Synopsis of Previous Council action:
On June 7, 1990, the Environmental Review Committee proposed a Negative Declaration.
On July 24, 1990, the Planning Commission voted unanimously to recommend the adoption
of the Negative Declaration and approval of Tentative Tract No. 14781 withou~ s~cond-

Subject: Tentative Tract No. 14781
Mayor and Council Meeting of August 20, 1990
RROUEST
The applicant, John PUlliam, is requesting the approval of
Tentative Tract No. 14781 with only one standard means of access.
BACKGROUND
Tentative Tract No. 14781 is a proposed subdivision consisting of
19 single-family lots on 7.55 acres located on the east side of
Lynwood Way approximately 176 feet south of Pacific Street. The
project has only one standard means of ingre~s and egress which
is via Valaria Drive to Byron Street or Amanda Street.

4. The Planning Coaaission must make a recommendation to the
Mayor and Common Council for approval of the tentative
map with only one standard means of ingress/egress.
The proposal is located outside the high fire hazard area. On
July 23, 1990, a traffic engineering study was completed on the
project with the finding that a secondary means of access to the
proposed subdivision was not necessary for traffic circulation
purposes (Exhibit A). On JUly 24, 1990, the traffic engineering
study was reviewed and approved by Hr. Anwar Wagdy, the City
Traffic Engineer (Exhibit B). The same day, Hr. William Wright,
the City Fire Chief recommended approval of the tentative map
with only one standard means of access based upon the traffic
engineering study with the conditions that all homes in the tract
have residential sprinkler systems and Class (A) roofs installed
(Exhibit C). These conditions were added to the Conditions of
Approval.

At the July 24, 1990 Planning Coaaission aeeting, the Planning
Com.ission voted unaniaously to adopt the proposed negative
declaration and approve Tentative Tract No. 14781 with the one
standard ,means of access subject to the Findings of Fact,
Conditions of Approval and standard Requirements.
MAYOR AND CQUNCIL OP~IONS
The Hayor and Council may:
1. Adopt the Negative Declaration and approve Tentative Tract
No. 14781 with the one standard means of ingress/egress
subject to the Findings of Fact, Conditions of Approval and
standard Requirements contained in the July 24, 1990 Staff
Report and Addendum;
or,
2. Deny Tentative Tract No. 14781 given that only one standard
means of ingress/egress is provided.
RECOMMENOATION
Staff recoaaends adoption of the Negative Declaration and
approval of Tentative Tract No. 14781 with the one standard means
of access given that the application has aet all requireaents for
an exemption the access requireaents set forth under Hunicipal
Code Section 18.40.160 (B)

The study area bas only one.vehicular ace... to the Pacific
street via Valaria Drive. This acc.ss is a tee inter.ection
and is controlled by stop sign. It is located halfway
~etween two signaliz.d intersections, one mil. apart on
pacific str.et at. Victoria Ave and at Ard.n Ave.
Most of the lots in the study area are dev.l-oped by .ingle
family hou.... The last vacant tract is our subject Tract
No. 14781 which will front on the existinq Lynwood Way.
By field 1n8pection the intersection operates well during
the existiDg conditions.

To e.t.imate the traffic conditions at. Build out of the stUdy

addendum discussing access and circulation for the subdivision
will be provided.
5. RECOMMENDATION
If the applicant is successful in meeting the requirements for an
exemption of the secondary standard access requirements of
MuniCipal Code section 18.40.160(Cl by the Planning Comaission
Hearing, it is recommended that the Planning CommisSion hear
Tentative Tract No. 14781, Should the applicant be unsuccessful
in meeting the requirements in time for the hearing, it is
recommended that Tentative Tract No. 14781 be continued until
August 21, 1990.

Bnvironmental ReView Committee on June 7, 1990. A Negative
Declaration was proposed. The Initial StUdy was made available
for public review and co.ment fro. June 14, 1990 to July 5, 1990.
No comments were received (See Initial StUdy, Attach.ent Rl.
ANALYSIS
Topography and Site Characteristics
The irregularly shaped site is currently vacant, consisting of
tvo parcels totalling 7.55 acres. The property slopes
approxi.ately four to five percent to the south-southwest. It
abuts the San Bernardino County Flood Control District's Sand
Creek on the east and is located in Flood Zone B.
Project Characteristics
The tentative subdivision proposes 19 single fa.ily lots vith a
.ini.u. lot size of 11,350 square feet. The proposed density is
2.51 dvelling units per gross acre, apprOXimately over one-half
of the ..xi.u. density of 4.5 dwelling units per gross acre

Flood Susceptibility
Sand Creek outlets flows froa a large tributary aountainous area
and accuaulated local drainage froa the north. Sand Creek is
able to handle runoff froa aost saall floods, however, it is not
considered adequate to handle aajor flood flows. ~o protect the
site froa potential flood hazards, a scour wall will be
constructed along the western edge of the Sand Creek. I
addition, the project will comply with all Flood Insurance
Association requirements including elevation, coapaction, and
erosion protection of building pads and flood proofing of

Access and Circulation
Primary standard means of access to the subdivision will be via
Valaria Drive and Byron street to Lynwood Way anv Valaria Drive
and Amanda street to Lynwood Way. All lots will front on
Lynwood Way which has a 60 foot right-of-way.
No secondary standard means of access to the tentative
subdivision is proposed. Pursuant to Municipal Code Section
18.40.160(C)(1)(a) a subdivision can be exempted from the
requirements of a secondary standard means of access if the
following criteria are met:
1. The proposed subdivision is located outside the high fire
hazard area;
2. A traffic engineering study approved by the City Traffic
Engineer which finds that a secondary access is not
~equired for traffic circulation purposes;
3. Recommendation by the City Fire Chief, based on the
traffic engineering study, to the Planning Commission
for approval of the proposed subdivision with the one
standard means of access.
A traffic engineering study was prepared for the proposed tract
and was reviewed by the city traffic engineer. The finding of
study was that .the proposed 19 lot subdivision will not impact
area circulation and that Valaria Drive will continue to function
at an acceptable level of service at P.acific Street, and
therefore no' additional access is required.
The project is not located within a high fire hazard area. The
City Fire Chief has reviewed the traffic study and has determined
that a secondary access is required as proposed. However, the
Fire Chief recommends approval of Tentative Tract No. 14781
without a secondary standard .eans of access based upon the
findings of the approved traffic engineering study and the
condition that all ho.es constructed on the lots created by
Tentative Tract No. 14781 shall have residential sprinkler
systems and Class (A) roofs installed. This condition has been
added to the Conditions of Approval.

Minor modifications to the plan shall be subject to approval
by the Director of Planninq. An increase of more than 10
percent of the square footaqe or a siqnificant chanqe in the
approved concept shall be subject to (Planninq Commission and

include a statement that no radio frequency antenna shall
be included within the complex except for central antenna
systems.
b. No lot or dwelling unit in the development shall be sold
unless a corporation, association, property owner's group,
or similar entity has been formed with the right to assess
all properties individually owned or jointly owned which
have any rights or interest in the use of the common areas
and common facilities in the development, such assessment
power to be sufficient to meet the expenses of such entity,
and with authority to control, and the duty to maintain,
all of said mutually available features of the development.
Such entity shall operate under recorded CC 'R's which
shall include compulsory membership of all owners of lots
and/or dwelling units and flexibility of assessments to
meet chanqinq costs of maintenance, repairs, and services.
Recorded CC 'R's shall permit enforcement by the City of
provisions required by the City as conditions to approval.
The developer shall submit evidence of compliance with this
requirement to, and receive approval of, the Commission

Grading and construction could result in temporary impacts on the
physical environment (erosion, drainage, etc.) as well on the
communi~y (dust, noise, etc.). Engineering Department Standard
Requirements and Conditions of Approval will diminish these
potential impacts to a level of non-significance.

The project site is bordered on the east..by the San Bernardino
County Flood District's Sand Creek, and on the south by Upper
Warm Creek, with the Federal Flood Insurance Administration
maps showing the entire site within Flood Zone B. Sand Creek
outlets flows from a large tributary mountainous drainage area
and accumulated local drainage from the north. Although Sand
Creek has interim improvements consisting of an earth graded
channel with rail and wire bank protection and is able to handle
runoff from most small floods, it is not considered adequate to
handle major flood flows. Therefore, in the event of a major
storm, overflow across the site can be expected. The proposed
residential development of the site will require that Sand Creek
be modified adjacent to the site. Per San Bernardino County
Flood Control District and City of San Bernardino Engineering
department recommendations, the following mitigation measures
shall apply and will be included as project Conditions of
Approval:
