Synopsis of Previous Council action:
07-16-90
Authorization was given to proceed with the proposed sale of
certain City-owned parcels.
Authorization was given to do all things necessary and incidental
to the sale of those certain City-owned parcels, including the
payment of appraisal and title services. Also, authorization was
given for the payment of a Real Estate Broker's commission in the
amount of six percent (6t) of the sales price, incidental to the
sale of that certain City-owned property.
Notice Inviting Competitive Bids approved, setting 08-02-90 as date
of opening of sealed bids, and 08-20-90 to hear oral bids.
Real Property Section directed to list properties with MLS Broker
for a period of 90 days, and to lower prices by lot.

STAFF REPORT
The subject properties were appraised by Ralph Monge SRfWA on November II, 1969.
His valuation was the minimum bid price on this parcel of property. When Staff
was directed to list the properties with a Multiple Listing Service Broker, the
prices were reduced by 10%. The original price of this piece of property was
$29,000. With the reduction in price, the total price asking price was $26,100.
The local Board of Realtors was asked to recommend three brokers. The three
brokers recommended were Better Homes and Gardens, Century 21-Showcase and
Spellacy and Associates. The first two offices did not return Staff calls for
several days. The Spellacy and Associates staff was immediately available and
listed the three properties for sale on August 31st. On September 6, Staff
received a full price offer (Spellacy and Associates added the sales commission
to the City's minimum sales price of $26,100 - with the total sales price of
$29,000). There were, however, some deficiencies in the offer, i.e. deposit was
not a 10% Cashier's Check, a different escrow company than the City uses, etc).
A counteroffer was prepared and returned to the proposed Buyer for his
examination and approval.
On September 7, 1990, Spellacy and Associates returned a copy of the signed and
accepted counteroffer and an offer for $100 more than the original offer
($29,100). The second Broker was reminded that the time for bidding on the
property had passed and that the original offer and counteroffer were accepted.
A 60 day escrow was opened at First American Title Insurance Company, with
closing set for November 6, 1990 or earlier. The entire purchase price will be
paid in cash at close of escrow. The estimated cost to the City for the sale is
$3,400: $2900 in commissions to be split between the two Brokers involved, and
approximately $500 as the City's share of one-half of the Title Insurance, escrow
fees and other closing costs. Therefore, the net proceeds to the City will be
approximately $25,600.
Staff recommends the execution of the Grant Deed by the Mayor and City Clerk for
the sale of the surplus real property located at 1215 Colima in the City of San
Bernardino.

RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION
OF A GRANT DEED CONVEYING CERTAIN SURPLUS PROPERTY LOCA1~D AT 1215 COLIMA,
IN THE CITY OF SAN BERNARDINO, TO EXECU SYSTEMS REALTORS OF SAN BERNARDINO,
INC., A CALIFORNIA CORPORATION.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1 .
The Mayor and City Clerk of the City of San
Bernardino, are authorized and directed to execute on behalf of the City, a
Grant Deed conveying certain surplus property located at 1215 Colima Road,
9 at the Southeast corner of Colima Road and Garner Street, to Execu Systems
10 Realtors of San Bernardino, Inc., a copy of which is attached hereto, marked
11 Exhibit "A" and incorporated herein by reference as fully as though set
12 forth at length.
13 SECTION 2. The deed shall be deposited into escrow with First
14 American Title Insurance Company, to be recorded upon the payment, by Execu
15 Systems Realtors of San Bernardino, Inc., of Twenty Six Thousand One Hundred
16 Dollars ($26,100.00), which along with the previous deposit of Two Thousand
17 Nine Hundred Dollars ($2,900.00) is Twenty Nine Thousand Dollars
18 ($29,000.00), the total price for the property.
