HomeMy WebLinkAbout1981-631 ~ 1 RESOLUTION NO. 81-631 2 RESOLUTION OF THE CITY OF SAN BERNARDINO REQUIRING A DEPOSIT FOR THE LOAN OF A CAT OR DOG TRAP, REFUNDABLE IF RETURNED 3 UNDAMAGED; ESTABLISHING A RENTAL FEE; AND REQUIRING PAYMENT FOR DAMAGE OR LOSS. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF 5 SAN BERNARDINO AS FOLLOWS: 6 SECTION 1. Recitals. 7 (al City's Animal Control Department loans to City residents 8 cat and dog traps to assist residents in apprehending stray 9 animals within the City. 10 (bl Occasionally, traps loaned to residents of the City are 11 either not returned, or are returned in a damaged condition. 12 (cl The Mayor and Common Council have determined that 13 establishing a deposit, refundable if returned in good condition, 14 and a rental fee will encourage residents to return the traps 15 expeditiously and undamaged. 16 SECTION 2. Deposit; Deduction for Damage. A $20.00 deposit 17 is hereby established for the loan of a cat or dog trap. Any 18 resident of the City desiring to borrow a cat or dog trap from the 19 nimal Control Department shall deposit the sum of $20.00 in cash 20 ith the Department. The deposit shall be refunded to the 21 borrower if the trap is returned to the City in as good condition 22 as when loaned, less any rental fee required hereunder. If the 23 trap is returned only slightly damaged, reasonable repair costs 24 be deducted from such deposit before refund. SECTION 3. Rental Fee. A rental fee of $1.00 per day is 25 26 ereby established for the use of a cat or dog trap. The Animal 27 ontrol Department shall take from such deposits or assess and 28 collect from residents of the City who borrow a cat or dog trap - . - 1 the sum of $1.00 per day from the date the trap is borrowed 2 through the date the trap is returned. 3 SECTION 4. The borrower shall be responsible for return, in 4 good condition, of any trap borrowed. The borrower shall execute 5 a document stating that in the event any such trap is lost or 6 damaged before return, the resident borrowing such trap shall be 7 liable to the City for its reasonable value, or for the reasonable 8 cost of repair. 9 I HEREBY CERTIFY that the foregoing resolution was duly 10 adopted by the Mayor and Common Council of the City of San 11 Bernardino at a regular meeting thereof, held ]2 on the 21st day of December , 1981, by the following 13 vote, to wit: 14 AYES: Council Members Castaneda.
