RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF AN AGREEMENT WInI THE COUNTY OF SAN BERNARDINO
RELATING TO THE DESIGN AND CONSTFUCTION OF A METAL BEAM GUARl)-
RAIL ON THE EAST SIDE OF DEL ROSA AVENUE, FROM CARPENTER
STREET NORTH TO FOOTHILL DRIVE.
BE IT RESOLVED BY THE ~~YOR ANl) COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino is
hereby authorized and directed to execute on behalf of said City
an a~reeMent with the County of San Bernardino relating to the
design and construction of a metal beaM guardrail on the east
side of Del Rosa Avenue, from Carpenter Street north to ~oothill
Drive, a copy of which is attached hereto, Marked Exhibit "A"
and incorporated herein by reference as fully as though set
forth at length, but such award will be effective only upon the
contract being fully signed.
SECTION 2. The contract authorized by this resolution
shall not take effect until fully signed and executed by both
parties.
Neither party shall be obligated hereunder unless and
until the contract is fully executed and no oral agreement
thereto shall be iMolied or authorized.

IT IS HEREBY AGREED AS FOllOWS:

for performance or completion, determination of satisfactory performance and cause for termination, other terms and
conditions, and attach plans, specifications, and addenda, if any.)
WHEREAS, the east side of Del Rosa Avenue from Carpenter Street to
Foothill Drive is adjacent to the Del Rosa Channel, a County Flood Control
District facility; and .
WHEREAS, the above described section of Del Rosa Avenue is partly within
the incorporated area of the CITY and partly within unincorporated area of
the COUNTY; and
WHEREAS, the CITY and COUNTY desire to cooperate and jointly participate
in a project to improve traffic safety by the installation of guardrail and
to improve the appearance of the roadside by the maintenance of Oleander
plants anticipated to be planted by the County Flood Control District following
the installation of guardrail; and
WHEREAS, the CITY and COUNTY desire to set forth the responsibilities
and obligations of each agency in regard to the installation, maintenance
and funding of guardrail and maintenance of the Oleander plants.
NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS:
COUNTY SHALL:
1. Act as the lead agency for the design and construction of metal
beam guardrail on the east side of Del Rosa Avenue from Carpenter
Street north to Foothill Drive.
2. Coordinate the project with affected utilities and arrange for any
necessary utility relocations.
3. Bear the cost of the installation of guardrail on the approximately
11000 lineal feet lying within the unincorporated area of the
COUNTY plus eighty (80) percent of total cost of preliminary and
construction engineering. Estimated COUNTY share of the project
cost is estimated to be $120,000.

4. Require its contractors 1;0 maintain W::lrker's Canpensation Instjrance,
on all employees ana a Public and Property Liability insurance FOlicy
of not less than one million dollars ($1,000,000) canbinerl single

5. Upon COIlpletion of the =rk, provide the CITY a sunrnary of costs
and a billing for CITY'S share.
CITY ffiALL:
1. ReiJnburse the cnUNTY for the costs incurrerl in the construction of
guardrail on the approximately 1000 lineal feet lying within the in-
corp:>rated area of the CITY (fran Marshall Boulevard north to Eureka
Street), plus twenty (20) percent of the total cost of preliminary and
construction engineering. Estimated CITY share of the project cost is
$30,000. The CITY obligation under this 'agreenent shall not exceerl
$30,000 unless prior approval is obtainerl fran the Mayor and Ccmron
COuncil.
2. Maintain all Oleander plants anticipated to be planted by the County
Flood Control District along the entire length of. the project including
necessary watering and trimning.
BE IT FURl'HER AGREED. 'lHAT:
1. Neither party to this l\greenent nor officers nor enployees thereof
shall be responsible for any damage or liability occurring by reason
of anything done or anitterl to be dbne by the other party to the
l\greenent under or in connection with any =rk authority or jurisdic-
tion not delegated to the parties urrler this Agi'eanent. It is also
agreed that, pursuant to Governrrent Code Section B95.4, each party
shall fully indemnify and hold the other party harmless fran any
liability imposerl for injury (as definerl by Governrrent Code Section
BIO.8) occurring by reason of anything done or anitted to be done
under or in connection with any =rk, authority or jurisdiction under
this Agreerrent.
2. Upon completion of the guardrail construction, the CITY and cnUNTY
will maintain the portion of the guardrail within their respective
areas of jurisdiction.
3. County participation in the project is subject tQ inclusion of
necessary funding for the cnUNTY share in the 19B6-87 County Road
Budget.

SUBJECT:
RECOMMENDATION: Approve cooperative agreement between the County and City
of San Bernardino for the installation of guardrail on the east side of Del
Rosa Avenue from Carpenter Street to Foothill Drive. .
COUNTY/CITY OF SAN BERNARDINO COOPERATIVE AGREEMENT - DEL ROSA AVENUE
BACKGROUND: A major flood control channel is located along the east side
of Del Rosa Avenue. Due to increasing traffic volumes on Del Rosa Avenue,
currently averaging over 10,000 vehicles per day, it is desirable to reduce
traffic hazards on the street by the ins1;allation of guardrailing between
the roadway and channel. The portion of the project between Marshall Boulevard
and Eureka Street (approximately 1,000 feet) is within the City and the
remainder of the project (approximately 4,000 feet) lies in unincorporated
area of the County. The County will act as the lead agency to implement the
project with each agency bearing a proporti onate share of the costs. The
agreement further provides that the City will maintain Oleander plants along
the entire project which are planned for planting by the County Flood Control
District. The project is scheduled to be advertised for bids in October,
1986. The County will be the lead agency.

REASON FOR RECOMMENDATION: Execution of thi-s agreement is needed to set
forth the responsibilities and obligations of each agency in regard to the
installation, maintenance and funding of the guardrail and maintenance of
the oleander plants.
REVIEW BY OTHER DEPARTMENTS: On May 15, 1986 the agreement was approved by
Deputy County Counsel Ed Robinson as to legal form. On May 12, 1986 the
agreement was found to be consistent with County Affirmative Action policies
by the Department Contract Compliance Officer.
FINANCIAL DATA: The total cost of the proposed installation of guardrail
is estimated to be $150,000. Twenty percent (20%) of the actual cost will
be reimbursed from the City upon completion of the project. No funds are to
be encumbered under this agreement as no obligation will be incurred until
the Board awards a construction contract. The project is included in the
proposed FY 1986-87 County Road Budget.

Dear Manuel:
This is in follow up to our recent conversations regarding cooperative
efforts between the City and County on the following projects that are of mutual
concern.
1. Del Rosa Avenue - Guardrail and plantings.
Attached for your review is a draft cooperative agreement for construction
of standard metal beam guardrailing along the east side of Del Rosa Avenue
along the entire reach of almost one mile where the channel is immediately
adjacent to the street. We tentatively propose construction for late summer.
As you will note we have included a provision in the agreement which makes
the County participation subject to inclusion of funding in the FY 1986-87
County Road Budget. The agreement also provides that the City will perform
the maintenance on the Oleander plants.":
We have obtained information from the Southern California Gas Company that
the high pressure main we were concerned about is generally under the road
pavement so pending more detailed location work we now feel the conflicts
will be minimal.
Our current tentative scheduling is to advertise for bids in late June with
construction in August.
2. Pumalo Street - Resurfacing (Del Rosa/Sterling)
We have submitted a requisition for issuance of a purchase order to cover
the County share of the cost which you have estimated to be $7,700. You
mentioned that you will seek City Council approval at the March 3, 1986
Council meeting.
We appreciate your continuing cooperation on the n merous items that we
are working on. As you know, this spirit of cooperation is very important to
efficiently provide needed services in areas of split juri diction. Please call
me or John Steger if you need any additional information 0 would like to discuss
any of these items.
