STAFF REPORT
Pursuant to LAFCO 2584. Annexation #347. the City of San Bernardino was directed to
annex the subject property as the cOBpletion of Annexation #347 will complete the
formation of an "island" (the subject of this annexation). The resulting "island"
will be completely surrounded by the City of San Bernardino.
The general area referred to is located North of 40th Street, with Waterman Avenue
located to the West, and David Way located to the Southeast of the proposed
annexation. The area is classified as "uninhabited" by LAFCO as there are fewer than
12 registered voters living in the subject area.
On June 4, 1990, the Director of Public Works/City Engineer was authorized to proceed
with the proposed annexation. The attached resolution and its exhibits is the first
step in filing a formal application with LAFCO, and is attached hereto for your
action.

RESOLUTION OF THE CITY OF SAN BERNARDINO MAKING APPLICATION TO
THE LOCAL AGENCY FORMATION COMMISSION OF THE COUNTY OF SAN BERNARDINO FOR
THE ANNEXATION OF THE TERRITORY LOCATED NORTH OF 40TH STREET, BETWEEN
WATERMAN AVENUE AND DAVID WAY
5 WHEREAS, the Mayor and Common Council as the governing body of the
6 City of San Bernardino desire to initiate proceedings pursuant to the
7 Cortese-Knox Local Government Reorganization Act of 1985, Division 3,
8 commencing with Section 56000 of the California Government Code, for the
9 annexation of the area generally located North of 40th Street, between
10 Waterman Avenue and David Way; and
11 WHEREAS, the territory proposed to be annexed is uninhabited, and
12 a description of the boundaries of the territory is set forth in Exhibit "C"
13 attached hereto and incorporated by reference as fully as though set forth
14 in length herein; and
15 WHEREAS, this proposal is consistent with the sphere of influence
16 of the affected City; and
17 WHEREAS, the reason for this proposed annexation is as follows:
18 1) The City of San Bernardino was directed to initiate the
19 procedures for the annexation of the subject property in order to eliminate
20 the "island" formed by Annexation No. 347.
21 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF
THE CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1.
Application and a proposal is hereby made to the
24 Local Agency Formation Commission of the County of San Bernardino to take
25 proceedings for the annexation of uninhabited territory. located North of
26 40th Street, between Waterman Avenue and David Way, as outlined in the
27 justification form marked Exhibit "A", and the plan and narrative marked
28 exhibit "B", and a full description of the area proposed for annexation

Goven.ent Codes aDd City Ordinances as well as following the City's
General Plan for zoning aDd subject to the provisions of Land Use
OrdiDllDce No. 1991. 1bis function is supported by City tues and

b) PIlI'ks lIIId Recreation - 'l1le Area proposed for llDDel[ation will
have no illpact on park or recreatiODllI facilities or prosr-, aDd no
lldditioDllI services will be required as a result of the llDDeution.

collected through the City tues aDd 11)' required fees charges to
those iDdividuals who wish to participate in City-sponsored
recreational activities where charges aDd fees are applicable.
c) Library Service - It is !.portent to note that the resources
of the entire lilrisry syst_ are readily lllllie available to the
proposed llDDexation, including the Central Lilrary located at 6th aDd
WEW Streets. 'l1le cost for these services are paid through City tues

DivisiOD presently averages 24 Police units OD patrol 24 hours a day,

'lbe Detective DivisioD has 30 norD officers aDd works fro. 8:00
a... to 5:00 p... daily, "ollday through Friday.
'lbe Services DivisiOD _iDtaiDS all records aDd identificatioD
aDd provides support services to the other two DivisiODS OD a 24 hour
a day buis. 'lbe cost for these services are paid through City toes,
aDd beco.e available ~iately upoD lIDIlnatioD.
e) Public Safety, Fire, ParaEdic aDd Rescue - Fire protectiOD
services wi II be provided UJIOD lIDIlezatiOD aDd the affected residents
will be provided with a Class 3 rated Fire depart.eat with eleven
(11) different fire statiODS to respcmd. A typical structural fire OD
the first al~ deploys two (2) engiDe c-..mes, ODe (1) ladder
truck co.pllDy, a paraEdic squad aDd ODe (1) BattalioD Chief. ID
additiOD to fire protectioD, the City also bas a mIU.. of four (4)
paraEdic units OD duty 24 hours a day. Each UDit has two (2)
paraEdics each, giviag a total of eipt (8) paraEdics OD duty at
all t1.es. Also, the City is equipped with helicopter assistance for
rescue aDd/or evacuatioD services when required. 'lbe closest statiOD
to the proposed lIDIlnatioD area is Fire StatiOD No.7, located at 282
W. 40th Street. 'lbe cost for these services are paid through the
City toes aDd beco.e available i-.tiately.
f) Public Safety, A.bulllDCe Service - 'lbe City of San Benulrdino,
UDder OnliDllDCe No. 1987, frllDChise to Courtesy A.bulllDCe Co.plIDy as
the ODly.edical traDSpOrtatiOD carrier within the City limts. 'lbe
rates are established by the above ordiDaDce aDd fees are paid by the
user.
g) Water aDd Sewer services - 'lbe area is currently served by

will reuin to serve this area for the t1.e. 'lbe treat.eat, disposal
aDd reel_tiOD of wastewater is processed by the City of San
Bernardino's Treat.eat Plant. Sewer services would be available to
