Property owner, Benjamin Zarate, was notified by regular mail at: 405 N. Garfield Avenue, Oxnard, California 93030 Property was secured by the owner. The property was again found to be Open & Vacant. Another certified letter was 405 N. Garfield Avenue, Benjamin Zarate signed for 1989. There was no response mailed to Benjamin Zarate at Oxnard, California 93030. this letter on August 29, by the owner. An abatement was ordered to board up the unit and clean the property. Mr. Zarate was notified of the costs by this abatement action. Again there Current costs: $1,699.25 that were incurred was no response. Mr. Zarate was notified of the Building commissioners meeting. certified mail to Mr. Zarate. next scheduled Board of This was also sent by Board of Building Commissioners upheld staff's recommend- ation to lien the property. Mr. Zarate was present at the BBC meeting to protest the costs, claiming, improper notification. Mr. Zarate appealed to Mayor and Common Council. STAFF RECOMMENDATION: The current zoning on this property is R.S. Herrington San Bernardino, CA 92411 APN' 139-172-23 Project No. 1366 Pursuant to action of the Board of Building Commissioners taken on May 4, 1990, a nuisance was found to exist at 932 North Herrington, San Bernardino, California. Certain costs have been incurred in the investiqation and determination of this condition. These costs are set forth in the enclosed statement and are now due and payable pursuant to San Bernardino Municipal Code Section 15.28.150. An appeal may be made within fifteen (15) days of the date of the decision of the Board of Building Commissioners to the Common Council. If no appeal is taken, the costs incurred shall become a lien upon the real property unless paid to the city Clerk within thirty (30) days of the date of this notice. If this condition is not corrected by the owner, and the nuisance has to be abated by the City, additional costs will accrue for the performance of the necessary work. Larry E.
