STAFF REPORT
On November 15, 1989 ~he San Bernardino Police Depart-
ment received a request by the tow companies now on the
Police Department rotation list to reduce the number of days
a tow company would have to serve as the primary respondent
to calls from members of the Police Department. The tow
companies requested that the rotation time period be changed
from 15 days to 7 days per rotation. This request was made
by the tow companies for the following reasons:
1. High driver attrition due to fatigue.
2. Slower response time towards the end of rotation.
3. More frequent equipment failure due to lack of down
time for maintenance.
4. Difficulty of processing cars through yards in large
volumes.

After review, the Police Department recommended that the
tow rotation be changed to one week rotation and that the
rotation change from one company to the next should take
effect at midnight each Sunday.
On Friday, July 6, 1990 a meeting was conducted by Wayne
Overstreet, Director of Facilities Management at which a tow
company representative was present from each tow company on
the Police Department rotation list to discuss issues
relative to the vehicle abatement program. At this meeting
Deputy City Attorney Henry Empeno indicated there was an
urgent need to adopt the 7 day rotation schedule to reduce
the overcrowding of tow company storage yards. In some cases
it was necessary to temporarily store towed vehicles on
public right-of-way until the vehicles could be disposed of.
Mr. Empeno indicated that the shorter rotation period would
reduce the number of stored vehicles and therefore alleviate
storage problems on public right-of-way.

At their meeting of July 10, 1990 the Bureau of
Francl.ises received the uttachec reco~mendation frorr the San
Bernardino Police Department to. change the tow company
rotation from a 15 day to a 7 day time period. The Bureau of
Franchises considered the recommendation and then unanimously
recommended to the Mayor and Common Council that Municipal
Code Section 5.76.550 subsections A and C be amended to
permit the 7 day rotation time period, that each rotation
change take place Sunday at midnight and that the amendment
be implemented by emergency ord inance to relieve overcro\~c ing
of tow company storage yards and alleviate storage of
vehicles on public right-of way.

Dear Chief Robbins,
As you are aware, the present schedule of rotation for the four
towing companies which serve your department requires each of
us to perform at peak capacity with no days or nights off for
us or our employees for a period of 15 days straight. Although
the basic system is sound, there are some negative effects for
us which result in less than perfect performance.
1. High driver attrition due to fatigue.
2. Slower response time towards the end of rotation.
3. More frequent equipment failure due to lack of down
time for maintenance.
4. Difficulty of processing cars through our yards in
such large volumes.
Suggested Solution: Rotate the companies each Sunday at midnight.
Our high level of service and readiness is easy to maintain for
a seven day period and sometimes deteriorates after that.
The benefits you would derive are:
1. Better trained tow operators instead of new faces each
rotation.
2. Less fatigue results in greater enthusiasm and improved
job performance.
3. Less truck failures resulting in better availability
and public safety.
4. Less crowding of the storage yards yielding improved
care and processing.

The department has been notified by the tow companies
that serve as rotation tows of the month of a problem with the
length of time each company serves as rotation tow. The length
that each presently serve is 15 days. The tow companies state
that the 15 day period of time has placed their equipment and
manpower in a strain which results in slow response time and high
driver attrition. They also state that storage problems exist
with the high volume of vehicles taken in over a 15 day period.
II. REcmaunmATIOlfS
The tow companies that serve the department are asking
our assistance with making their operation run smoothly and more
efficient. I recommend:

1. The tow rotation be changed to a one week rotation.
2. The Rotation change from one company to the next
should take effect at midnight each Sunday.
These recommendations will insure a higher level of
service, allow tow companies to better maintain their equipment,
and will assist them with the overcrowding in their storage yard.
III. FnmDfGS
I made contact with Dispatch Supervisor Kraus regarding
this matter. He indicated that he could not foresee any problem
with going to a one week tow rotation.
I contacted Mr. Lee Gagnon, Licensing Supervisor, City
of San Bernardino, regarding the proposal. Mr. Gagnon indicated
that any changes would need to go before the council for approv-
al, and that the ordnance now in effect would have to be revised
prior to the change taking effect. Mr. Gagnon did not foresee any
problem with going to a 7 day rotation.

SUBSECTIONS A AND C OF SECTION 5.76.550 OF THE SAN BERNARDINO
MUNICIPAL CODE RELATING TO THE ROTATION PERIOD FOR TOW TRUCK
OPERATORS FOR CITY TOWS.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
5 DO ORDAIN AS FOLLOWS:

SECTION 1.
Subsection A of Section 5.76.550 of the San
7 Bernardino Municipal Code is hereby amended to read as follows:

"A. The bureau shall establish a system of the seven-day
9
listing, selection and rotation of qualified towing
carriers for the performance of towing services in
response to calls from members of the Police
Department.
All members of the Police Department
shall comply with the system and the requirement of
the bureau relating thereto."
SECTION 2.
Subsection C of Section 5.76.550 of the San
16 Bernardino Municipal Code is hereby amended to read as follows:

"C. The carrier which is placed at the top of the list
18
shall be called exclusively by the Police Department
19
for seven days commencing on Sunday night at midnight.
20
At the expiration of that time, the carrier's name
21
shall be placed at the bottom of the list.
22
Thereupon, the carrier which is then highest on the
23
list shall be called exclusively for the following
24
seven days. Thereafter, during each seven day period,
25
the carrier similarly rotated to the top of the list
26
shall be called exclusively for that seven day
27
period."

SECTION 3.
This is an urgency ordinance which will take

effect immediately upon its adoption.
The reasons for the
5 urgency are the current rotation between tow truck operators
6 allows for too great a storage responsibility necessitating the
7 storage of towed vehicles on public rights-of-way and other
8 unauthorized locations resulting in blocking of the public rights
9 of way making the traversing of such rights-of-way difficult for
both citizens of the City and emergency vehicles.
Reducing the
11 rotation, will benefit the public health, safety and welfare by
12 insuring that public rights-of-way will remain open allowing

free passage for all private, public and emergency vehicles.
