8-21-89 - Adopted Resolution of Intention and Resolution preliminarily
approving the Engineer's Report.
11-20-89 - Adopted resolution describing changes proposed in improvements
12-18-89 - Held public protest hearing and adopted resolutions ordering
changes in improvements, confirming the assessments, ordering
the construction of improvements and awardin~ the contract.
2-19-90 - Adopted resolution determing the amount of unpaid assessments
and authorizing issuance and sale of bonds.
Recommended motion:
Adopt the Resolution.

STAFF REPORT
On February 19, 1990, the Mayor and Common Council approved the issuance
and sale of $1,101,681 1915 Act Bonds for improvements in the Industrial
Parkway Improvement District. The bonds are paid for by annual assessments
placed on the property tax bill through the County. They are submitted
to the Auditor and then placed on the County property tax bill. The
assessments are then collected by the County and forwarded to the City.
The procedures for collection are laid out in the California Streets and
Highway Code. In the past for 1915 Acts, the County Auditor has not re-
quired the submission of a specific resolution incorporating this
Code section dealing with the assessments and their collection. However,
this year they are requiring it on any new bond issues. This requirement
is in addition to the Resolutions filed with the Recorder's Office.
Because of this new requirement, Bond Counsel, Mr. Richard Anderson of
Best, Best & Krieger, reviewed the documents for this issue and is
recommending the adoption of this additional resolution that will
specifically reference those sections of the State Street and Highway
Code dealing with the Auditor's responsibilities dealing with the
filing and collecting of assessments in relationship to 1915 Bond Acts.
This needs to be adopted at the August 6, 1990 meeting so that the
assessments can be filed by the County deadline of August 10, 1990.

AMOUNT OF THE ASSESSMENTS REMAINING UNPAID
AND AUTHORIZING THE COUNTY AUDITOR TO
COLLECT THE ANNUAL INSTALLMENTS OF PRINCIPAL
AND INTEREST ON SUCH ASSESSMENTS

WHEREAS, on January 3, 1990, the Mayor and Common

WHEREAS, on February 21, 1990, the Common Council
14 adopted Resolution No. 90-57, determining, among other matters
15 that the assessments remaining unpaid and upon the security of

which bonds have been issued for the Assessment District is the
amount of $1,101,681.82; and
WHEREAS, pursuant to Section 8682 of the Streets and
Highways Code, a copy of the order of the Common Council deter-
mining the assessments remaining unpaid and upon the security of
which bonds have been issued shall be filed in the office of the
County of San Bernardino;

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA AS FOLLOWS:
Section 1.

Section 2. County Auditor. A certified copy of this
resolution shall be filed with the County Auditor of the County
of San Bernardino pursuant to Section 8682 of the Streets and
