STAFF REPORT
A request was received by this office to vacate the East/West alley located
between Guthrie Street and McKinley Street from Frank Schnetz, a local Realtor,
who represents the various owners. This request represents over 90% of those
owners who adjoin the area proposed for vacation.
On 05-21-90, authorization was given to proceed with the proposed vacation, and
Plan No. 8129 was approved.
All of the interested City Departments and Utility Companies were notified
of the proposal on 07-02-90, with a reply due by 08-02-90. The responses are
attached for your information. No reservations of easements were requested, but
concern was expressed by Building and Safety re~arding access to parking behind
rental units, and Public Services for trash pickup, as set forth in the attached
Resolution of Intention. Mr. Schnetz will coordinate these two aspects and find
an acceptable solution to the problems prior to the final vacation of the alley.

which eliminates the necessity of the Negative Declaration
The remaining fee of $375.00 has been paid and it is recommended that favorable
consideration be given to the requested vacation. The Resolution of Intention,
which sets a protest date of 11-05-90 has been attached hereto for your action
also.
Upon the approval of said Resolution, all adjacent property owners will be
notified by mail of the hearing date.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION
TO ORDER THE VACATION OF AN EAST/WEST ALLEY LYING BETWEEN GUTIlRIE STREET AND
McKINLEY STREET, NORTH OF ROCA STREET.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1. That the Mayor and Common Council of the City of San
Bernardino hereby declares its intention to order the vacation of that
certain East/West alley lying between Guthrie street and McKinley Street.
North of Roca Street, described as follows:
That certain East/West alley being a portion of Tract No.
6969, as per plat recorded in Book 8 of Maps, Page 44,
and being a portion of Tract No. 13233. as per plat
recorded in Book 191 of Maps, Pages 85 and 86, in the
office of the County Recorder of the County of San
Bernardino, State of California, described as follows:
Beginning at the Northeast corner of Lot 9 of said Tract
No. 13233; thence West along the North line of said Lot 9
and the North lines of Lots 8. 7, 6, 5, 4, 3, 2, and 1 of
said Tract No. 13233, and the North line of Lot 7 of said
Tract No. 6969. a distance of 619.55 feet, more or less,
to the Northwest corner of said Lot 7, said point also
being the East line of Guthrie Street; thence North,
along a straight line, a distance of 20 feet, more or
less, to the Southwest corner of Lot 6 of said Tract
6969; thence East along the South line of said Lot 6, and
the North line of said Tract No. 13233. a distance of
619.54 feet, more or less, to its intersection with the
Northerly prolongation of the East line of said Lot 9 of
said Tract No. 13233; thence South along said Northerly
prolongation, a distance of 20 feet. more or less, to the
Point of Beginning.
SECTION 2. That the Mayor and Common Council of the City of San
23 Bernardino, in vacating the above described portion of said streets, elects

to proceed under and in accordance with the provisions of the "Public
Streets, Highways and Services Vacation Law", being Division 9, Part 3, of
the Streets and Highways Code of the State of California.
SECTION 3.
That the hour of 10:00 A.M. on the 5th day of,
November, 1990, in the Council Chamber of the City Hall, San Bernardino,

California, be, and the same hereby is fixed as the time and place when and
where all persons interested in or objecting to the proposed vacation may
appear before the said Mayor and Common Council and offer evidence in
relation thereto.
For further particulars as to the proposed vacation of
the hereinbefore described portion of said streets, reference is made to
that map marked "Plan No. 8129" approved May 21, 1990, on file in the
office of the City Clerk of said City.
SECTION 4. That the City Engineer of the City of San Bernardino
hereby is directed to cause Notices of Street Vacation to be posted as
required by the Public Streets, Highways and Services Vacation Law.
SECTION 5. That the City Clerk shall certify to the adoption of
this Resolution of Intention and shall cause the same to be published once a
week for two successive weeks in The Sun, a newspaper published and
circulated in the City of San Bernardino, prior to the date of the above
public hearing.
