STAFF REPORT
Prob1_
currently, police officers who arrest persons for certain crimes
are required to gather physiological evidence in order to suc-
cessfully prosecute those persons. Usually, these crimes are for
substance abuse offenses requiring blood withdrawals. The cur-
rent method of relying on county hospital resources for those
blood withdrawals is ineffective, inefficient, and ultimately
costly. I am proposing that the city contract with Western Nurse
Specialists for blood withdrawals and certain other services.
Recommendations
I recommend the adoption of the attached contract (reviewed and
approved by the city attorney) between the City of San Bernardino
and Western Nurse specialists.
Findinas
A survey was conducted in December, 1989, by the Services Cap-
tain which identified the averaae time it took an officer at
county Hospital for certain procedures. The results are summa-
rized as follows:
Blood withdrawals - 48 minutes
Blood Withdrawals and Jail Checks - 2 hrs., 6 minutes
Jail cheiks - 1 hr., 31 minutes
Sex Kits - 3 hr~., 26 minutes
Suspect Sex Kits - 30 minutes
Total Average for 66 instances - 1 hr., 36 minutes.
Western Nurse Specialists has developed a system where their
nurses respond directly to the jail facility to collect the
physiological evidence from suspects within 15-20 minutes 1I2m
the ~ the SUSDect is arrested. As soon as an officer realizes
that he needs physiological evidence, he/she contacts the dis-
patch center who "beeps" the service. In most cases, a nurse can
be standing by at the jail facility when the officer arrives.
This eliminates the time (downtime) required for the officer to
transport the suspect to county hospital, request and receive
service from hospital personnel, and then transport the suspect
to the jail.
Western Nurse specialists has been providing this service to many
of the agencies in Riverside County for a number of years. They
are also currently providing service to the cities of Colton and
Ontario. My staff has contacted those agencies and has received

Specialists perform some of these related functions in the future.

Cost Estimates

County Hospital currently charges the city $20 for each blood
withdrawal. The current listed price from Western Nurse Special-
ists for the same service is $30. Assuming the following facts,
the salary savings in officer down time is listed below.
1. Estimated savings in Time - Assuming that Western Nurse
Specialists can meet our officers at the jail facility within 15
minutes, there is a savings of approx. 33 minutes (compared with
an average county Hospital withdrawal time of 48 minutes). ~

2. Current salary level for top step police officer (including
benefits) - $27.88 per hour ($15.33 for 33 minutes).
3. Estimated cost savings - Given that Western Nurse Specialists
currently charges $10 more than county hospital, the savings for
an average blood withdrawal (in officer down time) is $5.33 each
time. As mentioned previously, this does not factor in the cost
savings in travel time to and from county hospital.
As you know, and as articulated by the mayor, the council and
myself on many occasions, the police department is severely
understaffed. capt. Lewis' survey was conducted over a 14 day
period. During that period there were 18 instances in which
officers took prisoners to county hospital for blood withdrawals
gnly. Bad the contract been in place for Western Nurse special-
ists during that time period the time savings in officer down
time during this period would have averaged 594 minutes (9.9
hours). The salary savings would have amounted to $275.94. The
greatest concern to me, however, is not necessarily the cost
savings. I feel that the additional 9.9 hours could have been
very valuable in our on-going law enforcement efforts.
My staff has been unable to locate any comparable service (with
the same reputation) in this area.
I urge your support and endorsement of our contract with this
service.
Budaet XmDact
CUrrently, the department has budgeted $24,000 to pay county
hospital for blood draws (at $20 each). Past history has shown
that that figure is accurate for the number of blood draws per
year (approx. 1200 draws). I estimate that Western Nurse will
account for approx. 75% of those draws if this contract is imple-
mented. Given a cost of $30 per draw (Western Nurse) for approx.
900 draws and $20 per draw (County Hospital) for 300 draws, the

total expected impact on an annual basis would be $33,000. This
figure would mean an over budqet expense of $9000. Due to the
increase in officer field time and efficiency, I intend on trans-
ferrinq money from the evidence fund in order to cover the $9000
excess (if it occurs).

EXECUTION OF AN AGREEMENT WITH WESTERN NURSE SPECIALISTS, INC. TO
PROVIDE EVIDENCE COLLECTION FOR THE SAN BERNARDINO POLICE
DEPARTMENT
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor is hereby authorized and directed to
7 execute on behalf of said City an Agreement with Western Nurse
8 Specialists, Inc. to provide evidence collection for the San
9
Bernardino Police Department.
A copy of said Agreement is
10 attached hereto, marked Exhibit "A", and incorporated herein by
11 reference as fully as though set forth at length.

SECTION 2. The authorization to execute the
13 above-referenced agreement is rescinded if the parties to the
14

agreement fail to execute it within sixty (60) days of the
passage of this resolution.

AGREEMENT
THIS AGREEMENT is entered into as of this
day of
, 1990, by and between the CITY OF SAN
BERNARDINO, A Municipal Corporation of the State of California,
(hereinafter "CITY"), and WESTERN NURSE SPECIALISTS, INC.,
(hereinafter "SPECIALIST").
RECITALS
A.
WHEREAS, SPECIALIST is a health service which provides
evidence collection for law enforcement agencies; and,
B. WHEREAS, CITY desires to contract with a health
service for the purpose of evidence collection for the San
Bernardino Police Department; and,
C.
WHEREAS, SPECIALIST is willing to provide such
evidence collection for the San Bernardino Police Department;
NOW THEREFORE, the parties hereto agree as follows:
1.
The CITY agrees to pay the following sums for the
following services to be billed monthly, and payment is due
within 30 days of the billing date:

2. CITY agrees to use SPECIALIST exclusively for the
services contained in this Agreement, except in those instances
3 where CITY elects to use the services of the San Bernardino
4 County Medical Center.

CITY agrees that the term of this Agreement shall be
6 for one (1) year subject to termination by the CITY upon thirty
7 (30) days written notice.

SPECIALIST shall make available to the San Bernardino
9 Police Department sufficient information to enable the San
10 Bernardino Police Department to contact the on-call nurse,
11 including, but not limited to, 24-hour on-call phone number,
12 address, and names of nurses, alternate or backup number, if
13 any,

5. SPECIALIST agrees that only licensed female nurses will

As used hereinafter, in this agreement the term
20 "nurse", shall include those who are certified in the State of

23 to withdraw blood in the State of California.

SPECIALIST agrees to make available on an on-call
basis nurses to testify in court, if needed.
CITY is to be
26 charged for actual time in court only, at the rates agreed upon

in Paragraph 1 above.

of this Agreement such medical malpractice, public liability and
property damage insurance naming CITY as additional insured, as
shall insure CITY, its elective and appointive boards,
commissions, officers, agents and employees from claims for
damages for medical malpractice, personal injury, including
death, as well as from claims for property damage which may arise
7 from SPECIALISTS' or its agents', concessionaires', or lessees'
operations hereunder, whether such operations be by SPECIALIST,
its agents, concessionaires or lessees, or by anyone directly or
indirectly employed by SPECIALIST, its agents, concessionaires,
lessees or attendees, and the amounts of such insurance shall be
for medical malpractice, public liability and property damage
insurance in an amount not less than One Million Dollars
($1,000,000) combined single limit.
9. SPECIALIST undertakes and agrees to defend, indemnify
16 and hold harmless the CITY and its officers, agents and employees
17 from and against all suits and causes of actions, claims, costs
18 of litigation, damage or liability of any nature whatsoever, for
19 death or injury to any person, including the employees and agents
20 of SPECIALIST and its concessionaires and lessees, or damage or
21 destruction to any property of either party hereto or third
22 persons in any manner arising by reason of or incident to the
23 performance of this Agreement.
24 This hold harmless provision shall not apply to any breach
25 of the terms of this agreement or to any wrongful or negligent
26 acts or omissions by the City of San Bernardino Police Department

or their officers, agents, employees, representatives and other
third parties.
