Synopsis of Previous Council action:
05-15-81 -- Resolution No. 81-235, adopted by the Mayor and Common Council,
found that the public interest, convenience and necessity required
the formation of a landscaping construction and maintenance
district.

Resolution No. 81-33, adopted by the Mayor and Common Council,
declared that all the land included within the boundaries of
said district will be benefited by the construction and maintenance
of said landscaping.

STAFF REPORT
As required by the prov1s1ons of Chapter 12.90 of the Municipal Code and
Resolutions No. 81-235 and 61-33, which established the District, the annual
assessment roll relative to Assessment District No. 952 (State College Area
Landscaping Maint. Distr.) has been prepared and is attached to the Resolution.
The roll for 1990-91 totals $77,789.48 and is submitted to your Honorable
Body for action as required.

2 A RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 1990-91 ASSESSMENT
ROLL FOR ASSESSMENT DISTRICT NO. 952, LANDSCAPING CONSTRUCTION AND
3 MAINTENANCE. STATE COLLEGE PARKWAY (UNIVERSITY PARKWAY) AREA.

5 WHEREAS, by Resolution No. 81-235, the Mayor and Common Council
6 found that the public interest, convenience, and necessity required the
7 formation of a landscaping construction and maintenance district; and

WHEREAS, by said Resolution No. 81-235, the Mayor and Common
Council formed an assessment district known as Assessment District No. 952
for the purpose of providing landscaping construction and maintenance in the
State College Parkway Area pursuant to the provisions of Chapter 12.90 of the
San Bernardino City Municipal Code; and
14 WHEREAS, by Resolution No. 81-33, the Mayor and Common Council
15 declared that all the land included within the boundaries of said district
16 will be benefited by the construction and maintenance of said landscaping;

WHEREAIi, said Resolution No. 81-33 declared that an annual
assessment shall be levied on all land within the district to provide funding
for said landscaping construction and maintenance and the administration
thereof; and
23 WHEREAS, the payments on the construction portion of the district
24 were spread over a five (5) year period and the last payment thereon was made
25 on the 1987-88 assessment roll, therefore all assessment rolls hereafter are
26 prepared only for the maintenance and administration of the landscaping; and

1 WHEREAS, an Assessment Roll has been prepared totalling $41,973.15
2 for Zone 1, $34,852.56 for Zone 2, and $963.77 for Zone 3, or $77,789.48 for
3 the entire District, which sets forth the individual assessments to be levied
4 on each of the parcels of land within Assessment District No. 952 for the
5 fiscal year 1990-91,

7 NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
8 SAN BERNARDINO AS FOLLOWS:

SECTION 1. That the Mayor and Co_on Council do hereby find and
11 determine that the proportionate costs to be levied against the parcels of
12 land within Assessment District No. 952 are correctly set forth on
13 Assessment Roll No. 952 for the fiscal year 1990-91, designated as Exhibit
14 "A" and attached hereto, and do hereby confirm said assessments.

SECTION 2. That the City Clerk is directed to cause a copy of this
Resolution to be transmitted to the Office of the Auditor-Controller for the
County of San Bernardino with the request that the individual assessments be
placed on the subject 1990-91 property tax bills for collection together
with all other property taxes.
