Synopsis of Previous Council action:
Resolutions have been approved by the Mayor and Common Council since August
1983 to establish Agreements between the City and School District for delivery
of lunches and snacks to the City's Delmann Heights Head Start Center.
09/11/89 -- Resolution No. 89-393 approved extending the Agreement
for the 1989-90 school year.

RESOLUTION AUTHORIZING THE
EXECUTION OF AN AGREEMENT
RELATING TO DELIVERY OF
LUNCHES AND SNACKS TO DELMANN
HEIGHTS HEAD START CENTER.
STAFF REPORT
The Parks, Recreation and Community Services Department has
provided a Head Start Program at Delmann Heights Community
Center since 1978 with an agreement with City Schools for
lunches and snacks since that time. This program currently
accommodates 15 morning and 15 afternoon pre-schoolers, ages
3-5 and runs September through June.
This proposed agreement includes a $.01 increase for lunches
(from $.94 to $.95). The cost of the snacks remains the same
as last year ($.25). The program is fully funded through a
federal Head Start Grant.
Approval is recommended.

Enclosed are two signed originals of the Food Services Agreement
between the City of San Bernardino and the San Bernardino City
Unified School District. This Agreement was approved by the
Board of Education on August 7, 1990, as attested by the enclosed
Certification of Minutes. Please have both oriainals sianed
after aDDroval bv the citv Counsel and return one to this office.

This Agreement will expire next year on June 30, 1991. If the
city wishes to enter into another Agreement, we would appreciate
if all negotiations could be completed by April or the beginning
of May at the latest, in order for there to be plenty of time for
approval by our respective Boards.

LUNCHES AND SCHEDULE B SNACKS TO CITY'S DELMANN HEIGHTS HEAD
START CENTER.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF
THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino
is hereby authorized and directed to execute on beha1f of
said City an Agreement with the San Bernardino City Unified
School District relating to the delivery of Type A Lunches
and Schedule B Snacks to City's Delmann Heights Head Start
Center, for the term of one year and to provide the student
lunches at ninety-five cents each, a copy of which is
attached hereto, marked Exhibit "A" and incorporated herein
by reference as fully as though set forth at length.

FOOD SERVICES AGREEMENT
(FISCAL YEAR)
THIS AGREEMENT, made and entered into this 8th day of August, 1990,
by and between the SAN BERNARDINO CITY UNIFIED SCHOOL DISTRICT,
hereinafter referred to as "DISTRICT," and the CITY OF SAN
BERNARDINO for its Delman Heights Child Care center, hereinafter
referred to as "CITY,"
R E C I T 1'. L S:
WHEREAS, the CITY desires to have Type A lunches and Schedule B
snacks provided for its Delman Heights Child Care Center; and,
WHEREAS, the DISTRICT has facilities for the preparation of the
needed lunches, and the DISTRICT is willing to provide such service
to the CITY on a cost reimbursement basis;
NOW, THEREFORE, the DISTRICT and the CITY mutually agree as
follc,'!s:
1. '!he tenn of this J\gn!ement shall be fran Jul v 1. 1990 through June
30. 1991, inclusive, bIt may be cancelled by either party upon the
giving of sixty (60) days written notice to the other party. '!his
J\gn!ement may be amended by mutual written consent.
2. Each lunch shall CCIIlply with Type "A" requirements set by the united
states Department of Agriculture for the National Schcol lllnch
Program for students' nutritional needs. '!he contents of the menus
shall contain such items as are ~o:ary to meet these requirements.
3. lllnches shall not include: milk, straws, utensils, or napkins.

required by menu, at or before the lundl. hour each school day,
incll.lClinJ miniInum days, in acx:ordanoe with the number of meals
requested for that day. DISl'RICI' shall only be responsible for
providi.n;J 1l1Ild1es, if ~...-l, on days that are DISl'RICI' school days
ani food is prepared for distribution.
2. Be respollsible for the teup!rature ani quality of the luncl1es at the
t:iJne of delivery.
3. Pick up transport carts.
4. Present CI'IY with an itemized invoice the first day of each month
for the previous month's deliveries.
5. Assume all liability for proper use ani protection of sw:plus
'^-'l,.,.....li.ties assigned to it by the CI'lY.
6. Provide CI'IY with a monthly menu one week prior to the beginning of
the pericxi covered by said menu.
7. Maintain all ~S'ary records on the nutritional canponents of the
1l1Ild1es ani the number of 1l1Ild1es delivered to the CI'lY ani make
said records available for inspection by state ani Federal
autllOrities upon request.
IIxiemni.fy ani hold the CI'IY hannless for any loss, liability, claim,
suit, or judgment, resultin;J fran work or acts done or omitted by
the DIS'lRICI', its officers, enq;>loyees, ani agents, in carrying out
this l\greement.
8.
DISl'RICI' ani the CI'IY further agree that CI'lY SHALL:
1.
Request by teleprone no later than 8:30 a.m.' on the day of the
delivery, an acaIrate number of 1l1Ild1es to be delivered to the CI'lY
Delm:m Heights Child care Ceirt:er. Errors in coont called in shall
be the responsibility of the CI'IY.
Insure that an individual is available at the school at 11:00 a.m.
each school day to receive the requested number of lund1es.
Provide personnel to serve 1l1Ild1es, clean the servin;J ani eatin;J
areas, ani asseniJle transport carts for pick up by DISl'RICI' at 1:30
p.m. on the same school day.
If applicable, establish collection },u.' <-"'lres which are in
accordance with state ani Federal regulations relatin;J to the overt
identification of needy plpils ani keep accurate records of the
number of free, reduced price, paid ani adult lund1es served daily.

If applicable, prepare all claims for rellnbursement urrler its own
agreement number, receive ani approve all free ani reduced price meal
ar;plications, ani maintain all ~~ary records to substantiate the
above items.
6. Assign to DISTRIcr all cornrocx:tities for which the CITY is entitled
ani the liability for use of such c.......r:>Ji.ties.
7. Pay DISTRIcr by the tenth of each IOOnth the full amount as presented
on the JOOnthly itemized invoice.
8. Bear the sole responsibility to properly care for all refrigerated
perishable food items after they have been delivered to the delivery
site by the DISTRIcr until the time of ultimate COI'lSUlIption.
9. Bear the cost of any 1o:3ses resulting f= th~ft or i.''P'-~ storage
once the food or lunches are received or delivered to authorized
CITY personnel; the CITY assumes the responsibility to dispose of
such ani return no food items. If CITY has inProperly ordered IOOre
food than it is able to consume, it shall not be entitled to any
=edit on said items from future food orders.
10. Indemnify and hold the DISTRIcr harmless for any loss, liability,
claim, suit, or judgment, resulting from work or acts done or anitted
by the CITY, its officers, enployees, ani agents, in carrying out
this Agree!re.'1t.
11. CITY certifies it will not dis=iminate on the basis of race, color,
national origin, sex (including sexual harassment), handicap (or
disability), religion, or age in any of its policies, procedures,
or practices in carpliance with:
o Title VI ani VII of the civil Riahts Act of 1964.
