6. After completion of the improvement and the payment of all claims from the improvement fund, the Mayor and Common Council here- by determine that the amount of the surplus, if any, remaining in the improvement fund by reason of the assessment and any supplemental assessment levied for said improvement, shall be used for anyone or combination of the following: (a) for the maintenance of the improvement; (b) for transfer to the general fund of the City, provided that the amount of any such transfer shall not exceed the lesser of one thousand dollars ($1,000) or 5 percent of the total amount expended from the improvement fund; 2 3 4 5 6 7 8 9 - 2 - 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 (c) for transfer to the bond redemption fund to be used for the payment, at or prior to maturity, of such bonds, the interest thereon, and the pre- payment penalty, if any. SECTioN 7. The Director of Public Works/City Engineer is hereby authorized and directed to make and file a report on the proposed improve- ment, in writing with the City Clerk. SECTION 8. The City Treasurer is hereby designated as the officer to collect and receive all payments on account of the proposed assessments including any penalties therefor, and to sign, issue and deliver said improvement bonds. SECTION 9. That the Mayor and Common Council find the public interest will not be served by allowing property owners to take the construction contract and, accordingly, no notice of award of contract is required to be published. SECTION 10. That the Mayor and Common Council hereby find and determine that in the event that the contractor who has contracted for the work as set forth herein, for any reason, shall have failed to perform the work within the time limit as specified and set forth in the contract or within such further time as the Mayor and Common Council shall have authorized, and to the satisfaction of the Director of Public Works/City Engineer, the contractor or contracting owners, as the case may be, after such breach, shall pay to the City, liquidated damages in the amount equal to $150.00 for each day beyond the date as specified in said contract for the completion of such work. SECTION 11. Pursuant to a letter from the Deputy Health Officer, Environmental Health Services of the County of San Bernardino recommending that proceedings be instituted as necessary as a health measure, the Mayor and Common Council hereby find that a health hazard exists in the proposed district. Pursuant to Section 2808 of the California Streets and Highways Code, compliance with the Special Assessment Investigation, Limitation and Majority Protest Act of 1931 shall not.apply.
