Recommended Motion: <COMMUNITY DEVELOPMENT COMMISSION) Adopt a RESOLUTION OF THE COMMUNI~ DEVELOPMENT COMMISSION OF THE CITY OF SAN BERNARDINO, MAKING FINDINGS AND DETERMINATIONS AS TO THE BENEFIT OF THE PROVISION OF CERTAIN EQUIPMENT ITEMS FOR VARIOUS REDEVELOPMENT PROJECT AREAS OF THE CITY. On October 27. 1990, a Tax Exempt Collateralized Mortgage Bond was Issued with net bond proceeds to the Agency of $2.811.340 to be used for the blight reduction program. street Improvements and equipment purchases. The equipment to be purchased with the Collateralized Mortgage Bond proceeds totals $1,028.286. With the approval by the Mayor and Common Council of the City Benefit Resolution. the Community Development Commission must also adopt a Benefit Resolution for the purchase of the equipment listed In Exhibit "A". - o o 1 2 3 RESOLUTION NO. RESOLUTION OF THE COMMUNITY DEVELOPMENT COMMISSION OF THE 4 CITY OF SAN BERNARDINO, MAKING FINDINGS AND DETERMINATIONS AS TO THE BENEFIT OF THE PROVISION OF CERTAIN EQUIPMENT ITEMS FOR 5 VARIOUS REDEVELOPMENT PROJECT AREAS OF THE CITY. 6 WHEREAS, the City of San Bernardino, California (the 7 "City"), is a municipal corporation and a charter city duly 8 created and existing pursuant to the Constitution and the laws of 9 the State of California; and 10 WHEREAS, the Community Development Commission of the City 11 of San Bernardino (the "Commission") on behalf of the 12 Redevelopment Agency of the City of San Bernardino (the 13 "Agency" ), is a redevelopment agency, a public body, corporate 14 and politic of the State of California, organized and existing 15 pursuant to the Community Redevelopment Law (Part 1 of Division 16 24) commencing with Section 33000) of the Health and Safety Code 17 of the State of California (the "Act"); and 18 WHEREAS, pursuant to Section 33445 of the Act, the Agency 19 may, with the consent of the Mayor and Common Council of the City 20 (the "Council"), pay all or a part of the cost of installation 21 and construction of any building, facility, structure or other 22 improvement which is publicly owned either within or without the 23 boundaries of a redevelopment project area if the Council 24 determines: (1) that such buildings, facilities, structures 01 25 other improvements are of benefit to the redevelopment projec1 26 area or the immediate neighborhood in which the project il 27 located, regardless of whether such improvement is within anothel 28 DAB/ses/Equipmen.res August 10, 1990 1 - o o 1 project area, or in the case of a project area in which 2 substantially all the land is publicly owned that the improvement 3 is of benefit to an adjacent project area of the Agency, and (2) 4 thaj::J no other reasonable means of fi~ancing such buildings, 5 facilities, structures or other improvements is available to the 6 community, and such determination by the Agency and the Council 7 shall be final and conclusive: and 8 WHEREAS, in order to provide for the construction and 9 installation of buildings, facilities and structures the Agency 10 must acquire, install and utilize certain equipment which is 11 necessary in order to implement the redevelopment projects of the 12 Agency: and 13 WHEREAS, in connection with assisting in the provision of 14 police facilities, fire facilities, rights-of-way facilities and 15 other such public facilities, certain equipment inherent to such 16 facilities is required in order to allow for the proper 17 functioning of such facilities: and 18 WHEREAS, certain additional equipment is necessary to allow 19 the Agency to provide for the construction and installation of 20 buildings, facilities and structures which are of benefit to the 21 various redevelopment project areas of the Agency: and 22 WHEREAS, it is in the interests of the City and the Agency 23 that the City causes the acquisition of certain equipment, as 24 described in Exhibit "A" attached hereto and incorporated herein 25 by this reference and as hereinafter designated as the 26 "Equipment", to be used in connection with the implementation of 27 28 DAB/ses/Equipmen.res August 10, 1990 2 o - - - o - o o 1 various redevelopment projects within the variouS redevelopment 2 project areas of the City: and 3 WHEREAS, the provision of the Equipment will promote the 4 development of redevelopment project areas within the City which 5 the Meadowbrook-central City Project project areas include: 6 Area, Central City North project Area, Central City East project 7 Area, Central City South project Area, Central City West project 8 Area, Tri-City Project Area, Southeast Industrial Park Project 9 Area, South Valle project Area, State College project Area and 10 the uptown Project area, to the extent that it will enable the 11 Agency to undertake and promote redevelopment activities within 12 such areas and thereby assist in the elimination of blight withi~ 13 such areas: and 14 WHEREAS, in order to promote the City's health, safety an< 15 welfare and ensure the orderly development of the Agency'l 16 project areas, it is important that the equipment necessary fo: 17 the implementation of the redevelopment plans within the Agency' 18 project areas be financed by the Agency: and 19 WHEREAS, it is appropriate at this time for the Commissio 20 to make certain findings and determinations and take certai 21 action with respect to the acquisition of the necessar 22 Equipment. 23 24 25 / / / / / / / / / / / / 26 27 DAB/ses/Equipmen.res August 10, 1990 3 28 ~- o o 1 NOW, THEREFORE, THE COMMUNITY DEVELOPMENT COMMISSION OF THE 2 CITY OF SAN BERNARDINO, CALIFORNIA, DOES HEREBY FIND, RESOLVE, 3 DETERMINE AND ORDER AS FOLLOWS: 4 SECTION 1. The Recitals hereinabove are true and correct 5 and are incorporated herein by this reference. 6 SECTION 2. The commission consents to the payment by the 7 Agency of the cost of the equipment described in Exhibit "A" to 8 be acquired for use by the Agency in order to implement the 9 redevelopment plans of the Agency for the reasons set forth in 10 the Recitals hereinabove. The Commission further finds and 11 determines that no other reasonable means of financing the 12 acquisition of the equipment is presently available to the City 13 and that the City and the Agency require the use of revenues 14 generated from the project areas of the Agency in order to fund 15 the acquisition of the equipment. 16 SECTION 3. The provision of the equipment will allow the 17 Agency to promote redevelopment within the project areas of the 18 City which will help stimulate development of such project areas 19 and their immediate neighborhoods which will in turn help 20 eliminate blight within such project areas and surrounding 21 neighborhoods. 22 SECTION 4. The Secretary is hereby authorized and directed 23 to cause this Resolution to be transmitted to the Council for 24 consideration in connection with appropriate action by that body. 25 SECTION 5.
