STAFF REPORT
.
, The sturges Theatre Group was formed in early 1988 and
received a grant of $10,000 to meet the costs of their first
three productions.
However, they were unable to create rapid audience growth and
funds were spent for building sets, storage space and
rehearsal costs. NO income was generated to make them self
supporting.
In 1989 grants were obtained from other sources. The 1990
grant application requested $16,150 for two performances. The
Fine Arts commission at their october 14 meeting recommended
funding of $2,500 to assist with one production.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF AN AGREEMENT WITH THE STURGES THEATRE GROUP FOR
THE PROMOTION OF ARTS AND CULTURE.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
section 1.
The Mayor of the City of San Bernardino
is hereby authorized and directed to execute on behalf of
said city an Agreement with The sturges Theatre Group a copy
of which is
attached hereto, marked Exhibit "A"
and
incorporated herein by reference as fully as though set forth
at length.
Section 2. The authorization to execute the above
referenced agreement is rescinded if the parties to the
agreement fail to execute it within sixty (60) days of the
passage of this resolution.

AGREEMENT
Fine Arts Fundina
THIS AGREEMENT is entered into between the CITY OF SAN
BERNARDINO, a municipal corporation, referred to as "City",
and sturges Theatre Group a non-profit organization, referred
to as "organization".
The parties agree as follows:
1. Recitals.
A. organization has requested financial assistance
from city for the fiscal year 1990-91, in order to assist in
defraying the expense of certain concerts, shows, festivals or
events or activities sponsored by organization as set forth in
organization's grant proposal (hereinafter "the proposal")
approved by the Fine Arts commission of the City, a copy of
which proposal is on file in the Office of CUltural Affairs.
The terms of the proposal are incorporated herein by reference
and shall govern the uses of the funds provided herein. The
financial assistance provided for in this agreement is made on
a one-time only basis, and receipt of said funds shall not
imply a continuing obligation of the city beyond the, terms of

this Agreement.
B. The expenditure is for a valid municipal public
purpose, to wit: for the promotion of theatre art in art
appreciation in San Bernardino, as more fully set forth in the
proposal submitted by organization.
2. Pavment. upon presentation of a claim to the City
Finance Director, city shall pay to organization from the
budget for the 1990-91 fiscal year, the total sum of two

thousand five hundred dollars, to cover the costs per the Fine
Arts grant application agreement.
3.
Use of FUnds.
The funds paid to organization shall
be used soley for the purposes set forth, 'in Paragraph 1 and in
strict compliance with the provisions set forth in
the
proposal. No deviation from the proposal shall be made without
the express approval of the City of San Bernardino. Said funds
shall be expended by June 30, 1991, and any unexpended funds
shall be returned to city by organization.
4.
Accountina.
At such time or times as may be
requested by the City Administrator or Director of Finance of
city, organization shall submit to the city Administrator, with
a copy to the Director of Finance and the San Bernardino Fine
Arts Commission, an accounting of the proposed and actual
expenditures of all revenues accruing to the organization for
the fiscal year ending June 30, 1991. Financial records shall
be maintained in accordance with generally accepting accounting
principles by organization in such a manner as to permit City
to easily trace the expenditures of the funds. All books and
records of organization are to be kept open for inspection at
any time during the business day by the city or its officers or
agents.

Hold Harmless.

damages arising or growing out of the use or receipt. of the
funds paid hereunder and all operations under this agreement.

Payments hereunder are made with the understanding that the
2 city is not involved in the performance of services or other
3 activities of organization. organization and its employees and
4 agents are independent contractors and-are not employees or
5 agents of the city in performing said services.

Termination.
city shall have the right to terminate
7 this Agreement and any funding remaining unpaid hereunder for
8 any reason by mailing a ten-day written notice to organization
9 and this agreement shall terminate ten days after the mailing
10 of such notice. In the event this Agreement is terminated for
11 reasons of improper use of funds or use of funds for any
12 purpose other than those authorized, any unexpended portion of
13

the funds provided by city shall be returned to city. In
addition, organization shall reimburse to City any funds
15 expended which were used for any purposes other than those
16 authorized under this Agreement.

Assianment.

Insurance. organization shall take out and maintain
21 during the life of this Agreement such public liability and
22 property damage insurance as shall insure City, its elective

this Agreement from claims for damages for personal injury,
including death, as well as from claims for property damage
which may arise from organization's or its agents' operations
hereunder, whether such operations be by organization or its

aqents or by anyone directly or indirectly employed by either
orqanization or its aqents, and the amounts of such insurance
shall be as follows:
(a)
Public Liability Insurance;
In an amount not
less than $100,000 for injuries, includinq, but not limited to,
death, to anyone person and, subject to the same limit for
each person, in an amount not less than $100,000 on account of
anyone occurrence:
(b) property Damaqe Insurance. In an amount of not
less than $50,000 for damaqe to the property of each person on
account of anyone occurrence.
(c)
Workers
compensation.
orqanization shall
provide workers compensation insurance in the amount required
by state law if the funds provided hereunder are to be paid as
salary to any employee of orqanization. orqanization shall
require that all riqhts of subroqation under such pOlicy of
workers compensation insurance shall be waived as to city.
City shall be set forth as an additional named
insured in each policy of insurance provided hereunder.
9. orqanization hereby convenants that it has ~aken all
actions necessary to make the adherence to the obliqations
imposed
by this aqreement a bindinq obliqation of

writinq and delivered in person or sent by certified mail,

FAC Grant Application, 1990-91

o Use of 1987 FAC Grant funds.
FAC has made one grant to Sturges Theatre Group. This was
was for two productions in 1987-88. In November 1988, STG
submitted to the City Administrator and FAC a report on
the use of the funds ($10,000). A copy of this report is
included (see Attachment 2).
o STG has given between eight and ten performances of each
production, including one or two matinees. Attendance has
varied between 80 and 350, averaging about 120 for each
performance. At $7.00 admission ($6.00.senior and student
rate) and taking complimentary admissions into account,
the average production to date has yielded box office
returns of approximately $4000.
o Sources of funding other than FAC have been as follows:
a) The Ralph L. smith Foundation: two disbursements
of $5000"each, in February and July 1989
b) TRW Contributions committee: $300, September 1989
c) TRW, Inc. contributed $250 towards the cost of
printing the program for a production in 1989
d) Arts Foundation of San Bernardino County: $1000,
January 1990
e) Miscellaneous contributions totalling approx.
$350 in 1988-90
Total fundraising (other than FAC): $11,900.
o sturges Theatre Group has been recognized for the
outstanding quality of its productions from the start.
Just as noteworthy, the group has offered works
of social and cultural significance such as "Inherit the
Wind" and Arthur Miller's "A Memory of Two Mondays". The
latter production earned more awards from the Inland
Theatre League than any other group in the two counties
received for a whole season of plays. A package of
reviews and articles about Sturges Theatre Group's
presentations is included (see Attachment 3).

o STG's first production of the 1990-91 will be "Arsenic and
Old Lace". The production will be directed by STG's
Artistic Director, Claude Earl Jones. The remaining three
plays of the season will be selected from a list including
"All the King's Men", "Noises Off", "A Funny Thing
Happened on the Way to the Forum", and "Stepping Out".

More than 100 theater awards were
presented Tuesday night to ac-
tors, directors, designers and oth-
ermembers ofInland Empire
theater groupS, during the 15th
annual awards presentation of the Inland
Theater League.
l\early 50 university, college and commu-
nity stage shows produced in San Bernardino
and Riverside counties during the 1989-'90
season were recognized. The ceremony was
held at Harry C's Restaurant in Riverside.
Ten San Bernardino County theater
groups were given 65 awards, with California
State University, San Bernardino, winnning
13 for four productions. Stu es Thea

Other top county winners were Red1ands'
Junior University and Chino Community The-
ater, each with seven awards; and the Univer-
sity ofRed1ands. Redlands Footlighters, Rial-
to Community Players and Redlands Summer
Theatre Festival, each with six.
Seven Riverside County groupS were pre-
sented with 50 awards, with the Ramona Hill-
side Players winning 18 for six shows. Mount
San Jacinto Collece received 13 awards, and
the Riverside community players won 11.
Special awards for contributions to region-
al theater went to Sara Hughes, Sandy Court-
ney, winifred Hanson. Rialto City Council, Ra-
mona Hillside Players, Riverside Community
Players and Rosemarie TriCone.

Bernardino has enjoyed a long association with the Sturges Center Theater
Group, so named because of its primary commitment to productions at this
