STAFF REPORT
A request was received from the County Transportation and Flood Control
Department to vacate a portion of Fairway Drive at South "E" street. The nomal
street vacation fee of $750 has been waived as this vacation is pursuant to an
agreement between the City of San Bernardino and San Bernardino County Flood
Control District dated July, 1977, for the construction of the South "E" Street
bridge at Fairway Drive.
The property in question lies Southwesterly of Fairway Drive and Westerly of
South "E" Street. When Fairway Drive was re-aligned at its juncture with South
"E" Street it created surplus right-of-way which was to be returned to the Flood
Contro 1 Department.
As the City has no use for the subject property for present or future street and
highway purposes. and as the Streets and Highways Code allows summary vacations
for highways superseded by relocation, Staff recommends that the City summarily
vacate the subject property. This will eliminate the necessity of going through
the entire vacation procedure for the abandonment of the easement under the
provisions of the Streets and Highways code.

RESOLUTION OF TIlE CITY OF SAN BERNARDINO SUMMAR,ILY VACATING THAT
CERTAIN STREET AND HIGHWAY EASEMENT LOCATED SOUTH OF FAIRWAY DRIVE AND WEST
OF SOUTH "E" STREET, IN SAN BERNARDINO.
WHEREAS, the City of San Bernardino relocated a portion of Fairway
Drive West of "E" Street; and
WHEREAS. the street lying within the subject area has been
abandoned by the City and is no longer needed for street and highway
purposes; and
WHEREAS, the San Bernardino County Flood Control District wishes
to develop or otherwise use the land in question, which would utilize the
area encumbered by the street and highway easement.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF
THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
That this summary vacation of the Street and Highway
Easement located West of "E" Street, South of Fairway Drive, is being made
under Section 8330 (a), et. seq., of the Streets and Highways Code, and is
described as follows:
Those portions of Lot 2, Block 54, Rancho San Bernardino,
as per plat recorded in Book 7 of Maps, Page 2, in the
office of the County Recorder of said County, described
as follows:
PARCEL ONE:
That portion of land described in document recorded May
7, 1937, in Book 1204, Page 199, Official Records of said
County, described as follows:
Beginning at a point in the centerline of "E" Street,
distant thereon, South 571.8 feet from the North line of
said Lot 2, said point being the most Easterly of the
Southeast corners of the property conveyed to Ernest J.
Oehl, et aI, by deed recorded in Book 1141, Official
Records, Page 433, Records of said County; thence South
480 40' West, a distance of 362 feet to the centerline of
Colton Road (now known as Fairway Drive); thence South
870 40' East along said centerline of said Colton Road
(Fairway Drive) to said centerline of said "E" Street, a

distance of 340 feet;more or less; thence North along
the centerline of said "E" Street, a distance of 240
feet, more or less, to the Point of Beginning.
PARCEL TWO:
Those portions of Fairway Drive described in documents
recorded July 13, 1915, in Book 577 of Deeds, Page 78 and
June 9, 1915, in Book 565 of Deeds, Page 395, both being
records of said County, lying Easterly from the
Southeasterly line of a 42 foot wide strip of land, the
centerline of said strip described as follows:
Beginning at a one inch iron pipe with tag marked RCE
8613, as shown on Record of Survey recorded February 7,
1964, in Book 21, Page 87 of Records of Survey of said
County, said point being the Westerly terminus of a line
shown as having a bearing of North 860 19' 20" East and a
length of 413.70 feet on said Record of Survey; thence
along the centerline of relocated Fairway Drive the
following courses: Northeasterly along a nontangent curve
concave Northwesterly, having a radius of 300.00 feet and
a central angle of 490 49' 02", a radial from said point
bears South 020 45' 40" East, a distance of 260.84 feet;
thence North 370 25' 18" East, a distance of 74.63 feet;
thence Northeasterly along a tangent curve, concave South
easterly, having a radius of 150.00 feet and a central
angle of 490 48' 51", a distance of 130.41 feet; thence
North 870 IS' 00" East, a distance of 56.00 feet to the
intersection of said centerline of relocated Fairway
Drive with the centerline of "E" Street, and the Point of
Termination, said intersection shown as "E" Street
centerline Station 24+27.00 on United States Army Corps
of Engineers, Lytle and Warm Creeks Project, Santa Ana
River Channel, East Twin Creek to 1-15 Freeway, Phase VI,
Roadway Plan & Profile, Sheet 31.
SECTION 2.
That the Street and Highway Easement referred to
herein,
is unnecessary for present or prospective street purposes
SECTION 3.
That the Mayor and Common Council of said City do
