STAFF REPORT
Pursuant to a petition received Qy this office March 15, 1990, the Director of
Public Works/City Engineer and the City Clerk were authorized to proceed with the
proposed annexation of a portion of the unincorporated area between Baseline and
Gilbert St., East of Cedar Street.
On May 21, 1990, Resolution No. 90-178 was approved, making application to the
Local Agency Formation Commission (LAFCO) for the proposed annexation.
Before LAFCO can issue a Certificate of Filing, Section 99 of the Revenue and
Taxation Code requires that the distribution of property taxes, relative to the
proposed boundary changes, be negotiated and agreed upon Qy all affected local
agencies. Tbe County Board of Supervisors shall negotiate with the City, any
exchange of property tax revenues on behalf of all affected agencies, except as
provided for in Section 99.1 of the Revenue and Taxation Code. Such negotiations
between the City and County took place in 1980, when County staff and a committee
of City managers agreed upon a formula for property tax transfers, and Resolution
82-325 was adopted June 7, 1982, requesting the Board of Supervisors to direct
the establishment of a policy for the formula.
Tbe adoption of the attached resolution fulfills the City's compliance with said
Section 99 . Exhibit "A" of the resolution, sets forth the actual dollar amounts
proposed for transfer and the local agencies affected.

RESOLUTION OF TIlE CITY OF SAN BERNARDINO DETERMINING TIlE AMOUNT OF
PROPERTY TAX REVENUES TO BE EXCHANGED BETWEEN AND AMONG TIlE CITY OF SAN
BERNARDINO AND TIlE COUNTY OF SAN BERNARDINO, RESULTING FROM TIlE
JURISDICTIONAL CHANGE DESCRIBED BY LAFCO 2620, FOR TIlE AREA GENERALLY
LOCATED NORTH OF BASELINE, EAST OF CEDAR STREET.
BE IT RESOLVED BY TIlE MAYOR AND COMMON COUNCIL OF TIlE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1. Recitals. The Mayor and Common Council of the City of
San Bernardino hereby find and determine that:
A. Pursuant to Section 99 of the Revenue and Taxation Code, prior
to the issuance of a certificate of filing by the Local Agency Formation
Executive Officer, the governing bodies of all local agencies whose service
area or service responsibilities will be altered by a proposed
jurisdictional change will negotiate and determine by resolution the amount
of property tax revenues to be exchanged between and among such local
agencies.
B. Except as provided in Section 99.1 of the Revenue and Taxation
Code, in the event that a jurisdictional change would affect the service
area or service responsibility of one or more special districts, the Board
of Supervisors of the County of San Bernardino shall, on behalf of the
district or districts, negotiate any exchange of property tax revenues.
C. The Mayor and Co_on Council of the City of San Bernardino and
the Board of Supervisors of the County of San Bernardino have deteI'lllined the
amount of property tax revenues to be exchanged as a result of
jurisdictional change described by LAFCO 2620, for the territory generally
located North of Baseline, South of Gilbert Street, East of Cedar Street and
West of the Flood Control Channel.
SECTION 2. IlI1llementation.

City of San Bernardino and the County of San Bernardino attached hereto as
Exhibit "A" and incorporated herein by reference. resulting from the above
3 described jurisdictional change. is hereby approved and accepted. The column
4 entitled "Estimated Current Tax Revenue" shall represent the amount of
5 property tax revenues for the current year to be paid to the County of San
6 Bernardino and its affected agencies.
7 B. The annual tax increment generated in the area subject to the
8 jurisdictional change and attributable to the Local Agencies whose service
area or service responsibilities will be altered by the proposed
jurisdictional change shall be allocated in the future years pursuant to the
provisions of Section 96 of the Revenue and Taxation Code.
SECTION 3.
The City Clerk of the City of San Bernardino is
hereby directed to certify to the passage of this resolution and to cause a
certified copy to be sent to the Executive Officer of the Local Agency
Formation Commission of the County of San Bernardino.

Dear Shauna:
We have placed on the San Bernardino County Board of Supervisors' Agenda
for Monday, September 17, 1990, adoption of the resolutions relating to tax
negotiations for LAFC No. 2620, entitled, "Property Tax Transfer to the City of
San Bernardino, LAFC No. 2620".
Attached is a copy of our recommendations, the resolutions to be adopted
and the breakdown of transfers to be made as submitted to the Board of
Supervisors. When it is approved, the Local Agency Formation Commission
office will send you a copy showing the action taken by the Board.
Senate Bill 180 requires that your city council also adopt a resolution relating
to the tax transfer and forward that to the Local Agency Formation
Commission office.
The final date for submission of our resolution to the Local Agency Formation
Commission is September 21 , 1990.

SUBJECT:
RECOMMENDATION:
Adopt a resolution transferring $7,701 in property tax to the City of San Bernardino as
a result of pending annexation.
BACKGROUND:
State law requires that agreement on distribution of property tax relating to
proposed boundary changes be reached before the Local Agency Formation
Commission issues a Certificate of Filing. On May 19, 1980, the Board approved the
formula for property tax transfers whicll had been agreed upon by County staff and a
committee of city managers.
This action will determine the share of property tax revenue to be allocated as a result
of this jurisdictional change and shall only be effective upon satisfactory completion
of the annexation proceedings.
