determine that the public convenience and necessity require the proposed maintenance
of landscaping in the Chestnut Area, and that the Special ~ssessment, Investigation
and Limitation 'Act of 1931 shall not apply. (4/5ths roll call vote is required).
2. Adopt Resolution.

STAFF REPORT
Hear protests, if ~lY, and adopt the Resolution Ordering Work in the
Chestnut Area for the maintenance of landscaping.
This is a result of a requirement for Tracts No. 13603 and 13307 and a
request from the owner-developers of the.area. The Subdividers are being
required to install Jandscaping for the entire width of the vacated Chestnut
Avenue adjoining their respective Tracts and to establish the maintenance
district. To assess the two Tracts only for the mainten~ce of this area
which is estimated at $31,354.00 annually would be prohibitive. Therefore
we have included all of the area which adjoins the Chestnut landscape area
which will eventually be included in the District as they subdivide anyway,
to spread the costs more equitably over the larger area of benefit.
As the undeveloped areas in proximity to the Chestnut open space develop,
they will be required to join the district which will require separate
proceedings to expand the district each time there is a new subdivision.
This is not only costly to the Subdividers but very time consuming on our
part, taking the entire area now would be cost effective and time saving.
We therefore recommend that all protests be overruled and the Resolution
adopted.
On August 6, 1990, the Resolution of Intention was passed, which set up the
protest hearing date of September 5, 1990. As required by Chapter 12.90 of the
Municipal Code, the portions of the streets within the proposed district
were posted by the Real Property Section on August 9, 1990; a notice of
improvement was mailed to each of the property owners in the proposed
district; and on August 9, 1990, the Resolution of Intention was published
in the Sun Newspaper. To date, we have received no protests.
The Resolution Ordering the work is attached for your action.

A RESOLUTION OF THE CITY OF SAN BERNARDINO FINDING AND DETERMINING THAT THE
PUBLIC CONVENIENCE AND NECESSlTY REQUIRE THE PROPOSED kAINTENANCE OF
LANDSCAPING IN THE CHESTNUT AREA,CREATING AN ASSESSMENT DISTRICT TO COVER
THE COSTS OF SAID MAINTENANCE, KNOWN AS ASSESSMENT DISTRICT NO. 997, ORDERING
THE WORK AND THAT 11ffi SPECIAL ASSESSMENT, INVESTIGATION AND LIMITATION ACT OF
1931 SHALL NOT APPLY.
WHEREAS, the Mayor" and Common Council of the City of San Bernardino
have preliminarily found that the public interest, convenience, and necessity
require the maintenance of landscaping in a portion of the City, as more
fully hereinafter described, and the appurtenances and appurtenant work and
incidental costs and expenses in connection therewith, that the project is
feasible, and that the lands to be assessed will be able to carry the burden
of the proposed assessments to pay the costs and expenses thereof; and
WHEREAS, the Mayor and Common Council of the City of San Bernardino
have;" on the 6th of August, 1990, passed and adopted Resolution No. 90-338

formatioll of the proposed district, the work to be done or the extent of the
district to be assessed were heard and considered.

NOli, THEREFORE. BE IT RESOLVED BY THE MAYOR A~D COMMOK COUNCIL OF
THE CITY OF SAi\ BERNARDINO AS FOL101;S:
SECTION 1. That a full and fair public hearing having been held.
as stated in the recitals herein, and the Mayor and Common Council. having
heard and considered anv and all comments received thereon and being fully
advised in the premises. her.eby overrules any and all protests received.
SECTION 2. That the public convenience and necessity require, and
tile Mayor and Common Council of the Cit.y of San Bernardino hereby declares by
not less than a 4/5t.hs vote that. the public interest., convenience, and
necessity requires and hereby orders, t.he format.ioll of Assessment District
No. 997; the work described in said Resolution No. 90-338 t.o be done in
portions of the vacated Chest.nut Avenue between Ohio Avenue and Irvillgton
Avenue, as provided ill said Resolution and that the Special Assesslnent.,
Investigat.ion and I.imitation Act of 1931 shall not apply.
SECTION 3. The Cit.y Clerk hereby is directed t.o post a Not.ice lor
five days on or near the door of t.he Council Chambers of the Cit.y Hall
invit.ing sealed proposals or bids when necessary for doing the work ordered
and referring to the specifications on file and to publish a Notice Inviting
such proposals for at least two days in the San Bernardino Sun, a newspaper
published and circulated in said City.
SECTION 4. The contract will be awarded pursuant to the standard
procedures used by the City in the award of Public Works contracts and the
work ordered hereunder shall be to the satisfaction of the City Engineer of

said City, and all of said work shall be done under his direction and shalJ

said work, the City Engineer shall, and he hereby is directed to make the
assessment.
SECTION 5. Reference hereby is made to said Resolution No. 90-338
for a description of the work, the extent of the assessment district, the
financing alternatives dnd for further particulars.
