Steel had been stored in this easement, which precluded installation of the sewer main. San Bernardino Steel was notified to remove the steel from the easement area, in order to allow the sewer main to be installed. However, after repeated assurance by the President of San Bernardino Steel that the steel would be removed from the easement, the steel was still in place when the Contractor was ready to begin work. The Contractor was prevented from working for 26 working days. During this time, his equipment was "standing by" on the job site. The standard specifications provide that a Contractor is entitled to costs incurred for equipment being on the job site and not being able to work, due to circumstances beyond his control. The costs for delays total $23,652.97. In order to avoid having to remove the steel stored within the easement, an alternate alignment was developed. This alignment was within a driving aisle, which would allow the sewer main to be installed without moving any steel. Based upon representations by the President of San Bernardino Steel that an easement for sewer would be granted, the Contractor was allowed to commence installing sewer on the alternate alignment. This action was taken in an effort to keep the delay costs to a minimum. After 362 feet of sewer main was installed on the alternate alignment, notification was received from San Bernardino Steel's parent company that the easement would not be granted, and the President did not have the authority to give a , commitment on granting of the easement. The costs incurred by , the Contractor for placing this 362 feet of sewer is $16,471.00. . A recommendation has been submitted to the City Attorney's office that legal action be taken to recover these extra costs from San Bernardino Steel. During construction, it was discovered that an additional 28 feet of 18-inch sewer main was required to connect to the existing line, over the estimated quantity included in the contract documents. This additional length will be paid for at the agreed on lump sum price of $895.67. The plans and specifications directed that cold tar epoxy coating be applied to the steel casing to be jacked under the Santa Fe Railway. It was determined during construction that this coating was not needed and could be deleted. Also, that the actual quantity of steel casing required was 20 feet less than the amount shown on the plans. 7-06-90 CITY OF SAN BERtaRDINO - REQUEST AR COUNCIL ACTION e STAFF REPORT Page 2 of 2 Extensive rock deposits were encountered during the jacking operation. The diameter of the casing was reduced from 36-inch to 30-inch for 85 feet of the length installed, in order to facilitate the jacking operation. A total credit of $9,987.22 was realized from deleting the coating, reduced length and reduction in diameter. Shoring was required for the 362 feet of sewer main installed in the proposed alternate alignment. Bid Item No.2, "Trench Shoring," will be increased by the lump sum price of $905.00 to compensate the Contractor for this extra work. The total estimated project cost included an amount of $35,642.00 for contingencies, which can be used to finance the cost for this change order.
