STAFF REPORT
At the .Mayor and Common Council meeting held on June 9,
1990, the Mayor and Councilmembers expressed great concern over
the Ordinance and Resolution establishing the Annual Sign Code
Inspection Sticker and Inventory Program. The Mayor and
Councilmembers had received numerous calls from constituents
regarding the applicability of the Ordinance and Resolution to
their signs.
On April 2, 1990 the Mayor and Common Council adopted MC-717
and Resolution 90-115 which required an annual sign code
inspection sticker for each legally permitted sign in the City
except temporary signs and those signs exempt under
San Bernardino Municipal Code Section 19.60.090 (copies of MC-
717, Resolution 90-115 and various sections of San Bernardino
Municipal Code Chapter 19.60 attached as Exhibits A, B, and C,
respectively) . The new Ordinance and Resolution required an
application and payment of a fee of Twenty-five Dollars ($25.00)
for each sign by June 2,1990. This fee would double to Fifty
Dollars ($50.00) for each sign if not paid by July 2, 1990.
Although Ordinance MC-717 was adopted on April 2, 1990, it
did not become effective until sixty (60) days after its
adoption because of state law requirements. It was also
anticipated that the sixty (60) day lag-time would permit
sufficient publicity and notice so that sign owners would respond
by the June 2, 1990 due date.
On June 7th and 8th, 1990, the Department of Planning and
Building Services mailed out to 7,500 businesses a letter, Sign
Registration Application, and a copy of Resolution 90-115 (copy
of letter and application attached as Exhibit D). The result of
this poorly worded and late notice has been widespread public
confusion and frustration, especially compounded because the
Department was not able to initially answer the many telephone
calls inquiring about the sign fee. Several questions have
arisen as to whether the City should only require one
application and one fee for each lot (no matter how many signs
exist on the lot) and whether real estate "for sale" signs,
interior signs, and temporary signs are or should be exempt.
Attached as Exhibits E-1 and E-2 are proposed amendments to
the Ordinance and Resolution addressing some of these issues. We
encourage the Mayor and Common Council to refer this matter to
the Legislative Review Committee for further review of these
proposed amendments.
This matter is on the Supplemental Agenda because the Mayor
and Common Council raised these concerns after the regular agenda
deadline for the June 18, 1990 Mayor and Common Council meeting.

19.60.081 THROUGH 19.60.085 OF THE SAN BERNARDINO MUNICIPAL CODE
AND REQUIRING AN ANNUAL SIGN CODE INSPECTION STICKER AND
INVENTORY PROGRAM, AND REPEALING SECTION 15.04.085(7).
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
00 ORDAIN AS FOLLOWS:
SECTION 1. Sections 19.60.081 through 19.60.085 are added
to the San Bernardino Municipal Code to read as follows:
"19.60.081 ANNUAL INSPECTION STICKER REQUIRED
Every person, firm or corporation owning any legally
permi tted sign in the City of San Bernardino shall obtain for
each sign an Annual Sign Code Inspection Sticker issued by the
Director of Planning and Building Services unless specifically
waived by Resolution of the Mayor and Common Council. A sticker
is required for each on-premises and off-premises sign except
temporary signs and those signs exempt pursuant to Section
19.60.090.
This sticker is applicable to one sign at one
location only and is transferable to a new owner or lessee of
that sign. This sticker must be displayed on a visible portion
of the face of the sign or its structural support.
"19.60.082 APPLICATION AND FEES
A. An application for an Annual Sign Code Inspection
Sticker shall be submitted by the owner of a legally permitted
sign or his agent to the Director of Planning and Building
Services. Such application shall include, but not be limited to,
a description of the sign, its size, its height, and its
location.
B. The initial Annual Sign Code Inspection Sticker fee

Renewal fees for an

6 determined in accordance with the fee schedule established by
7 resolution of the Mayor and Common Council and filed in the

office of the City Clerk.
Each Annual Sign Code Inspection
9 Sticker fee not paid wi thin thirty (30) days of the date due
10 shall be considered delinquent and shall be twice the amount
11
specified.
Fees collected from the Annual Sign Code Inspection
12 Sticker Program shall be used only to implement the inventory and
13 abatement program referred to in Section 19.60.084.

ILLEGAL SIGNS
15 The issuance of any sign permit or Annual Sign Code
16 Inspection Sticker pursuant to this chapter does not allow any
17 person, firm, or corporation to erect or maintain any sign in
18 violation of any City ordinance or any State or Federal law.

INVENTORY AND ABATEMENT
20 Within six (6) months from the date of adoption of Section
21 19.60.081, the City shall commence a program to inventory and
22 identify illegal or abandoned signs within its jurisdiction.
23 Wi thin sixty (60) days after this six-month period, the City
24 shall commence abatement of identified preexisting illegal or
25 abandoned signs.

is required shall be subject to inspection by the Planning and
BuilcUng services Director. The Planning and Building Services
Director, or his designees are hereby authorized to enter upon
any property or premises to ascertain whether the provisions of
this Code are being obeyed. Such entrance shall be made during
business hours unless an emergency exists. A sign owner shall
provide all necessary access by the City's employees for the
purpose of conducting the required inspection."
SECTION 2.
Section 15.04.085(7) of the San Bernardino
Municipal Code, which set an annual sign permit fee of ten
dollars for off-premise signs, is hereby repealed.
SECTION 3. Pursuant to Government Code Section 65962,
this Ordinance shall become effective sixty days after its
adoption by the Mayor and Common Council.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
5 OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor and Common Council find:
A.
This Resolution is adopted pursuant to Municipal Code
8 Section. 19.60.081, et seq., and Cali fornia Business and
9 prosessions Code Sections 5491.1 and 5491.2, which authorize the
10 City to impose reasonable fees upon all owners or lessees of
11 signs for the purpose of covering the City's actual cost of
12 inventorying and identifying illegal or abandoned signs within
13 the City.

B.
A hearing has been held by the Mayor and Common
15 Council pursuant to the provisions of Government Code Section
16 54990, et seq., to consider imposing this annual sign code
17 inspection sticker fee for various services involved in
18 inventorying, identifying and abating illegal or abandoned signs,
19 which hearing was held following public notice published in a
20 newspaper of general circulation in the City of San Bernardino.

C.
This proposed new fee will not exceed the estimated
22 cost of providing such services, and for those services which are
23 not completely paid for by the proposed fee, the additional
24 expense to the City of providing the services shall be borne by
25 the general fund of the City of San Bernardino.

D.
The proposed fees are reasonable and necessary to
27 enable the City of San Bernardino to meet the actual. costs of

The adoption of this resolution is exempt from the
3 California Environmental Quality Act because it involves
4 inspections under Section 15309 of Title 14 of the California
5 Code of Regulations and because it approves fees for the purpose
6 of meeting a portion of the operating expenses of the City
7 Planning and Building Services Department, as set forth in Public
8 Resources Code 21080 (b) (8).

SECTION 2. Existing Signs.
10 For each sign erected on or before June 2, 1990, an initial
11 Annual Sign Code Inspection Sticker fee of Twenty-Five Dollars
12 ($25.00) shall be due and payable to the City of San Bernardino
13 on June 2, 1990.

SECTION 3. New Signs.
15
For each new sign erected after June 2, 1990, an Annual
16 Sign Code Inspection Sticker fee of Twenty-Five Dollars ($25.00)
17 shall be due and payable to the City of San Bernardino on the
18 date the sign is erected.

SECTION 4. Annual Renewal Fee.
20 Renewal fees for an Annual Sign Code Inspection Sticker
21 shall be due and payable on July 1st of each year beginning July
22 1, 1991; except that new signs erected between May 1 to July 1
23 of any year for which an initial annual fee has been paid will be
24 exempt from payment of a renewal fee for the first year after the
25 sign was erected.

SECTION 5. Delinquent Fees.

19.60.010 Purpose and intent.
The purpose of this chapter is to provide reasonable coll-
trois for signs within the City of San Bernardino in order to
safeguard and enhance property values and investments, pro-
mote commerce, prevent traffic hazards, encourage redevelop-
ment of blighted areas, and create a more desirable environment
for residents and nonresidents who come to visit or trade. (Ord.

19.60.020 Defmitions.
A. SIGN shall include all outdoor advertising on any card,
cloth, paper, plastic, metal, painted glass, wooden or stone
materials and any and all devices, structural or other-
wise, lighted or unlighted, painted or not painted, attached
to, made a part of or placed in the window of, in the
front, rear, sides or top of any structure on any land or
any tree, wall, bush, rock, post, fence, building or struc-
ture and visible from any public or private street, way,
thoroughfare, alley or walk, which device announces or
directs attention to the name or nature of a business.

occupant of a structure, bUilding or land or the nature or
type of goods, services or products produced, sold, stored
furnished or available at that location or at any othe;
location, including signs specifically for the sale of real
property.
The term "placed" as used in this section shall include
erected, constructed, posted, painted, printed, tacked,
glued, stuck, carved or otherwise fastened, fixed or made
visible in any manner whatsoever.
B. ON-PREMISE SIGN shall include any sign which advertises
or informs in any manner businesses, services, goods,
persons, or events which are located at the same location
upon which the sign is located.
C. OFF-PREMISE SIGN shall include any sign which advertises
or informs in any manner businesses, services, goods,
persons, or events at some location other than that upon
which the sign is located. Off-premise sign, billboard, and
outdoor advertising structure are equivalent terms.
D. KIOSK shall mean an off-premise sign used for directing
people to the sales office or models of a residential sub-
division project. Structural and design details of such signs
are shown as Exhibit "19-A" under Section 19.60.140 D.1.
of this chapter.

19.60.030 Area measurement.
A. The area of any sign shall be measured by one face only and
shall not include decor or pole covers. Symbols or other
designs implying the name of the business or services
rendered shall be included in the total square footage.
B. Individual letters mounted on a building shall be measured
by the area enclosed by four straight lines outlining each
letter.

19.60.040 Prohibition.
It is unlawful for any person except a public officer or
employee in the performance of a public duty to attach a sign
to any public property except as may be required by ordinance

19.60.090 Exempt signs.
. The following signs shall be exempt from the provisions of this
,hapter.
A. Window signs not exceeding three square feet and limited to
business identification. hours of operation. address and emergency
information,
B. Signs within a structure and not visible from the outside,
C. Memorial signs and plaques installed by a civic organization rec-
ognized by the Mayor and Common Council.
D, Official and legal notices issued by a coun or governmental
agency,
E. Officialllags of the United States, the State of California. and other
states of the nation. counties. municipalities. official flags of
foreign nations and nationally or internationally recognized or-
ganizations.
F. Identification signs on construction sites, Such signs shall be
limited to one director or pictorial display sign per street frontage
or entrance. up to a maximum of two signs. identifying all
contractors and other panies (including lender. realtor. subcon-
tractors. etc,), Each sign shall not exceed thiny-two square feet
in area and eight feet in height. Each sign shall be removed prior
to issuance of a Cenificate of Occupancy,
G, Political signs. regulated in Chapter 16.12.

..1 Temporary signs.
A. Banners. flags and pennants shall be allowed with a permit from
the Depanment of Building and Safety in Col. C-2. C-3. C-3A.
C-4. CoM. M--I,. M-IA and M-2 zones for periods not to exceed
fony-five days. Such temporary sign permits shall not be granted
to the- business or location more than twice during anyone year.
The two permitted time periods shall not be granted consecutively.
but shall be separated by a time period of at least sixty days.
Banners shall not occupy more than ten percent of the wall area
exclusive of window or door area upon which the sign is located.
A maximum of two banners shall be permitted in anyone time
period, The maximum size for anyone banner shall be fifty square
feet.
B. Temporary window signs may be permitted on the inside of
window facing out which do not cover more than fifty percent of

19.60.110 Public and municipal purpose signs.
The Mayor and Common Council may authorize, subject to
conditions, the erection of a limited number of public and
municipal purpose signs, not to exceed six square feet in size,
at designated locations in "R" residential zoning districts for
stated periods of time, without compliance with the require-
ments of this code. Public and municipal purpose signs shall be
limited to the following kinds of signs:
I. Burglary and crime prevention.

19.60.120 Prohibited signs - General.
All signs not expressly permitted are prohibited in all zones.

19.60.130 Prohibited signs - Express.
The following signs are unlawful 10 the City of San
Bernardino:
A. Flashing signs (except time and temperature signs and
electronic message centers).
B. Animated signs.
C. Revolving signs.
D. Vehicle signs: No sign shall be temporarily attached to or
placed upon any vehicle. Such signs shall be permitted only
if painted directly upon, or permanently attached, to the
body of a public transportation vehicle or a vehicle regularly
used in a business to which the sign pertains.
E. Portable or A-frame signs.
F. Signs within the public right-of-way (except where approved
or required by a government agency).
G. Balloons or other inflatable wind activated or spinning
devices.
H. Signs by which color, wording, design, location or illustra-
tion resemble or conflict with any traffic control device.
I. Signs that create a safety hazard by obstructing clear view
of pedestrian and vehicular traffic.
J. Roof signs.

sent the attached sign registration program information. This
packet included a cover letter from Larry Reed, a sign
registration application and a copy of the resolution. A
clerk has been hired as of June 11th to provide clerical
support for administration of this new program, and Don
Hesterley has been assigned as the program coordinator. Calls
should be directed to him concerning specific questions about
the program.

The City of San Bernardino has adopted a new ordinance
(Ordinance Number MC-717) and resolution (Resolution Number
90-115) requiring that all signs have an annual sign sticker.
This resolution will become effective on June 2, 1990. The
law requires that every person, firm or corporation owning or
leasing any legally permitted sign in the City of San
Bernardino shall obtain for each sign an Annual Sign Sticker.
A sticker is required for each and every on-premises and off
premises sign. This sticker is applicable to one sign at one
location only, and is transferable to a new owner or lessee
of that sign. This sticker must be displayed on a visible
portion of the face of the sign or its structural support.
The issuance of any sign permit or Annual Sign Code
Inspection sticker does not allow any person, firm, or
corporation to erect or maintain any signs in violation of
any City ordinances or any State or Federal laws.
The fee in the amount of $25.00 for an Annual Sign
sticker shall be due and payable on July 1st of each calendar
year to the Department of Planning and Building Services
located on the third floor of City Hall, 300 North "0"
Street, San Bernardino, California, 92418.
Please find enclosed a copy of the annual sign
resolution, the application for annual sign registration and

INSTRUCTIONS FOR FILING AN APPLICATION FOR
ANNUAL SIGN REGISTRATION

A. GENERAL
All existing and new permanent signs shall be subject to an annual sign registralion requirement and $25 fee. All
permanent signs shall display a sticker issued annually by the Department of Planning and Building Services.
Field inspections will be conducted and Notice of Violation will be mailed to property owners of properties where
unregistered signs are located.
B. WHAT TO FILE
1. Application Form
One copy of the Annual Sign Registration application properly filled out and signed shall be submitted
annually. A separale application is required for each separate address. If the sign or signs have not changed
from the oreviouslv raoistered vear in any manner, the plot plan and pictures may be delated from the required
submittals.

Fee(s) of $25 per sign shall be submitted w~h the application. A double faced sign counts as one sign.
3. Plot Plan
A plot plan of all permanent sign(s) shall be submitted w~h the application. The plot plan shall adequalely
illuSlratethelocation of the signs by showing thedistanca in feet from structure(s), from property line(s), from
curb(s) and from the centerline of road(s). The outside dimension of structures shall be indicated. as well as
the north arrow and scala of plot drawing. The plot plan may be prepared on the reverse side of the application
form. (See allached sample plot plan.)

Photographs of each sign, including each side of a double faced sign, shall be submitted w~ the application.
Number photographs according to number in sign information section of regisltation application. Double
faced signs should be numbered w~ a Ialler suffix, i.e. (1A and 1 B).
C. WHERE TO FILE
A completed application, including all required submittals and fee(s), shall be filed at the Planning and Building
Services Department any weekday between the hours of 7:30 a.m. and 4:00 p.m.

D. PROCESSING
Upon appIicalion review and approval for completeness, an annual sticker will be sent in the mail to the
APPLICANT'S address. The sticker will be colored differently for each year. Peel off the backing and install the
stickar on the bollom or loWer right.hand corner of the sign, where the sticker will be readily visible from the public
right-of-way. For double-faced signs which are perpendicular to a public right-of-way place the sticker on the outer
edge or side of the sign neXl to the road.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY

SECTION 1.
Resolution 90-115 is amended to read as

"For each lot upon which a sign has been erected on or
before June 2, 1990, an initial Annual Sign Code Inspection
Sticker fee of Twenty-Five Dollars ($25.00) shall be due
and payable to the City of San Bernardino on June 2, 1990."
B.
"Section 2.
New Signs.
14 "For each lot upon which a new sign is erected after
15 June 2, 1990, an Annual Sign Code Inspection Sticker fee of
16 Twenty-Five Dollars ($25.00) shall be due and payable to
17 the City of San Bernardino on the date the sign is
18 erected."
