STAFF REPORT
Policy guidelines were approved in January 1986 in order to control the
increasing use of public park facilities by non-profit organizations.
Since that time, experience has shown that two changes need to be
implemented to clarify and strengthen the guidelines:
First, paragraph one has been revised to include public agencies.
Second, in an effort to provide use of public properties while at the
same time provide for the least disruption of normal activities for which
parks are established and to alleviate problems which could develop with
carnival activities being held in neighborhood parks, a paragraph 12 has
been added to restrict carnivals to Nunez, Seccombe Lake and Perris Hill
Parks. These three parks have been used successfully in the past with
very few problems and are more suitable for carnival activities because
of location and size.
These revised guidelines were reviewed by the City Attorney's office
and the Parks and Recreation Commission approved the revisions for re-
commendation to the Mayor and Common Council at their September 20,
1990 meetin9.

USE OF PARKS AND PARK PARKING LOTS
BY PRIVATE NON-PROFIT GROUPS EXCLUSIVELY FOR FUND RAISING ACTIVITIES
GUIDELINES
1. Applicant must be a non-profit financially responsible
charitable corporation, which has qualified as an exempt
organization under the prov1s1ons of Internal Revenue Code
Section 501 (c) (3) and Revenue and Taxation Code of the
State of California Section 23701 (d) or be a public agency.
2. Applicant must be a local organization, whose services
or programs are primarily for the benefit of the residents of
the City of San Bernardino.
3. When there are competing applications for the same site
at the same time, they will be evaluated on the basis of the
following criteria:
Qualifications of the organization applying.
The type of programs the applying organ-
ization sponsors.
Prior experience with the particular
organization by the city.
Proposed use of the revenue by the applicant.
Type of proposed use.
Should the department deem two or more final
applicants to have equal qualifications, the
user shall be selected by random drawing.
4. Prior to any use of the parks or park parking lots, the
applicant must demonstrate proof that there will be no
adverse affect from the proposed activity.
5. Any use of the parks or park parking lots under these
guidelines, shall not substantially interfere with any
existing use of the parks and park parking lots or substan-
tially interfere with the public use of the parks.

6. Each user will be required to execute an agreement with
the City of San Bernardino, which will include an agreement
to completely indemnify the city for any liability which may
arise during the use. Proof of insurance within limits
established by the Department will also be required.

8. The department will not approve the use of the parks or

PROCEDURE:
1. A written application must be submitted to the
Department at least 60 days, but not more than 90 days, prior
to the intended use (except for Christmas).

before January 1 of the year of intended use.
