'j.:".~. ...... .._,-r C I T Y o F SAN BERNARDINO INTEROFFICE MEMORANDUM TO: MAYOR AND COMMON COUNCIL FROM: ANWAR WAGDY, Traffic Engineer SUBJECT: Take Home city Vehicle DATE: OCTOBER 23, 1990 COPIES: SHAUNA EDWINS, ROGER HARDGRAVE, File No. 6.5 - - - - - - - - - - - - - - - - - - - - This is in response to the recent decision to revoke the existing authorization to take my Section's vehicle home. The current authorization to take that vehicle home was one of the items negotiated as a condition of my employment package. Although, that agreement was not put in writing, I consider it a good faith binding oral agreement. Revoking the current authorization from me will not only be a violation of my employment agreement, but also an equivalent to an involuntary salary cut. On the other hand, I dedicate much of my own time to the City outside the normal working hours. My responsibility as a Traffic Engineer does not stop at 4:30 PM nor does it start at 7:30 AM. Most often when I leave the office, I spend one-half hour to an hour reviewing traffic conditions throughout the City, such as signal operation, signage, congestion, etc. Such opportunity to review traffic and circulation conditions at peak hours is outside the normal working hours. This gives me, and the City an opportunity to detect and alleviate problems, review signing and striping work, identify deficiencies for mitigation by developers, etc. If the City vehicle is taken away from me, I will not be able to perform such services and duties using my own vehicle, because of liability exposure. To resolve this problem, I offer the following alternatives: a) Allow me, as a current user, to continue using the vehicle to and from home, until such a time as my position becomes vacant, then the City can stop or renegotiate the vehicle usage. 3h o o o o o MA'iOR AND COMMON COUNCIL Re: Take Home City Vehicle October 23, 1990 File No. 6.5 Page 2 b) If the vehicle must be disallowed, a compensatory monthly vehicle allowance will need to be authorized to compensate for my benefit reduction. Such a cash allowance was authorized to the former Traffic Engineer.
