SUBJECT: General Plan Amendment No. 90-1
Mayor and Common Council Meeting of
August 6, 1990
REOUEST
This is a city initiated amendment to change the land use
designation from RS, Residential Suburban, RU-l, Residential
Urban and CN, Commercial Neighborhood to CG-l, Commercial
General and from RU-l, Residential Urban to RS, Residential
suburban on a total of 22.41 acres as shown on Exhibit A of
the Initial Study, attached.
Site is located along both sides of 5th Street between Flores
Street and Herrington Avenue excluding Nunez Park and the
omnitrans facility.
BACKGROUND
e
The site was designated RU-l Residential Urban and CN,
Commercial Neighborhood on June 2, 1989 with adoption of the
General Plan. The land uses are a mix of commercial,
residential, churches and vacant land. Exhibits Band C of
the Initial Study show the existing General Plan designations
and existing land uses respectively.
ENVIRONMENTAL
The Environmental Review Committee reviewed the Initial Study
prepared for the proposed amendment and recommended a
Negative Declaration.
PLANNING COMMISSION RECOMMENDATION
The proposed amendment was considered by the Planning
commission at a noticed public hearing on May 22, 1990. As a
result of citizen concerns about the proposed amendment, the
item was continued. A community meeting was held on May 29,
1990 to address these concerns. At their meeting of June 5,
1990, the Planning Commission recommended adoption of the
Negative Declaration and approval of General Plan Amendment
No. 90-1.
MAYOR AND COUNCIL OPTIONS
1. The Mayor and Council may adopt the Negative
Declaration and approve General Plan Amendment No.
90-1 based on the findings on the resolution.

RECOMMENDATION
Staff recommends that the Mayor and Common Council adopt the
resolution copy attached as Attachment 2, which adopts the
Negative Declaration and approves General Plan Amendment No.
90-1.

On Tuesday, May 22, 1990, the Planning Commission continued
General Plan Amendment No. 90-1 until Tuesday, June 5, 1990
to give area residents an opportunity to meet with staff to
answer questions related to the proposed amendment.
A community meeting was held on Tuesday, May 29, 1990 for
that purpose. Representatives from Planning, Building and
the Redevelopment Agency were in attendance, as was
Councilwoman Estrada. Staff gave a brief summary of the
proposed amendment and answered questions from the public.
The questions dealt with potential changes to existing
residential or existing commercial uses with either the RU-1,
Residential Urban or CG-1, Commercial General land use
designations in place. Also discussed were compatibility
issues and the project review process. There were also
questions pertaining to possible inclusion of the areas in a
redevelopment project area.
Although the questions were answered and explained, a few
people did not like the CG-1, Commercial General designation
and felt that a residential designation should remain in
place for a few more years at a minimum. They were concerned
that the residences had been there for several years and that
they might be inadvertently forced out as a result of a
commercial designation. Others felt that a commercial
designation was more appropriate since the area would not see
new residential development due to its location along a major
street.

LOCATION
The proposed amendment is located alonq both sides of 5th
street between Flores Street and Herrinqton Avenue excludinq

BACKGROUND
The previous zoninq of the area was a mix of C-2, Community
Commercial, C-3A, Limited General CObercial, T,
Transitional, and R-2, Two-Family Residential. Adoption of
the General Plan on June 2, 1989 assiqned the residential and
commercial desiqnations as shown on Exhibit "B" to the
Initial study.
Because of the current land use desiqnations, all of the
commercial uses are non-conforminq. They are subject to
reversion to residential uses after structure vacancy of over
180 days or structural damaqe qreater than 50 percent. Vacant
land can only be developed accordinq to the underlyinq
residential desiqnation.

CALIFORNIA ENVIRONMENTAL OUALITY ACT (CEOAl STATUS
The General ,Plan Amendment is subject to CEQA. The
Environmental Review Committee reviewed the application on
March 29, 1990 and determined that the proposed amendment
would not have an adverse impact on the environment and a
Neqative Declaration was recommended. There was a public
review period from April 5, 1990 to April 25, 1990 to review
the Initial Study and the proposed Neqative Declaration.

ANALYSIS
SITE CHARACTERISTICS
The amendment site is irreqular in shape, flat and developed.
It straddles 5th Street from 200 feet west of the centerline
of Mount Vernon Avenue to Nunez Park on the south, and Flores
Street on the north excludinq the omnitrans facility. It is
made up of mostly commercial and residential uses.
LAND USES
The site is comprised of a mix of commercial uses,
residential uses, vacant land, churches and offices frontinq
on 5th street. Approximately 52 percent of the property
frontaqes are made up of parcels used for commercial
purposes, vacant parcels, and of parcels utilized for
parkinq. There is 9 percent used for church properties.
About 39 percent is used for residential purposes.
The area proposed to chanqe from RU-1 to RS on the south side
of Spruce Street north of 5th Street, is comprised of four
(4) sinqle-family residences with two (2) undeveloped parcels
used as qarden plots. Adoption of the CG-1 alonq 5th Streeet
would leave an RU-1 "island" at this location. CG-1 is not
appropriate because the parcels do not have frontaqe on or

with the existinq land use of the surroundinq area to the
north. There is no evidence that the area is deterioratinq
nor that the use is qoinq to chanqe from the current one. To

The area proposed to change from CN to CG-l is a single 0.17
acre parcel at the northwest corner of 5th street and Ramona
Avenue. The CN, Commercial Neighborhood designation was
instituted to provide for "... small scale, low-intensity
commercial uses which serve and are in pro~imity to
resideRtial neighborhoods..." with the commercialization of
5th street, the original need for the CN designation no
longer exists and the CG-l designation is consistent with
that proposed for the adjacent parcels.
The area proposed to change from RB to CG-l is the second
parcel north of 5th Street on the east side of Medical Center
Drive. Medical Center Drive is a secondary arterial route
and as suc~ is not conducive to new single-family residential
development. Residential side frictions need to be minimized
to insure safe and efficient functioning of arterials
(General Plan Policy 6.1.5). The parcel is vacant and
consists of approximately 0.9 acres with a tire shop to the
south and a school playground to the north. The Omnitrans
facility, an industrial operation, is across the street to
the west.
SURROUNDING AREA
The amendment site borders on single-family neighborhoods to
the north and to the south. There is an area designated RB,
Residential Suburban, south of 5th Street and north of the
IL, Industrial Light, designated area fronting on 4th Street.
All of the area north of the amendment site-is comprised of
single-family residential neighborhoods with the exclusion of
the Omnitrans facility and Alessandro School~ both of which
are designated PF, Public Facility. The land recently
re-designated CG-l, Commercial General from RB, Residential
Suburban by General Plan Amendment 89-2 is to the west of the
site and land designated CG-4, Commercial General (Theme) is
at the east of 5th Street with commercial development
fronting on Mount Vernon Avenue.

The CG-1, Commercial General, land use designation is
compatible with the majority of uses along 5th Street. The
area has been transitioning from residential to c~ercial
land uses as a result of the previous zoning~ Approval of

commercial land uses into conformance with the proposed CG-1
land use designation and allow for the
"... continued use, enhancement and new development
of retail, personal service, entertainment, office
and related commercial uses along major

It is also the objective of the City of San Bernardino to
"Upgrade the economic health of the local serving
commercial corridors that are currently not viable.

Redevelopment of the project site could involve demolition of
existing structures. Any structure built prior to 1941 will
be Subject to Ordinance MC-694 which requires review to
determine historical significance prior to issuance of a
demolition permit. Mitigation measures will be applied at
that time if deemed appropriate.
The majority of the area is developed with commercial uses
and the traffic increase that will result from commercial
development along 5th Street will not be sufficient to cause
a significant impact. The total traffic volume along 5th
Street will be less than the street's design capacity.

potentially yield 192 dwelling units but, in fact, there are

are under 7,200 square feet), development within the RU-1,
Residential Urban (9 dwelling units per acre) would only
produce single-family or duplex structures. Full build-out
of residential units would produce many residential side
frictions which are incompatible with traffic flow along a
major arterial route. A commercial designation would
encourage lot combining and, thus, produce sites of a size
conducive to viable commercial development, while reducing
the number of potential curb cuts.
The residential lots would become non-conforming if a
desiqnation of CG-1, Commercial General were approved. They
would be permitted to remain and could be converted to
commercial uses in the future.

CONCLUSIONS
The proposed General Plan Amendment is in conformance with
the goals, objectives and policies in the General Plan. It
is compatible with land uses within the amendment s~te. The
land use designation changes to RB, Residential Suburban and
CG-1, Commercial General with their permitted uses will not
create an adverse impact on the environment.
RECOMMENDATION
Staff recommends that the Planning Commission make a
recommendation to the Mayor and Common Council that:

21.47 acres and from RU-l, Residential Urban to RS,

located along 5th Street between Flores Street and
Herrington Avenue, excluding Nunez Park and the Omnitrans

Future noise levels within the project site adjacent to
5th Street are expected to be between 65dBa and 70dBa.
This range is considered acceptable for the proposed
commercial land use. However. the existing residential
uses adjacent to the proposed commercial uses may be
exposed to short-term high noise levels resulting from
individual site construction activities. Standard
Requirements and Conditions of Approval imposed upon site.
specific development permits will reduce the potential
impacts from construction noise. Also. concrete block
walls and buffer planting will be required along the rear
and side lot lines of the adjoining residential districts
as conditions of specific project approval. These
buffers will serve to reduce noise impacting- the existing
adjacent residential uses from future commercial

family housing involved.
Transportation/Circulation

The project is located along 5th Street, which is an
existing four lane major arterial. Currently, 5th Street
handles an Average Daily Traffic (ADT) of 16,300. The
. street is capable of handling an ADT of at least 30,000.
Approval of the proposed amendment may resul t in the
generation of additional traffic, which may impact 5th
Street and the surrounding street network.
According to the City Traffic Engineer, however. the
additional trips generated from the proposed amendment
are not sufficient to cause a significant impact on the
adjacent street system. Al so, specific design detail s
and conditions of approval will be considered for
individual projects during the development review phase.
Appropriate mitigation, such as traffic signal
installation. could be imposed at that time if deemed
necessary.
The proposed project has been reviewed by Traffic
Engineering and does not meet the minimum criteria for
traffic impact study as established in the Traffic Policy
Paper, or as determined by the Traffic Engineer. The
additional trips from the proposed project are not
sufficient to cause a significant impact on the adjacent
street system. Total traffic volume will be less than
the street design capacity.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO ADOPTING THE
NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AND ADOPTING
GENERAL PLAN AMENDMENT NO. 90-1 TO THE GENERAL PLAN OF THE
CITY OF SAN BERNARDINO.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION I. Recitals
(a) The General Plan for the city of San Bernardino
was adopted by the Mayor and Common Council by Resolution
No. 89-159 on June 2, 1989.
(b) General Plan Amendment No. 90-1 to the General
Plan of the City of San Bernardino was considered by the
Planning Commission on May 22, 1990 and June 5, 1990,
after a
noticed
public hearing, and
the Planning
Commission's
recommendation
of
approval
has
been
considered by the Mayor and Common Council.
(c) An Initial Study was prepared on March 29, 1990
and reviewed by the Environmental Review Committee and the
Planning Commission who both determined that General Plan
Amendment No. 90-1 would not have a significant effect on
the environment and therefore, recommended that a Negative
Declaration be adopted.
(d) The proposed Negative Declaration received a 21
day public review period from April 5, 1990 through April
25, 1990 and all comments relative thereto have been
reviewed by the Planning Commission and the Mayor and
Council
in

(e) The Mayor and Common Council held a noticed
public hearing and fully reviewed and considered proposed
General Plan Amendment No. 90-1 and the Planning
Department Staff Report on August 6, 1990.
(f) The adoption of General Plan Amendment No. 90-1
is deemed in the interest of the orderly development of
the City and is consistent with the goals, objectives and
policies of the existing General Plan.
SECTION 2. Neaative Declaration.
NOW, THEREFORE BE IT RESOLVED, FOUND AND DETERMINED
by the Mayor and Common Council that the proposed
amendment to the General Plan of the City of San
Bernardino will have no significant effect on the
environment, and the Negative Declaration heretofore
prepared by the Environmental Review Committee as to the
effect of this proposed amendment is hereby ratified,
affirmed and adopted.
SECTION 3. Findinas
BE IT FURTHER RESOLVED by the Mayor and Common
Council of the city of San Bernardino that:
A. The change of designation to CG-l, Commercial General
and RS, Residential Suburban for the proposed amendment
will change the land use map only and is not in conflict
with the guidelines and policies of the objectives and
policies of the General Plan.

B. The proposed amendment will not be detrimental to the
public interest, health, safety, convenience, or welfare
of the city.
C. All public services are available to the study area. Any
development permissable under the CG-1 Commercial
General and RS, Residential Suburban designations
proposed by this amendment would not impact on such
services.
D. The proposed amendment is to redesignate 21.47 acres to
CG-1, Commercial General and 0.94 acres to RS,
Residential Suburban. No housing stock will be affected
and future housing development would be unlikely to
occur.
E. The amendment site is physically suitable for the
requested land use designation. Anticipated future land
use has been analyzed in the Initial Study and it has
been determined that project specific mitigation
measures will be sufficient to eliminate any
environmental impacts.
SECTION 4. Amendment
BE IT FURTHER RESOLVED by the Mayor and Common
Council that:
(A) The Land Use Plan of the General Plan of the City of
San Bernardino is amended by changing approximately 22.41
acres from RS, Residential Suburban, RU-1, Residential Urban
and CN, Commercial Neighborhood to CG-l, Commercial General

and from RU-l, Residential Urban to RS, Residential Suburban.
This amendment is designated as General Plan Amendment No.
90-1 and its location is outlined on the maps entitled
Attachments A-l to A-6, and is more specifically described in
the legal descriptions entitled Attachments B-1 to B-12,
copies of which are attached and incorporated herein by
reference.
(B) General Plan Amendment No. 90-1 shall become
effective immediately upon adoption of this resolution.
SECTION 5. MaD Notation. This resolution and the
amendment affected by it shall be noted on such appropriate
General Plan maps as have been previously adopted and
approved by the Mayor and Common Council and which are on
file in the office of the City Clerk.
SECTION 6. Notice of Determination. The Planning
Department is hereby directed to file a Notice of
Determination with the County Clerk of the County of San
Bernardino certifying the City's compliance with CEQA in
preparing the Negative Declaration.
