RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
BXeCUTION OF AN AGREEMENT WItH DIAMOND INtERNATIONAL CORPORATION
RELATING TO ELECTION SUPPLIES AND SERVICES FOR THE SPECIAL
MUNICIPAL ELECTION TO BE HELD ON FEBRUARY 16, 1982.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino is hereby
authorized and directed to execute on behalf of said City an
Agreement with Diamond International Corporation relating to
election supplies and services for the Special Municipal Election
to be held on February 16, 1982, a copy of which is attached
ereto, marked Exhibit "I" and incorporated herein by reference as
fully as though set forth at length.
I HEREBY CERTIFY that the foregoing resolution was duly

THIS AGREEMENT is made and entered into this y,l'tl( day of

INTERNATIONAL CORPORATION, a Delaware corporation, referred to as

"Contractor".

The parties agree as follows:

1. Recitals.

(a) The Mayor and Common Council have called a special
11 municipal election (hereafter "the election") to fill the
]2 unexpired term of Councilman for the Fifth Ward.

(b) The election is to be held on February 16, 1982, in
14 the City of San Bernardino.

(c) It is necessary that election supplies and services
]6 for the election be procured.
]7
(d) Contractor is in the business of furnishing election
]8 supplies and services and has offered to furnish supplies and
]9 services upon the terms stated in this agreement.

2. City agrees to purchase certain election supplies and
2] services required for the election from the Contractor at the
22 prices and upon the terms stated in this agreement at a cost not
23 to exceed $6,000.00. Contractor agrees to prepare and furnish
24 necessary supplies and services in sufficient time to enable City
~ to comply with all requirements of the California Elections Code,
26 the California Government Code, the Constitution of the State of
27 California, the Charter of the City of San Bernardino, and the San
28 Bernardino Municipal Code.

1 3. Unit prices shall be as set forth in Contractor's
2 attached proposal, marked Exhibit "A". The required quantities of
3 supplies shall be determined after the total number of registered
4 voters in the City has been ascertained. Actual quantities
5 required may vary from those estimated in the proposal.
6 4. In addition to the supplies and basic services set forth
7 in Exhibit "A", Contractor will, at no additional charge, furnish
8 the following special services, if and when requested by the City
9 Clerk of City:
10 (a) Provide a detailed calendar of election events,
11 setting out dates and requirements of the California Elections
12 Code.
13 (b) Assist in the conduct of election officers'
14 instruction classes as to proper use of DATAVOTE Voting System and
15 general polling place procedures.
16 (c) Assist in training of the City Clerk',s staff as to
17 election night counting procedures.
18 (d) Provide a qualified computer operator on election
19 day for ballot tabulation, and supervise all counting center
20 procedures.
21 (e) Provide all materials (logs, seals, procedures,
22 etc.) necessary for the central counting center.
23 (f) Make arrangement for delivery of sample ballot
24 booklets to the U.S. Post Office in San Bernardino.
25 (g) Package official ballots, precinct supplies, and
26, other necessary materials, ready for delivery to inspectors.
27 (h) Provide any necessary Spanish translations.
28 (i) Furnish general guidance throughout the election

5. Payment for all supplies and services shall be made upon
a bill or claim filed by Contractor with City's Director of
Finance. The bill or claim shall show the quantity and character
of each supply and service furnished and the sum payable computed
at the appropriate unit price. The bill or claim may be filed at
any time after all of the particular supply or service has been
furnished. The Director of Finance shall verify the claim. If it
is correct, he shall pay it.
6. Contractor is not required to provide or pay for indexes
to the Great Register, precinct maps, postage expense for mailing
of election officer's forms, compensation of election officers,
sums payable for use of polling places or costs of publication of
notices.
7. Contractor agrees that it will place on file with the
City Clerk of City, within ten days after the execution of this
agreement, a corporate surety bond or an irrevocable instrument of
credit in a form satisfactory to the City Attorney, in the amount
of $15,000.00 to guarantee the performance of the work contracted
to be performed.
8. If the special municipal election is consolidated with
the election of another local governmental entity, and conducted
by another local governmental entity, or by the County Registrar
of Voters, this agreement shall be of no further force and effect.
In that event the parties may enter into arrangements for more
limited services by Contractor.

The following prices cover election supplies and rental of voting
equipment (Ballot Punches, Mini-Computer, and Program) required for
the 1982 Special Municipal Election using the DATAVOTE Voting System.
These prices are based on 12 consolidated election precincts and
approximately 7,000 registered voters.
