Subject: Appeal of Conditions of Approval of Parcel Map No.
13158
Mayor and Common Council Meeting - July 2, 1990,

REOUEST
The applicant, Jack Strickler for Lutheran Highland Avenue
Church, is appealing certain conditions of approval by the
Planning Comaission for Parcel Map No. 13158. The applicant
requests that the Mayor and Council reconsider those certain
conditions and delete them as conditions of approval. (See
E~ibit "A")
BACKGROUND
Parcel Map No. 13158 is a request to subdivide one parcel
consisting of 5.95 acres into two lots consisting of 2.59
acres and 3.36 acres. The site is the location of Lutheran
. Highland Avenue Church located at 1820 ..st Highland Avenue
generally situated at the northeast corner of East Highland
Avenue and Osbun Road. The property is designated CG-1,
General Commercial... 1, by the General Plan. The Parcel Map
meets all standards of the MUnicipal Code and is consistent
with State Law and the General Plan. Parcel Map No. 13158 is
exempt from the California Environmental Quality Act under
Section 15315, Class 15.
The applicant is appealing. the following two conditions
regarding the requireaents for undergrounding of utilities
and constructing street lights.
Condition No.5, Page 11
"All existing overhead utilities adjacent to or
traversing the site on either side of the street shall
be undergrounded in accordance with Ordinance No. MC-
601 (Subdivision) or Resolution No. 88-65 (Non~
subdivisions)."
Condition No. 10, page 12
"Construct street lights along Highland Avenue and
Osbun Road adjacent to the site."
The basis of appeal is that the applicant feels that the two

requirements are two expensive to apply to this project.
On April 16, 1990, the Council continued the appeal until
July 2, 1990, so that a pending ordinance which pertains to
this appeal was finalized. On April 9, 1990, the Council
approved Ordiannce No. MC 727 which amended Section
18.409.380 (See Exhibit "0"). This amendment exempts "the
previously development portions of any non-residentially
zoned parcels" from the requirement to underqround utilities.
Therefore, Condition No. 5 is no longer a valid condition.
Condition No. 10, however, was not affected by this
ordinance, and is still a valid condition. Section 18.44.070
(I) of the Municipal Code requires the subdivision to install
street lights. The council would have to amend this
ordinance before they could waive the street lighting
construction requirement.
RECOMMENDATION
It is recommended that the. Council partially uphold the
appeal by amending the conditions of approval, and only
deleting Condition No.5. This action would eliminate the
requirement to construct street lights.

BACKGROUND
The subject site 18 developed with a church, sunday School
tacilitie., and playground at the south portion of the site.
The northern portion of the. site i. unpaved and consi.ts of a
basketball court and baseball field. SurrouncliD9 land uses

The proposed Parcel Map will subdivide the approximately 5.95
acre parcel into two lots. Lot one will cons18t of approxi-
mately 2.59 acres. The proposed 2.59 acre lot will consist
ot an unpaved surface with a basketball court: and part of a

. baseball field. Lot two, proposed at the southern .ection of
the site will be 3.36 acres in size and will maintain the
existing church, Sunday School facilities, and playground.
The proposed parcel map is intended for the future develop-
..nt of proposed lot one which is undetermined at this time.
ACCESS AND PARKING
Proposed lot two will have access off of Highland Avenue and
Osbun Road'~ Proposed lot one will taka access froll Osbun
Road. In terms of parking, the existing church and Sunday
School have approximately 123 parking spaces on site which
exceeds the required approximately 88 oft",:,site parking spaces
(see Attachment "A"). The subdivision of the 5.t5 acre lot
will not effect the current parking situation. Osbun Road
will be dedicated (an additional five feet) and improved to
meet the requir_ents of the Public Works DepartJlent.
CITY AND STATE REQUIREMENTS
The proposed Parcel Map is consistent with the provisions of
Title 18 of the Municipal Code and the Subdivision Map Act of
the State of California, in that each parcel is Of buildable
size and has access from a dedicated street. The street
frontage for lot one and two is 240 feet and 397.17 feet,
respectively.
COMMENTS RECEIVED
The proposal was reviewed by the Developaent Review Committee
(DRC) on their February 15, 1990 ..eting. The ORC recom-
mended approval of the propoaed parcel IUJP and their ,comments
have been incorporated as Standarc:l conditions of Approval.
CONCLUSION
,
Parcel map 'NO. 13158 meets all standarc:ls of the Municipal
Code and is consistent with State Law and the General Plan,
in that the proposed parcels are of buildable size and have
access from a dedicated street.

Grading

-grading and drainage plan shall be signed by a Regfstered Civil
Eng i neer and a gradi ng permi t will be requi red. The gradi ng plan
shall be prepared in strict accordance with the City's "Grading
Policies and Procedures" and the City's "Standard Drawings.,
unless otherwise approved by the City Engineer in advance.
If more than 5,000 cubic yards of earthwork is proposed. a grading

A liquefaction report is required for the site. This report must

Any grading requirements recommended by the approved liquefaction

An on-site Improvement Plan fs required for this project. Where
-feasible, this plan shall be incorporated with the grading plan
and sha 11 conform to all requ i rements of Secti on 15.04-167 of the
Municipal Code (See "Grading Policies and Procedures"). The
on-site Improvement Plan shall be approved by the City Engineer.

An on-site Lighting Plan for the project shall be reviewed and

SBCTION 1.
The City of San Bernardino hereby adopts and
approves a revised map of the Bnterprise Zone, amending the
boundaries of the commercial area of the Bnterprise Zone
heretofore established by approval of the Mayor and Common
Council on March 25, 1985, to include within the commercial area
of the Enterprise Zone properties on both sides of Mount Vernon
12 Avenue immediately south of Highland Avenue, to clarify the
13 intention of the Mayor and Common Council at the time of original
14 adoption that the commercial area was to include both sides of
15 Mount Vernon Avenue between Harrington Street and Highland
16 Avenue, so that the westerly boundary of the commercial area of
17 the Bnterprise Zone north of the intersection of Harrington
18 Street and Mount Vernon Avenue shall follow Mount Vernon Avenue
19 to Highland Avenue, and then will head easterly. A copy of the
20 revised map of the Enterprise Zone, hereby adopted, is attached
21 hereto as Bxhibit -1- and is incorporated herein by reference.
22 This approval is effective as of the date of original approval of
23 the map of the Enterprise Zone, March 25, 1985, and any property
24 affected by the change in the boundaries shall be entitled to
25 full inclusion within the benefits of the commercial area of the
26 Enterprise Zone as though these boundaries had been in effect
27 since that date. The Staff of the City is hereby autho~ized to
28 make any refunds of fees necessitated by this revision.

REOUEST
The applicant, Jack Strickler for Lutheran Hiqhland Avenue
Church, is appealinq certain conditions of approval by the
Planninq Commission for Parcel Map No. 13158. The applicant
requests that the Mayor and Council reconsider those certain
conditions and delete th_ as conditions of approval. (See
Exhibit "A")
BACKGROUND
Parcel Map No. 13158 is a request to subdivide one parcel
consistinq of 5.95 acres into two lots conaistinq of 2.59
acres and 3.36 aeres. The site is ~ location of Lutheran
Hiqhland Avenue Church loc:ated at 1820 "st Hiqhland Avenue
qenerally situated at the northeast cornar of "stHiqhland
Avenue and Osbun Road. The property Is designated CG"l,
General Ccmmercial - 1, by ~ Gelleral Plan. The Percel Map
meet. all standards of th4t Municipal Code and is consistent
with State Law and the GeMtal Plene Percel Map No. 13158 is
exempt from the california Environmental Quality Act under
Section 15315, Class 15.
The applicant is appealinq the followlnq two conditions
reqardinq the requirement. for underqroundinq of utilities
and constructinq street liqhts.

. On April 16, 1990, the CO\UlCil continued the appeal until
July 2, 1990, so that a pendJ.ng ot'lUftance which pertains to
this appeal was finalized. On April 9, 1990, the CO\UlCil
approved Ordiannce No. Me - 727 which amended Section
18.409.380 (S.. Exhibit -D-). This aaencSlllent exeapts -the
previoualy devel41~.nt portions of any non-residentially
zoned parcels- frOll the requiraent to underground utilities.
Therefore, Condition No. 5 is no longer a valid condition.
Condition No. 10, however, was not affected by this
ordinance, and is still a vlt,lid cOnclition. Section 18.44.070
(I) of the Municipal Code requires the subdivision to install
street liqhts. The council would bave to aaend this
ordinance before they could waive the street liqhtinq
construction requirement.
RECOMMENDATION
It is recOlllllleDcled that the CouncU partially uphold the
appeal by amending the conditions of approval, ancl only
deletinq Condition No.5. This action would eliminate the
requirement to construct street lights.

SECTION 1.
Section 18.40.380 of the San Bernardino
Municipal COde is hereby amended by addition of Paragraph Nos. 5,
and 6, as follows:
"5. Any residential zoned Parcel Map with a maximum of 4
parcels, no parcel of which has previously been exempted
from this section: and where at least sot of the
surrounding area within a radius of 500 feet has been
previously developed without undergrounding utilities.
"6. Any non-residential zoned Parcel Map, the portion
previously developed."

Grading

-grading and drainage plan shall be signed by a Registered Civil
Engineer and a grading permit will be required. The grading plan
shall be prepared in strict accordance with the City's "Grading
Policies and Procedures" and the City's "Standard Drawings".
unless otherwise approved by the City Engineer in advance.
If more than 5.000 cubic yards of earthwork is proposed. a grading
-bond will be required and the grading shall be supervised in
'accordance with Section 7012 (c) of the Unifor~ Building Code.
A liquefaction report is required for the site. This report must
-be submitted and approved prior to issuance of a grading permit.
Any grading requirements recommended by the approved liquefaction
report shall be incorporated in the grading plan.
An on-site Improvement Plan is required for this project. Where
:-feasib1e. this plan shall be incorporated with the grading plan
and shall conform to all requirements of Section 15.04-167 of,the
Municipal Code (See "Grading Policies and Procedures")~ The
on-site Improvement Plan shall be approved by the City Engineer.
_A reciprocal easement shall be recorded prior to grading plan
approval if reciprocal drainage. access. sewer, and/or parking is
proposed to cross lot lines, or a lot line adjustment shall be
recorded to remove the interior lot lines.
_The project Landscape Plan shall be revi ewed and approved by the
City Engineer prior to iss,uance of a grading permit. Submit 4
copies to the Engineering Division for checking.
An on-site Lighting Plan for the project shall be reviewed and
-approved by the City Engineer. This plan can be incorporated with
the grading plan, or on-site improvement plan, if practical.
Utilities:
