that the Special Assessment, Investigation and Limitation Act of 1931 shall
not apply (4/5ths roll call vote is required).

STAFF REPORT
Assessment District No. 994 was proposed to generate funds to finance the costs
included in the 1990/91 budget for street Lighting and Street Sweeping. The proposed
budget for these services is $2,515,838. This amount, referred to as "Net Proceeds" in
the Engineer's Report, would then be freed up in the general fund to be used for
police services.
Funds to finance an additional street sweeping per month, and the addition of
approximately 200 street lights to the current system, is proposed to be added to the
assessments. The amount of the additional services is $455,229. The total assessment
would then be $3,065,892.
Assessments will be based upon the Basic Assessment Unit (AU), which is defined to be
one single family residence. Vacant lots will be assessed for half that amount, and
commercial property will be assessed based upon the use and/or size of the parcel.
Provisions for a Rebate Program have been made in the Resolution of intention to low
and middle income persons or families having an annual income of less than $12,000 for
a single person and $15,000 for two or more people in one household. Those who qualify
may apply once a year , in May.
The estimated annual assessment for the 1990/91 fiscal year is $48.00 per AU. The
Resolution of Intention limits any annual increases in the total assessment to
Consumer Price index. The Resolution of Intention also makes provisions for an annual
review, by the Mayor and Common Council, to determine that the "Net Proceeds" are
being spent on police services, and if not, then to terminate the district. The
district will be in effect for a period of five years, unless extended by the mayor
and Common Council.
The Resolution of Intention set Wednesday, June 27, 1990, 7:00 p.m. at Sturges
Auditorium, as the date, time and place of the public hearing. On June 8, 1990, all
property owners having property within the City of San Bernardino, were given notice
by mail, of the public hearing, and the resolution was published in the Sun.
It is recommended that the protests, if any, be overruled, the hearing be closed, and
find and determine that the public convenience and necessity require the proposed
Assessment District .

DISTRICT NO. 994, ORDERING TIlE WORK AND TIIAT TIlE SPECIAL ASSESSMENT,
INVESTIGATION AND LIMITATION ACT OF 1931 SHALL NOT APPLY.
WHEREAS, the Mayor and Common Counc il of the City of San
Bernardino have preliminarily found that the public interest,
convenience, and necessity require City-wide street lighting and street
sweeping services, as more fully hereinafter described,
and the
appurtenances and appurtenant work
and incidental costs and expenses
connection therewith, that the project is feasible,
and that the

lands to be assessed will be able to carry the
burden of the
proposed assessments to pay the costs and expenses thereof; and
WHEREAS, the Mayor and Common Council of the City of San
Bernardino have, on the 4th day of June,
1990, passed and adopted

SECTION

Bernardino hereby declares by not less than a 4/5ths vote as defined in
Section 12.90.040D of the San Bernardino
Municipal Code,
that the
public
interest, convenience, and necessity requires and hereby orders,
the formation of Assessment District No. 994; the work described in said
Resolution No. 90-207 to be done within the Corporate City Limits of the
City of San Bernardino as provided in said Resolution and that the Special
Assessment, Investigation and Limitation Act of 1931 shall not apply.
SECTION 3.
The work is proposed to be carried out by City
forces. If it is determined that the needs require an outside contract, then
the City Clerk hereby is directed to post a Notice for five days on or
near the door of the Council Chambers of the City Hall inviting sealed
proposals or bids when necessary, for doing the work ordered and referring
to the specifications on file and to publish a Notice Inviting such
proposals for at least two days in the San Bernardino Sun, a
newspaper published and circulated in said City.
SECTION 4.
If a contract is let, the contract will be awarded
pursuant to the standard procedures used by the City in the award of
Public Works contracts and the work ordered hereunder shall be to the
satisfaction of the City Engineer of said City, and all of said work
shall be done under his
direction
and
shall comply
with the
specifications prepared by him, and upon the completion of said work,
whether by City forces or by outside contract, the City Engineer shall ,
and he hereby is directed to make the assessment.

FOUND IT PARAMOUNT FOR ME AND MY TENANTS WELFARE.
My TAXES ON THE MoUNTAIN SHADOWS APARTMENTS ARE TO SE INCREASED SY Two
THOUSAND THREE HUNDRED AND FOUR DOLLARS ($2,304}' WHICH I HIGHl.Y PROTEST AS
SEING AN UN~UST INCREASE. A PERSON WHO RENTS A ONE BEDROOM APARTMENT, WHO
CAN NOT AFFORO A HOME, MUBT PAV THE SAME AMOUNT OF INCREABE IN TAXES AB A
WEALTHY MIl.LION DOl.LAR HOME OWNER OR BUSINESS MAN PAYS. THIS IS HIGHLY
UN~UST TAXATION. THIS TAX ASSESSMENT FAVORS THE WEAl.THV AND PENALIZES THE
WORKING CLASS. I MUST PASS ON MV TAX INCREASE AS RENT INCREASES TO MY
TENANTS.
SINCE 1983, WE HAVE OWNED THE MoUNTAIN SHADOWS APARTMENTS. My WIFE AND I PUT
OUR LIFE SAVINQa INTO THEIR PUROHA8E. FOR THREE (3) YEAR8 wE WERE ASLE TO
HAVE THREE PERCENT (3~) RENT INCREA8E8. FOR THE LAST FOUR (4) YEARS WE HAVE
NOT BEEN A8LE TO HAVE A GENERAL INCREASE. IT 18 DUE TO SAN BERNARDINO'B
VERY DEPRESSED, POOR, RENTAL AREA FROM DVER SUILDING AND THE LARGE CDN-
TRACTORS ASILITY TO OBTAIN LOW INTEREBT RATEa ON THEIR LOANB. THIS CONDITI.ON
HAB MADE MANY VACANCIES AND A HIGHLY COMPETITIVE RENTAL MARKET.
MY TOTAL OPERATING EXPEN8ES HAVE INCREA8ED CON810ERABLE AND CONSTANTLY IN THE
PA8T SEVEN (1) YEARS. Now I FIND IT PARAMOUNT IN FACE OF THE INCREASED
EXPEN8ES TO HAVE A GENERAL RENT RAI8E, REGARDLES8 OF THE POSSISILITY OF

IF THE COUNCIL FINDS IT NECESSARY TO INCREASE THE TAXES TO PAY FOR SERVICES
THAT MUST 8E INCREASED, THEN ASSESS THE PEOPLE EQUALLY ACCORDING TO THEIR

VALUE WOULD BE SUFFICIENT AND FAIR TO ALL TAX PAYERS. WHY SHOULD A WORKING

AS A PERSON LIVING IN A MILLION DOLLAR HOME. THE TAX INCREA8E TO MY TAXES
