Planning Commission's Denial of
90-09 for Review of Plans No. 89-
REOUEST
The applicant, Mr. Jimmie N. Cartee, is appealing the denial
of Variance No. 90-09 for Review of Plans No. 89-87 by the
Planning Commission. The applicant requests that the Mayor
and Council reconsider the denial and approve the variance
request.
BACKGROUND
Review of Plans (ROP) No. 89-87 is a proposal to construct a
two-story contractor's office and warehouse with outside
storage on a 1.15 acre site located 900 feet north of Mill
Street on the west side of Allen Street in the CH, Commercial
Heavy land use designation. The applicant has also requested
a variance from Code section 19.56.380 to use magnesium
chloride or 6-inch's of slag in lieu of paving the outside
storage area to accommodate heavy equipment/loads.
The Environmental Review Committee recommended that a
Negative Declaration be adopted for this project on May 17,
1990. No public comments have been received. On July 24,
1990, the Planning Commission approved the Review of Plans,
but denied the variance by a 4 to 3 vote.
Approximately 24,000 square feet of outside storage area will
be used to store construction equipment and materials .
associated with the plastering business. These types of
equipment and materials are heavy and will rapidly damage
asphaltic surfaces, especially during the high temperature
summer months. The City Attorney's Office objected to the
granting of the variance during the Planning Commission
public hearing and suggested that a more appropriate avenue
of recourse was to amend the Code to allow these types of
uses on a different surface.
BASIS OF APPEAL
The main basis of the appeal is that this particular use
would damage the asphalt over time, and that the alternate
proposed surface of slag or magnesium chloride would be more
practical and control dust.

OPTIONS AVAILABLE TO THE MAYOR AND COUNCIL
The Mayor and Council may deny the appeal and approve ROP No.
89-87 without approving the variance or uphold the appeal and
approve ROP No. 89-87 and Variance No. 90-09. If it is the
decision of Council to amend the Code, then Council could
direct staff to prepare the amendment. In order not to delay
the applicant from proceeding with this proposed development,
the ROP could be approved, without approval of the variance.
The review process for building permits could then proceed
and hopefully the timing of the need to construct a surface
would coincide with an ordinance amendment's effective date.
RECOMMENDATION
Staff originally recommended approval of ROP No. 89-87 and
approval of Variance No. 90-09 to the Planning Commission.
However, due to a number of variance requests with these
circumstances and the City Attorney's Office concerns about
appropriate variance findings, staff is recommending that the
Municipal Code be amended to allow appropriate surfacing
materials based on the type of use, and that ROP No. 89-87 be
approved conditioned to complying with City Codes regarding
surfacing, as amended.

On July 22,1990 the Planning Commission denied Variance No. 90-09
thus denying my client Mr. Clinton Caston, the use of magnesium
chloride or six inches of slag ground surface for his storage
area. The storage area is to be used for stopage of PLASTERING
equipment (scaffolds, planking, mixers, etc.). The intent of
this letter is to issue a formal appeal of the decision made
by the City of San Bernardino Planning Commission.
Justification for the Appeal,
1. The use of asphaltic concrete in the storage area will not
stand up to the weight of the equipment during the high
temperatures during our summer months. A slag or magnesium
chloride treatment has proven to be practical in this type
of operation and either method will control all dust, particulary
in a high wind area.
2. To support our argument the Variance No. 90-09 was supported
by the Planning Department, Building Department, and the City
Attornenys Office. The City Attorneys Office, are now proposing
and amendment to the citys ordinance to allow the use of slag
or magnesium chloride dust preventative products for storage
areas to house equipment, however it will require two to three
months be for this can happen.
3. My client Mr. Caston, has been zoned out of his present location
on Watermant Ave. by the new General Plan, and there for can
not improve his present location, he therefore wants to move
to a properly zoned parcel of land, build a new office,
warehouse, and storage yard.
Conclusion:
Mr. Caston and his business of Plastering is a credit to our City,
he maintaines a large employment and it would be to the City of
San Bernardinos loss to be forced into moving to another area.
These are the primary reasons that dustify his request for granting
this Variance No. 90-09..

Under the authority of Municipal Code, Section 19.83.300, the
applicant requests approval to construct a two-story contrac-
tor's office and warehouse with outside storage. The appli-
cant also requests a variance from Code, Section 19.56.380,
to use magnesium chloride or 6-inch slag in lieu of paving
the outside storage area. The applicant is requesting the
use of either of these alternative surfacing materials to
accommodate the heavy equipment loads.

The proposed contractor's office and storage facility is in
conformance with the Municipal Code and General Plan.
However, the use of slag or magnesium chloride in lieu of
paving the outside storage area is not consistent with
Municipal Code, Section 19.56.380. A Variance from this Code
Section is requested (see Attachment A).
CALIFORNIA ENVIRONMENTAL OUALITY ACT
An Initial Study was prepared and presented to the Environ-
mental Review Committee (ERC) on May 17,. 1990. The ERC
rScommended a Negative Declaration. The Initial Study was
advertised and made available for public review and comment
from May 24, 1990 to June 13, 1990; no comments. were received
(see Attachment F).
BACKGROUND
On May 17, 1990, the Development Review Committee (DRC)
reviewed Review of Plans No. 89-87. At that time the DRC
approved the proposal with the paving of the outside storage
area with asphaltic concrete or concrete, as outlined in the
Municipal Code. However, because asphaltic concrete would
not be able to withstand the weight of the equipment to be

stored, the owner chose to request a Variance to allow the
use of either magnesium chloride (a chemical treatment) or 6-
inch slag in lieu of paving the outside storage area.
In addition, Lot Line Adjustment No. 90-07 was approved by
the DRC on April 12, 1990. This allowed for the reconfigura-
tion of three lots into two lots of approximately 7,500
square feet and 49,725 square feet. The 49,725 square foot
lot will be developed with the proposed contractor's storage
lot. The smaller lot was created in order to preserve an
existing single-family residence.
ANALYSIS
Permitted Use
The proposed office and warehouse with outside storage is
permitted in the CH, Commercial Heavy land use designation
with approval of a Review of Plans and approval of a Variance
to allow the use of slag or magnesium chloride in lieu of
asphaltic concrete or concrete for the outdoor storage area.
Design
The proposal consists of a two-story office and warehouse
building with outside storage on approximately 1.4 acres. The
proposed building is 6 feet from the front property line,
allowing for adequate front-yard landscaping. The office
portion of the building is approximately 24-feet in height
and steps down approximately 7 feet at the warehouse portion
of the building. The two-story portion of the building faces
Allen Street. In addition, a 1,050 square foot open storage
area with roof is proposed at the rear of the building. The
remainder of the site, to the rear, is proposed "for uncovered
outside storage (see Attachment G).
Requested Variance
The applicant has requested a Variance for the waiver of
surfacing requirements for the proposed outside storage area.
The approximate 24,000 square foot outside storage area will
be used to store construction equipment and materials
associated with the plastering business. These types of
equipment and materials are quite heavy and will rapidly

damage asphaltic surfaces, particularly during the high
temperature summer months. A slag or magnesium chloride
treatment has proven to be practical in these types of
operations; either of the two alternatives will control dust.
Other storage facilities in the City, particularly in the
City's high wind area, have been utilizing a slag or
magnesium chloride dust palliative successfully.
Screening
The storage area will be screened with a 6-foot high chain
link fence with metal slats. This chain link fence will be
placed at the rear property line and at the side property
lines starting 15-feet back from the front property line. A
6-foot high decorative wrought iron fence will be placed in
the front yard outside the required 6-foot setback. The
wrought iron fence will have a 20-foot sliding gate at the
two-way driveway and a swing gate at the exit driveway. In
addition, a 6-foot wide decorative block wall is proposed at
the northeast corner of the site in a diagonal position. This
wall will provide and additional area for landscaping and
will serve to screen the refuse enclosure and parking area.
Traffic, Circulation and Parking
Two paved driveways will provide adequate egress and ingress
to the proposed site. A 25-foot wide two-way driveway is
proposed north of the building and a one-way 15 foot driveway
is ~roposed to the south. In addition, thirteen parking
spaces and one loading space are provided as required by
Code. Traffic circulation, and parking as proposed have been
deemed adequate by the Public Works/Engineering Department,
ERC, and DRC.
Setbacks and Landscaping
The proposal allows for a 5-foot wide landscaped front
setback, 5 feet required by Code, in addition to providing
approximately 9% interior landscaping in the parking area (5%
is required by Code). Three trees are located on the subject
site and 1 tree , a Coast Live Oak is located in the City
right-of-way. As a result, an arborist report was submitted
to the Planning Department. Due to the poor condition of the
four trees located on the lot, the owner will be required to

hood is in transition from residential to heavy commercial. A
few of the residences have been demolished to make way for
new construction, while others continue to be occupied as
residential dwelling units.
The vacant site abuts the A.T. & S.F. railroad to the west
and single family residences are located north and south of
the subject site. A number of single family residences and a
freight storage facility (Viking Freight System leasing) are
located across the street to the east. A truck storage and
leasing facility (Ryder Truck storage and Leasing) is also
located at the northeast corner of Valley and Allen Streets.
In addition a single family residence south of the site has
been converted into a construction office and storage
facility, it is partially paved.
CONCLUSION
The project proposal meets the development requirements of
the San Bernardino Municipal Code with granting of the
r~quested Variance. The request for a Variance to provide an
alternative surfacing material in lieu of paving appears
reasonable based on the nature of the proposed business and
compatibility with surrounding uses.

conditions applicable to the property involved, or to
the intended use of the property, which do not apply
generally to other property in the same zoning district
and neighborhood in that the nature of the proposed
business of storage of heavy equipment necessitates a
surface which can withstand in the weight without
repeated damage. Slag or magnesium chloride are paving
alternatives which will withstand heavy weight.
2. The variance is necessary for the preservation and
enjoyment of a substantial property right of the
applicant in that the waiver of the paving requirement
is necessary for operation of the proposed business and
will provide a practical solution that has been proven
successful in other similar operations.
3. The granting of the variance will not be materially
detrimental to the public welfare of injurious to
property and improvements in the zoning district and
neighborhood in which the property is located in that
the property is located in a heavy commercial land use
designation. In addition, other industrial properties
in the city of San Bernardino including properties in
the high wind area, have utilized these alternative
surfacing materials with no complaints of dust or damage
from heavy equipment loads.
4. The granting of such a variance will not be contrary to
the objectives of the General Plan in that slag,
magnes~um chloride and other acceptable surface
materials have been allowed for similar uses in the City
of San Bernardino.
NOTE: State Law findings for variance differ in that
findings #1 reads: "Because of special circumstances
applicable to the property, including size, shape,
topography, location of surroundings."

The developer shall provide for adequate Fire Flow as computed by the Fire Prevention Bureau. Fire Flow shall be based
on square footage, construction features and exposure information as supplied by the developer and may be taken from two
hydrants.

f) Private fire hydrants shall be installed to protect each building located more than 150-feet from the curb line. No fire hydrant
should be within 4o-feet of any exterior wall. The hydrants shall be Wet Barrel type, with one 2i-inch and one 4-inch outlet,
and approved by the Fire Department. Fire hydrants are to be protected from damage by providing suitable traffic barriers.
The area around the fire hydrant shall be designated as a "NO PARKINGn zone by painting an 8-inch wide, red stripe for 15-feet
in each direction in front of the hydrant in such a manner that it will not be blocked by parked vehicles. Suitable IlNO
PARKING" signs are required.
() Public fire hydrants shall be provided along streets at 300-feet intervals for commercial and multi-residential areas and at
500-feet intervals for residential areas. Installation shall conform to City specifications and be installed prior to combustible
construction or storage.

BUILDING:
A The address of the structure, in six inch numerals, shall be installed on the building or in other approved location in such a
manner as to be visible from the frontage street. The color of the numbers shall contrast with color of the background.

RE: Appeal of Variance No. 90-09 for Review of Plans
No. 89-87
Dear Honorable Mayor and City Council:
We have reviewed the proposal and discussed the variance
for the Planning Department of the above-mentioned variance
and we find unacceptable this type of storage yard in our
neighborhood.
Even though zoning allows this type of use,we find it
necessary that we request the City to require this project,
and other future project, to have consideration for the
residents that have priae of ownership of their homes. There-
fore, we are requesting that you require this project to
commit to at least H city standard, if not more. For example,
instead of chain link fencing with slats, at least chain link
with some type of barrier landscaping through the fence and,
more preferably, a block wall would be desirable. Secondly,
a setback from the curb with some type of attractive landscaping
that would hide any type of unsightly view from the street.
More importantly, six-inch slag cannot be ~llowed but attractive
paving with interior landscape garden should be at least a minimum
because all black hard paving is very unattractive to any
development.
We have discussed this project with several of the neighbors and
we are in agreement that we cannot continue to allow block walls
to be built to the sidewalks or trucking companies to build
terminals without enough parking for their employees. Neverthe~
less, the Viking Truck Company has become a nuisance not only to
the older people with the continuous noise, but also to the
children that ride their bikes cautiouslytittbugh.the unsafe driving
tactics of the Viking drivers.
