At their meeting of April 17, 1990, the Planning Commission failed to pass
a motion to recommend the adoption of a Negative Declaration and approval
of General Plan Amendment No. 89-3 to change the land use designation from
RL, Residential Low to RS, Residential Suburban on 22.5 acres of land on
the south side of Ohio Avenue between Olive Avenue and 'Walnut Avenue.

REOUEST
The proposed amendment is to change the land use designation
from RL, Residential Low to RS, Residential Suburban for two
parcels of land on the south side of Ohio Avenue between
Olive Avenue and Walnut Avenue (APN's 261-082-01 and 02). See
Attachment 1 for the proposed amendment site and its
location.
BACKGROUND
During the public hearing process for adoption of the General
Plan, the applicant requested that the site be designated RS,
Residential Suburban (4.5 dwelling units per gross acre). The
Planning commission and the Citizen Advisory Committee
recommended that the site be designated RL, Residential Low
(3.1 dwelling units per gross acre). The Mayor and Common
Council concurred and the site was designated RL with the
adoption of the General Plan on June 2, 1989.
ENVIRONMENTAL
The Environmental Review Committee reviewed the Initial Study
prepared for the proposed amendment and recommended a
Negative Declaration. The Initial Study is included with the
Staff Report to the Planning Commission labeled Attachment 2.
PLANNING COMMISSION RECOMMENDATION
At their meeting of April 17, 1990, the proposed amendment
was considered by the Planning Commission at a noticed public
hearing. A motion was made and seconded to adopt the
Negative Declaration and to amend the General Plan as
proposed, but the motion failed by the following vote:

ThePlanninq CQmmission members were concerned with density,
flooding and biological issues. The site was not designated
RS, Residential Suburban as requested by the same applicant
durinq the General Plan adoption proce.. as per the
recQmm8ndation of the Planning CQmmission. Some of the
Commissioners felt that unless there was new information to
support the RS, designation, they had thoroughly discussed
this site before and could not support the hiqher density.
The Planning Commission felt that the lower density of RL,
Residential Low was more appropriate due to the biological
concerns which are related to the floodinq issue. It has not
been resolved whether future development will be required to
construct a storm drain or a concrete lined channel or to
leave the channel in a natural state.
staff supported the RS designation during the General Plan
adoption process because the site is bordered by existinq RS
develOPments on three sides. Staff supports the RS
designation now for the same reason and also because there is
additional RS designated land to the north (on the property
considered for the State Water Project). Staff has
determined that RS is consistent with the Goals, Objectives
and Policies of the General Plan.
The CQmmission was also concerned about the integrity of
Bailey Creek based on potential riparian habitat. Permits
will be required from the california Department of Fish and
Game prior to project development. Conditions of approval
will be required with project development pertaining to
improv_ents, setbacks, maintenance, etc. of the stream
channel. This could affect actual density but will be
required regardless of the desiqnation.
MAYOR AND COUNCIL OPTIONS
1.
The Mayor and Council may adopt the Negative DeClaration-
and approve General Plan Amendment No. 89-3 based on the
(i~dinas in the resolution.
The Mayor and Council may deny General Plan Amendment
No. 89-3 because the higher density of RS, Residential
Suburban could impact the stream channel and cause
irreversible damage to the riparian corridor.

NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AND ADOPl'ING
GENERAL PLAN AMENDMENT NO. 89-3 TO THE GENERAL PLAN OF THE
CITY OF SAN BERNARDINO.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
(a)
The General Plan for the City of San Bernardino was
adopted by the Mayor and Common Council by Resolution No. 89-
159 on June 2, 1989.
(b)
General Plan Amendment No. 89-3 to the General Plan
of the City of San Bernardino
was considered by the Planning
Commission on April 17, 1990, after a noticed public hearing.
The Planning Commission recommended denial and their concerns
have been considered by the Mayor and Common Council.
(c)
An Initial Study was prepared on February 5,
1990
and
reviewed by

deemed in the interest of the orderly development of the city
and is consistent with the goals, objectives and policies of
the existing General Plan.
SECTION 2. Neaative Declaration.
NOW, THEREFORE BE IT RESOLVED, FOUND AND DETERMINED by
the Mayor and Common Council that the proposed amendment to
the General Plan of the City of San Bernardino will have no
significant effect on the environment, and the Negative
Declaration heretofore prepared by the Environmental Review
Committee as to the effect of this proposed amendment is
hereby ratified, affirmed and adopted.
SECTION 3. Findinas
BE IT FURTHER RESOLVED by the Mayor and Common Council
of the city of San Bernardino that:
A. The change of designation to RB, Residential Suburban
for the proposed amendment will change the land use map only
and is not in conflict with the goals, objectives and
policies of the General Plan.
B. The proposed amendment will not be detrimental to the
public interest, health, safety, convenience, or welfare of
the City.
C. All public services are available to the study area. Any
development permissible under the RB, Residential Suburban
designation proposed by this amendment would not impact on
such services.

D. The proposed amendment is to redesignate 22.5 acres of
land from RL, Residential Low to RB, Residential Suburban so
the balance of the land uses within the city will be
minimally impacted.
E. The amendment site is physically suitable for the
requested land use designation. Anticipated future land use
has been analyzed in the Initial Study and it has been
determined that project specific mitigation measures will be
sufficient to eliminate any environmental impacts.
SECTION 4. Amendment
BE IT FURTHER RESOLVED by the Mayor and Common
Council that:
(A) The Land Use Plan of the General Plan of the City
of San Bernardino is amended by changing approximately 22.5
acres located on the south side of Ohio Avenue between Olive
Avenue and Walnut Avenue from RL, Residential Low (3.1
dwelling units per gross acre) to RB, Residential Suburban
(4.5 dwelling units per gross acre). This amendment is
designated as General Plan Amendment No. 89-3 and its
location is outlined on the map entitled Attachment 1 and is
more specifically described in the legal description entitled
Attachment 2, copies of which are attached and incorporated
herein by reference.
(B) General Plan Amendment No. 89-3 shall become
effective immediately upon adoption of this resolution.

An Initial Study was prepared by staff and presented to the
Environmental Review committee (ERC) on February 15, 1990
(See Exhibit A). The ERC found that no significant impacts
would result'from the proposed amendment and recolllJllended a
Negative Declaration. The proposed Negative beclaration was
advertised and available for public review from February 22,
1990 to Mar9h 14, 1990. No, comments were received during
that period.

To the west, east, and .outh of. the propo.ed project are

The area northeasterly of the site is being cOlUJidered by the
State Department of water ,Resources . for the Devil Canyon
Second Afterbay.
PROPOSED LAND USE DESIGNATION
The existinq land use delllignation for the Subject site is RL,
Residential ,Low which pet-its single family residences with a
minimum lot size of 10,$00 square feet. The maximum density
is 3.1 dwellinq units Per qross acre. Development of the
site at the current all~able maximum density would yield 69
units maximum. The RS,Residential Suburban land use de-
signation permits sinqle'family residence. with a minimum lot
size of 7,200 square feet, and a maxt.um density of 4.5
dwellinq units per qroslll acre. Develop-.nt of the site at
the proposed allowable m.ximum density would yield 101 units
maximum. This increase ~n density would result in an incre-
mental increase in the'types of impacts associated with
residential development (i.e. traffic, drainaqe, gradinq,
etc.). These impacts are not expected to be significant.

LAND USE COMPATIBILITY AND GENERAL PLAN CONFORMITY
Development of the site under the proposed RS, Residential
Suburban land use designation will be compatible . with
exi.ting re.idential use. to the west, east and south. The
. objective of the RS de.ignation is to "promote the develop-
.ment of single-family, detached' units in a higblqual.ity.
suburban setting." (General Plan Objective 1.11) DeVelopment
attheRS density (4.5du per ~cr..) is in conformity with the
.goals~ obj!!lctives and policie~ of: the General Plan.
ENVIRO~NTAL
The amendment site is located in the High Wind and Qigh Fire
Hazard Zones. Future projects will be conditioned so as to
reduce the potential hazards of development in these zones.
The site is traversed by Bailey Creek which is shown as an
interaittant stream on. the U.S. Geologic Survey, San
Bernardino North 7.5 minute quadrangle .A biological
assessment was conducted for future infra.tructure projects
in the area. The section of Bailey Creek that crosses the
site was determined to be of little significance although
upstream Bailey Creek supports a lush and very significant
riparian community. Any proposed disturbance of Bailey Creek
will require a permit from the California Department of Fish
and Game, at which time appropriate mitigation measures will
condition the project.
A cultural resource assessment was conducted as the site is
in an area of archaeologic resource concern. No cultural
resources were located during the field survey of the site.
The area in and adjacent to the Creek bed is within the 100
year flood plain. The stream, as it now stands, is not
adequate to contain the flows from a major storm and overflow
of the site can be expected. The stream bed will have to be
modified prior to development of a residential project. The
City Public Works Department is proposing to construct a
storm drain from the existing concrete channel which is
across Walnut Avenue from the site northwesterly to the mouth
of Bailey Canyon.

The possible traffic generated in an RS, Residential Suburban
deaiqnaUd area when fully developed will be 46' greater
(Average Day Traffic (AD'l') of 1010 va an AD'l'of 690) than in

The facts are stated in the attached letter from Richard

not necessarily all that I have.

Dear Mr. Lindseth:
I wish to appeal the approval by the Pevelopment and Bnvironmental
Review Comaittee of items 90-13 on June 21, 1990. The ~round. for
the appeal are based on ..rious violations of the San Bernardino
Municipal Code reqarding building construction. , No member ot the
Buildinq and Satety oepart:l\etlt, was pre.ent at the June 21st
meeting. The chairman, Mr. M:crot:9Ol1ery, indicated the oOlNlli ttee was
not interested in building-safety issues at that time.
As you know, no testimony was allowed at any of the prior planning
oomaisaion meeting'S of May 24, June 5, nor June 19 of 1990.
Consequently, no testimony regarding- building and satety matters
has been heard at any ot the notioed hearings. Furthermore, the
oommittee totally ignored its own voluminous reports Which
reoolDlDended a flat dentalot both items 90-5 and 90-13
For, the record, I would like to i!lfo~ you I am A Certified
Building Inspeotor (lCBO #11725), a Certified Building Ofticial
(CABO #973) and a lioensed General $uilding-Contractor #524326.
I inspected the building- on April 15, April 20, April 28, 1990.
I also took piotures beg-inning- with the Apr1l 20th visit. The
building is within eyesight of my home and I was merely ourious at
fir.t about the oonstruction.
When it became obvious to me that the local Sun Newspaper was
missing parts to the whole story, I personally purchased the
Superior Court doe, uments of April 9, 1990" and the Planning
Department Staff reports on items 90-5 and 90-13. I also
interviewed various members of City staff.
I personally examined the "approved" structural plans on May 29,
1990 at the Building Department. These plans were "approved" by
Willdan and As.ooiates on March 23, 1990. I submit my findings to
you in the hope that the City does not adopt any liability to
itself nor establish a, pattern of permitting unsafe or illegal
oonstruotion in our area.

The approved plans:
1. "waive footing and foundation inspections. II The Uniform
Building Code 19.8, Section 305(e), requires foundation
inspection and does not permit any waiver.
2. . The plans lacked .a structural wet stamp from tile
structural Engineers - STB..
3. The plans lacked any plumbing, mechanical.or electrical
specifications or drawings.
.4. The plans were "apprOVedll March 23, but by this time all
the structural concrete hOod been poul"ed. W. cannot know
if the special inspectors supplied by the builder saw the
same set of plans.
5. The Uniform Building Code, Table 5-A, prohibits any
openings for this type of building less than five feet
from any property line, ie: A door on Waterman Avenue
is not permitted.
6. There is no report of roof sheathing nailing inspection
in any of the documents. Th.is is one of the most crucial
required inspections as the roof diaphragm holds up the
concrete panels.
7. The plumbing system uses plastic sewer drain and roof
drain material. '1'his in no longer permitted under
California Plumbing Codes as of 1990.
8. On Karch 5, 1990, the special inspector noted that "the
chord bar is 2 feet below the roof ledger and we have no
reinforcinq at the ledger". This appears to be the most
serious flaw in the building. The structural details in
the plans 00.11 for very exact positioning of reinforcing
steel vis-a-vis anchor bolts, and the roof ledger stack.
A medium sized quake will in all likelihood damage the
shear value of the concrete wall panels. This would
result in a root collapse at the perimeter.
As you know, this permit proce.s is complioated because the builder
started without approved plans and pBrlllits. The city cannot easily
let. building permit be is.ued now as it would accrue many unseen
liabilitie.. I would like very much to present an outline which
will permit the City to oversee a legal proces which will ensure
that this buildinq is made safe. I would gladly do this in spite

attorneys' fees or expenses which arise by reason of:
1. (a) Any law, oldinance or govemmental regulation (includinl but not limited to building and zoning laws,. oldlnances, or
regulations) restricting. regulating. prohibiting or relating to (i) the occupancy, use or enjoyment of the land; (ii) the character,

dimensions or area of the land or any parcel of which the land II or was a part; or (Iv) environmental protection, or the effect of

records at Date of Policy.

excluding from ~age any taking which has occurred prior to Dale of Policy which would be binding on the rightl of a purdlaser
for value without knowledse.

(b) not known to the Company, not recorded In the public reconls at Date 01 Policy, but known to the Insured dalrnantand not dildosed
