STAFF REPORT
Pursuant to LAFCO 2584. Annexation No. 347. the Director .of Public Works/City
Engineer and the City Clerk were authorized to proceed with the proposed
annexation of a small unincorporated area North of 40th Street. West of David
Way.
On October 10, 1990. Resolution No. 90-404 was approved, making application to
the Local Agency Formation Commission (LAFCO) for the proposed annexation.
Before LAFCO can issue a Certificate of Filing, Section 99 of the Revenue and
Taxation Code requires that the distribution of property taxes, relative to the
proposed boundary changes, be negotiated and agreed upon by all affected local
agencies. The County Board of Supervisors shall negotiate with the City. any
exchange of property tax revenues on behalf of all affected agencies. except as
provided for in Section 99.1 of the Revenue and Taxation Code. Such negotiations
between the City and County took place in 1980, when County staff and a cowoittee
of City managers agreed upon a formula for property tax transfers. and Resolution
82-325 was adopted June 7. 1982, requesting the Board of Supervisors to direct
the establishment of a policy for the formula.
The adoption of the attached resolution fulfills the City's compliance with said
Section 99 . Exhibit "A" of the resolution. states the actual dollar amounts
proposed for transfer and the local agencies affected.
THIS RESOLUTION MUST BE ADOPTED BEFORE THE 30 DAY DEADLINE OF DECEIIBER 17. 1990,
OTHERWISE LAFCO MUST TERMINATE PROCEEDINGS. WE THEREFORE RECOMMEND ITS ADOPTION.

RESOLUTION OF THE CITY OF SAN BERNARDINO DETERMINING THE A."IOUNT OF
PROPERTY TAX REVENUES TO BE EXCHANGED BETWEEN AND A."IONG THE CITY OF SAN
BERNARDINO AND THE COUNTY OF SAN BERNARDINO. RESULTING FROM THE JURIS-
DICTIONAL CHANGE DESCRIBED BY LAFCO NO. 2643. FOR THE AREA GENERALLY LOCATED
NORTH OF 40TH STREll, WEST OF DAVID WAY
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1. Recitals. The Mayor and Common Council of the City of
San Bernardino hereby find and determine that:
A. Pursuant to Section 99 of the Revenue and Taxation Code. prior
to the issuance of a certificate of filing by the Local Agency Formation
Executive Officer. the governing bodies of all local agencies whose service
area or service responsibilities will be a!~ered by a proposed jurisdict-
ional change will negotiate and determine by resolution the amount of
property tax revenues to be excllanged between and among such local agencies.
B. Except as provided in Section 99.1 of the Revenue and Taxation
Code. in the event that a jurisdictional change would affect the service
area or service responsibility of one or more special districts. the Board
of Supervisors of the County of San Bernardino shall. on behalf of the
district or districts. negotiate any exchange of property tax revenues.
C. The Mayor and Common Council of the City of San Bernardino and
the Board of Supervisors of the County of San Bernardino have determined the
amount of property tax revenues to be exchanged as a result of jurisdict-
ional change described by LAFCO No. 2643.
SECTION 2. Implementation.
A. The negotiated exchange of property tax revenues between the
City of San Bernardino and the County of San Bernardino attached hereto as
Exhibit "A" and incorporated herein by reference. resulting from the above
28 described jurisdictional change. is hereby approved and accepted. The column

1 entitled "Estimated Current Tax Revenue" shall represent the amount of
2 property tax revenues for the current year to be paid to the County of San
3 Bernardino and its affected agencies.
4 B. The annual tax increment generated In the area subject to the
5 jurisdictional change and attributable to the Local Agencies whose service
6 area or service responsibilities will be altered by the proposed jurisdict-
7 ional change shall be allocated in the future years pursuant to the
8 provisions of Section 98 of the Revenue and Taxation Code.
9 SECTION 3. The City Clerk of the City of San Benlardino is
10 hereby directed to certify to the passage of this resolution and to cause a
11 certified copy to be sent to the Executive Officer of the Local Agency
12 Formation Commission of the County of San Bernardino.
