Background: On August 15, 2005, the Mayor and Common Council allocated funds, as part of the FY 2005/06 Capital Improvement Program (CIP), for Orange Street failed rock-lined channel reconstruction (SD04-16). A rock-lined channel on the west side of Orange Street, south of Highland Avenue, has failed in several locations. A metal culvert installed at some time in the past for use as an access driveway does not have adequate capacity. It has caused the channel to overflow in large storms, flooding a garage at 2128 Orange Street. Staff proposes removal of the pipe and construction of a box culvert in its place. This project will consist of the replacement of a portion of a rock-lined ditch with a reinforced concrete box culvert with new side walls to transition back to the existing channel walls. The rock-lined channel will be repaired at one location from damage due to tree roots. The rock-lined channel is in the public right of way and conveys street drainage from Highland Avenue and Orange Street, north of Highland Avenue. Rights of Entry's have been obtained from the property owners at 2128 and 2138 Orange Street. This will allow the contractor to enter the properties for reconstruction of the driveway to match the existing improvements on-site. o The plans and specifications for this project have been completed and the project was opened to public bidding on April II, 2006. The project was advertised locally in the San Bernardino County Sun Newspaper, F. W. Dodge, High Desert Plan Room, Construction Bid Board, Reed Construction Data, Bid America, Construction Bid Source, Bid Ocean and the City's web sites, and with the San Bernardino Area Chamber of Commerce. RESOLUTION NO. RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT TO GRAND PACIFIC CONTRACTORS, INC. FOR INSTALLATION OF REINFORCED CONCRETE BOX CULVERT AT 2128 ORANGE STREET (SD04-16) PER PLAN NO. 11568 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Grand Pacific Contractors, Inc., 11405 Geyser Drive, Mira Lorna, CA 91752 is the lowest responsible bidder for Installation of Reinforced Concrete Box Culvert at 2128 Orange Street (SD04-16) per Plan No. 11568 A contract is awarded accordingly to said bidder in a total amount of $45,300.00, with a contingency amount of $6,850.00, but such award shall be effective only upon being fully executed by both parties. All other bids, therefore, are hereby rejected. The Mayor is hereby authorized and directed to execute said contract on behalf of the City; a copy of the contract is on file in the office of the City Clerk and incorporated herein by reference as fully as though set forth at length. SECTION 2. This contract and any amendment or modifications thereto shall not take effect or become operative until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. No oral agreements, amendments, modifications or waivers are intended or authorized and shall not be implied from any act or course of conduct of any party. SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it within sixty (60) days of passage of the resolution.
