Synopsis of Previous Council ection:
June 18, 1990 - Approved Century Homes Communities' request to dedicate land and
improvements in lieu of payment of Park Construction Fees for
Tracts #14110 and #14319. Approved reimbursement of $80,353.20
in previously paid Park Construction Fees for first three phases
of development for Tracts #14110 and #14319.
Approved waiver of $29,205.46 in fees due for the final Phase IV
of development of Tracts #14110 and #14319.

IN LIEU OF PAYMENT OF PARK
CONSTRUCTION FEES.
century Homes Communities hall developed a park on Harwick
Drive near Weir Road in accordance with a City approved plan.
The park construction has been il18p8Cted by City inspectors
from Engineering and by Parks, Recration and coaaunity
Services staff. The park is 3.24 acres in. si.e and includes a
childrens play lot, concrete walkways, benches, security
lights, complete landscapinq and an autoaatic irrigation
system. The park is located di~ly across the .treet from
Colony Park which has a light:ed ballfield, restrooas, picnic
tables and parking lot. The ~ addition will compliment that
which i. already in place and will provide a facility that
meets the leisure needs of all age..
The attached agreement outlines requir...nts for Century Homes
to follow prior to acceptance of a grant deed for the property
and improvements. These requirements will provide a aeans to
assure that City interests arebeinq addressed and ..t before
reimbursement of fees and prior to taking control of the
property and i.provements. upon satiSfactory completion of
these require.ents, a rec~tion can be made for the City,
with the assistance of Real Property Section, to accept a
grant deed.
All items approved by Mayor and Co_on Council at their
meeting on June 18, 1990 are addre.sed in the agreement. It
is, therefore, recommended that the resolution and agre..ent
be approved.

City required Parks & Recreation fees for the above-referenced Development.

Century Homes Is hereby requesting the Parks & Recreation fees that have been
paid to be relnmursed. The ba.is for this request Is the dedication and
improvement of a public park site In lieu of the payment of fees.

MAYOR TO EXECUTE AN AGREEMENT BETWEEN THE CITY OF SAN BERNARDINO

IMPROVEMENTS FOR PUBLIC PARK AND RECREATION PURPOSES TO THE CITY

5 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1.
The Mayor of the City of San Bernardino is

hereby authorized and directed to execute for and on behalf of
said City an Agreement with Century Homes Communities for
dedication of land and improvements to the City in lieu of
payment of Park Construction Fees: a copy of said Agreement is
attached hereto as Exhibit "A" and incorporated herein by
reference as though fully set forth at length.
I HEREBY.CERTIFY that the foregoing resolution was duly
adopted by the Mayor and Common Council of the City of San

AND RECREATION PURPOSES TO THE CITY IN LIEU OF PAYMENT OF PARK
CONSTRUCTION FEES.
THIS AGREEIIENT, made and entered into this
, 1990, by and between the city of San

WIT N E SSE T H:
WHEREAS, City may, pursuant to Section 15.56.080 of
the City Municipal Code,

improvements which are dedicated in fee to public recreation
and park purposes in lieu of payaent of Park Construction
Fees; and
WHEREAS,-cHC has formally, requested that it be
allowed to dedicate in fee to public park and recreation
purposes, land and improvements in lieu of paying Park
Construction Fees for development of Tracts '14110 and
114319; and
wHEREAS, the City and CHC desire to enter into an
agreement for the dedication in fee of certain real property
located in the vicinity of Harwick Drive and Weir Road, in the
ispering Glen residential housing development, hereinafter
Tract '14110 (See Attachment A); and
WHEREAS, it is mutually beneficial to the parties
that CHC dedicate in fee to public park and recreation
urposes said property which has been developed into a 3.24
cre park consisting of land and improvements as reflected in
B hereto; and

WHEREAS, the parties contUlplate
this agreement under the provisions of
the City Municipal Code; and
WHEREAS, as required said Municipal Code, Section
15.56.080, the City Planning Commission, at their March 20,
1990 meeting, certified that said develo~ent of the property
to be dedicated in fee to public parka and recreation purposes
meets the requirements of the park and recreation elements of
the city's General Plan.
NOW, THEREFORE, in

1. For purposes of the provisions of the deed from
CHC to city for that portion of property developed for park
and recreational purposes, all develo~ent improvements to
said land, made by CHC, shall be deemed improvements made
pursuant to a plan approved by the city.
2. CHC agrees to furnish "as-built" drawings for the
completed project which shall be delivered to city within 30
days after execution of this agreement.
3. City reserves the right, in addition to any other
right it may have, to inspect the work of the development to
etermine that city's interests have been met in accordance
ith this agreement. Upon determination that all work and
installation of materials and equipment has been completed as
rescribed in the approved plan, and upon receipt of the "as

built" drawinqs for the completed project, the Director of
Parks, Recreation and Community Services Department shall
recommend acceptance by city of the grant deed for the
property and improvements as specified herein.
4. Tracts '14110 and '14319 have a total of 111 lots
for construction of re.idential dwelling units. This equates
o $109,558.66 Park Con.truction Fee. for the two tract.. CHC
a total of $80,353.20 for development of 81 dwelling
City agree. to reimburse CHC for paid Park
onstruction Fees in the amount of $80,353.20 and to waive
ark Construction Fees in the amount of $29,205.46 for the
emaining 30 dwelling units to be constructed. These actions
undertaken simultaneously upon acceptance by City of
e grant deed for property and improv.ments dedicated in fee
public park and recreation purposes.
5. CHC hereby waives all claims and recourse against
including any right to contribution for loss or damage to
rsons or property arising from, growing out of, or in any
or incident to dedication of land and
under this agre_ent.
CHC shall, to the extent it may leqally do so
harmless, and defend City and its officers,
gents, and .mployees against any and all claims, demands,
amages, costs, expenses, or liabilities arising out of the
evelopment or construction of Lot A, Tract '14110.

7. Any notice, demand, or request required or
authorized by this agre.ment to be given or made to or upon
city shall be deemed properly given if deliver.d by mail to
the Dir.ctor of Parks, Recr.ation and Community Services
Department, 547 North Sierra Way, San Bernardino, California
92401.
The notice, d.mand, or request r.quired or authorized
by this agreement to be made to or upon CHC shall be deemed
properly given or made if delivered by mail to Mr. Bob Diehl,
Century Home Communities, P.o. Box 8110, San Bernardino, CA
92412.
The address to which any notice, damand, or request is
to be mailed may be changed at anytime by notice given in the
same .anner as provided in this article for other notices.
othing herein shall preclude the giving of notice by personal
service.
