Synopsis of Previous Council Action:

Plan. Authorization was given to proceed with the annexation of Arrowhead Springs.

Staff Report
SUBJECT:
Resolution determining the amount of property tax revenues to be exchanged between the City of
San Bernardino and the County of San Bernardino relative to the annexation of unincorporated
territory located in the Arrowhead Springs area, generally northerly and northeasterly of State
Highway 18 and Old Waterman Canyon Road.
BACKGROUND:
On February 21,2006, Resolution No. 2006-45 was adopted, making application to the Local
Agency Formation Commission for expansion of the Sphere of Influence and annexation of
unincorporated territory located in the Arrowhead Springs area, generally northerly and
northeasterly of State Highway 18 and Old Waterman Canyon Road, to be known as Annexation
No. 360.
Pursuant to Section 99 of the Revenue and Taxation Code, agencies affected by a change of
jurisdictional boundaries must negotiate the re-distribution of property taxes for property within
the affected area and respond with a resolution. This must be accomplished within 60 days of
receiving a response from the Auditor-Controller. In this case, the negotiations consist of the
implementation of a formula that was established by the County in 1983.
o Attached for your consideration is a resolution determining the amount of tax transfer that is to
occur between the County and the City upon annexation of this territory. A detail of the amount
to be transferred, by tax rate area, is attaChed as Exhibit "A" to the resolution. The deadline for
submitting the resolution to LAFCO is June 21, 2006.
Upon annexation, the total property tax to be transferred to the City for the area to be annexed is
$5,997.00. The transfer amount is determined using a supplemental formula adopted by the
Board of Supervisors. The amount is minimal because the current owner has a non-profit status
and is exempt from paying various fees. However, because this area is not within a designated
Inland Valley Development Agency or Redevelopment Project area, tax increment funds for
future projects will go directly to the City of San Bernardino.
The proposed development of this site includes: 1350 residential units; 1,044,646 square feet of
existing and new commercial/office use; 199 acre 18 hole golf course; reuse of the historic
Arrowhead Springs Hotel; a new 300 room hotel; a new and reuse of existing conference center;
and the reuse and expansion of the historic Arrowhead Springs spa/resort.
FINANCIAL IMPACT:
Annual property tax revenues in the amount of $5,997.00 will be received after annexation.
Future tax increment funds will go directly to the City of San Bernardino.

CANYON ROAD, TO BE KNOWN AS ANNEXATION NO. 360.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Recitals. That the Mayor and Common Council of the City of San

A. Pursuant to Section 99 of the Revenue and Taxation Code, prior to the
issuance of a certificate of filing by the Local Agency Formation Commission Executive Officer,
the governing bodies of all local agencies whose service area or service responsibilities will be
altered by a proposed jurisdictional change shall negotiate and determine by resolution the
amount of property tax revenues to be exchanged between and among such local agencies.

17 B. Except as provided in Section 99.1 of the Revenue an Taxation Code, in the
18 event that a jurisdictional change would affect the service area or service responsibility of one or
19 more special districts, the Board of Supervisors of the County of San Bernardino shall, on behalf
20
of the district or districts, negotiate any exchange of property tax revenues.

C. The Mayor and Common Council of the City of San Bernardino and the
Board of Supervisors of the County of San Bernardino have determined the amount of
24 property tax revenues to be exchanged as a result of jurisdictional change described by LAFCO
25

3050, for unincorporated territory located in the Arrowhead Springs area, generally northerly and
northeasterly of State Highway 18 and Old Waterman Canyon Road.

RESULTING FROM THE JURISDICTIONAL CHANGE DESCRIBED BY LAFCO 3050.
SECTION 2. Implementation.
A. The negotiated exchange of property tax revenues between the City of San Bernardino
and the County of San Bernardino, attached hereto as Exhibit "A" and incorporated herein by
reference, resulting from the above described jurisdictional change, is hereby approved and
accepted.
SECTION 3. The annual tax increment generated in the area subject to the jurisdictional
change and attributable to the local agencies whose service area or service responsibilities will be
12 altered by the proposed jurisdictional change shall be allocated in the future years pursuant to the
13 provisions of Section 99 ofthe Revenue and Taxation Code.
14 SECTION 4. The City Clerk of the City of San Bernardino is hereby directed to certify
15 to the passage of this resolution and to cause a certified copy to be filed with the Executive
16
Officer of the Local Agency Formation Commission of the County of San Bernardino.
