AND CERTIFICATION OF FINAL EIR RELATING
THERETO
Call to Order
This meeting will be called to order. This is a
joint meeting of the Community Development
Commission and the Mayor and Common Council of
the City of San Bernardino. The Mayor and Common
Council also sit as members of the Community
Development Commission. This is an adjourned
regular meeting.
The purpose of this !..eeting is to conduct a joint
public hearing to consider and act upon the
Redevelopment Plan for the Mt. Vernon Corridor
Redevelopment Project and the certification of
the Final Environmental Impact Report on the
Redevelopment Plan.

I will now call this joint public hearing open.
The state law under which we are acting is the
Community Redevelopment Law of the State of
California. That law requires that we follow
certain procedures, some of them formal, in the
conduct of tonight's joint public hearing.

This is a combined hearing on b~th the Mt. Vernon
Corridor Redevelopment Plan and the certification
of the Final Environmental Impact Report on the
Redevelopment Plan, so please make it clear when
you are speaking whether your remarks are
directed to the Redevelopment Plan, the adequacy
of the Final Environmental Impact Report, or both.
The staff presentation tonight will be made by
the Executive Director of the Community
Development Commission, the Project Director, the
Redevelopment Consultant with the firm of Urban
Futures and the Special Legal Counsel for the
Community Development Commission.
Before proceeding, may I have an indication by
show of hand of those in the audience who wish to
speak tonight on the Redevelopment Plan or the
Final Environmental Impact Report.

Our order of procedure toniqht will be as follows:
1. The staff will present the Redevelopment
Plan, the Final Environmental Impact Report
and other evidence and testimony in support
of the Redevelopment Plan.
2. Next, we will receive any written comments.
3. We will then receive any evidence or oral
testimony from those present concerninq the
Redevelopment Plan or the Final
Environmental Impact Report.
4. Following the introduction of all evidence
and testimony tonight, and upon the
conclusion of the hearing, we will do one of
two things: (1] if no written objections
have been received, we will consider and act
upon all oral objections and then act on the
Final Environmental Impact Report and the

objections have been received and are not
rescinded.

Thank you. As the Presiding Officer has
indicated, the purpose of this hearing is to
consider evidence and testimony for and against
the adoption of the Mt. Vernon Corridor
Redevelopment Plan and the certification of the
Final EIR. Evidence will be introduced for
consideration by the Mayor and Common Council and
the Community Development Commission in
connection with certain findings and
determinations which are to be made in the
adoption of an ordinance adopting the
Redevelopment Plan. These findings and
determinations are contained in Section 33367 of
the Health and Safety Code. A copy of that
Section is included in the materials which have
been distributed to the Common Council. Very
briefly, some of the findings are:

1. The proposed "Project Area" meets the legal
qualifications set forth by the legislature
for a blighted area.
2. The Redevelopment Plan would redevelop the
Project Area in conformity with the law.
3. The adoption and carrying out of the
Redevelopment Plan is economically sound and
feasible.
4. The Redevelopment Plan conforms to the
General Plan of the community.
5. The elimination of blight and the
redevelopment of the Project Area could not
reasonably be expected to be accomplished by
private enterprise acting alone without the

aid and assistance of the Community
Development Commission.
That is only a partial description; there are
other statements and determinations set forth in
the proposed ordinance adopting the Redevelopment
Plan, but the foregoing are most of the major
evidentiary findings.

We will now proceed with the receipt of evidence
and testimony.
Summary of Report to Common Council
[Background of Project; rationale for Project)
[Introduction; comments)
Staff has prepared, and each of the Common
Council members has before them, a notebook
containing reports, resolutions, statements,
memoranda and other information pertaining to the
proposed Redevelopment Plan and the Project
Area. Most of the items contained in the
notebook have been previously reviewed by the
members; the materials are now in one place for
convenience. In my remarks, I will be referring
to a Report to the Common Council; major portions
of that Report were previously submitted by the
Community Development Commission to the Common
Council in May, and have been available for
public inspection. The portions of the Community
Development Commission's Report to Council as
transmitted pursuant to Resolution No. 5252

approved and adopted on May 7, 1990, appear in
the notebook after the Agenda at tab 4-A. The
draft Environmental Impact Report for the
proposed Project now appears as part of the Final
Environmental Impact Report.
Project Area boundaries were established by the
Planning Commission by Resolution No. PC 89-2,
approved November 7, 1989. Maps of the Project
Area, included as part of the Redevelopment Plan,
conform to the foregoing action by the Planning
Commission.
The Planning Commission has recommended approval
of the Redevelopment Plan, and has found that the
Redevelopment Plan is consistent with the General
Plan of the City of San Bernardino. In addition,
comments have been received to the draft EIR.
Also, continuing discussions have been held with
the County and other agencies concerning the
Project, a summary of which discussions is
included in the notebook. Notice of tonight's
hearing was provided pursuant to statute. All
materials contained in the notebook should be
made a part of the record.

I would now like to refer to and briefly
summarize pertinent parts of the Report to the
Common Council, which is the basic supporting
documentation for the Redevelopment Plan and the
ordinance which will adopt the Redevelopment
Plan. Since major portions of the Report have
been previously submitted by th~ Community
Development Commission to the Council have been
available for public inspection, I will only
cover certain pertinent parts of the Report in
detail.

MT. VERNON CORRIDOR REDEVELOPMENT PROJECT - CITY OF

SUBJECT:
RECOMMENDATION:
Adopt resolution electing to be allocated various revenues within the Mt. Vernon
Corridor Redevelopment Plan attributable to increases in tax rate and valuation.
BACKGROUND INFORMATION:
The City of San Bernardino is proposing to adopt a redevelopment plan for the
Mt. Vernon Corridor area. The scheduled public hearing date is June 11. 1990.
Those provisions of the Health and Safety Code. State of California, governing
community redevelopment. allow the County to adopt a resolution prior to plan
adoption which will allocate to the County those property tax revenues
attributable to increases in tax rates and increases in assessed value. It is the
intent of these provisions that the County will receive increased revenue from the
property area due to the effect of inflation. The annual increase in revenue is
capped at 2%. Adoption of this resolution will partially offset the effect of
freezing the allocation of property tax revenue at the level of such revenue in the
base year ofthe plan.

DISTRICT, ELECTING TO BE ALLOCATED VARIOUS
REVENUES WITHIN THE MT. VERNON CORRIDOR
REDEVELOPMENT PLAN ATTRIBUTABLE TO INCREASES
THEREIN IN THE RATE OF TAX AND INCREASES IN
THE ASSESSED VALUATION
WHEREAS, Health and Safety Code Section 33670 permits a
redevelopment agency to receive tax increment money to finance
redevelopment projects with money which would otherwise be
received by affected taxing agencies; and
WHEREAS, Health and Safety Code Section 33676(a) (1)
provides that before the adoption of a redevelopment plan an
affected taxing agency may elect to be allocated all or any
portion of the tax increment amount attributable to increases in
the rate of tax imposed for the benefit of the taxing agency
which levy occurs after the tax year in which the ordinance
adopting the redevelopment plan becomes effective; and
WHEREAS, Health and Safety Code Section 33676(a) (2)
provides that before the adoption of a redevelopment plan an
affected taxing agency may elect to be allocated the tax
increment amount attributable to increases in the assessed value
of the taxable property in the redevelopment project area that
are, or otherwise would be, calculated annually pursuant to
Revenue and Taxation Code Section 110.1(f); and
WHEREAS, the City of San Bernardino has scheduled a
public hearing on June 11, 1990 to adopt the plan for the
Mt. Vernon Corridor Redevelopment Plan (hereafter the "Plan").
NOW, THEREFORE, BE IT RESOLVED THAT:
1. The Board of Supervisors acting in its capacity as
the governing body for the County of San Bernardino (hereafter
"County") and for the San Bernardino County Flood Control

District (hereafter "District"), hereby elects for the County and
for the District to receive, in addition to the portion of taxes
respectively allocated thereto pursuant to Health and Safety Code
Section 33670(a), all of the tax revenues allocated to the
Redevelopment Agency of the city of San Bernardino pursuant to
Health and Safety Code Section 33670(b) attributable to the
following:
(A) Increases in the rate of tax imposed for the
benefit of the County or for the District, or for both, which
levy occurs after the tax year in which the ordinance adopting
the Plan becomes effective; and
(B) Increases in the assessed value of the taxable
property in the Plan area, as the assessed value is established
by the assessment roll last equalized prior to the effective date
of the ordinance adopting the Plan pursuant to Health and Safety
Code Section 33670(a), which are, or otherwise would be, calcu-
lated annually pursuant to Revenue and Taxation Code Section
llO.l(f).
(2) That the Clerk of the Board of Supervisors is
hereby directed to certify to the passage of this resolution and
to forward a copy of the same to each of the following public
bodies and officers:
(a) The City Clerk of the City of San Bernardino;
(b) The Redevelopment Agency of the City of
San Bernardino.

ELECTING TO RECEIVE INCREMENTAL PROPERTY TAX REVENUES
AS PROVIDED FOR BY SECTION 33676
OF THE CALIFORNIA HEALTH AND SAFETY CODE
CITY OF SAN BERNARDINO
MT. VERNON CORRIDOR REDEVELOPMENT PROJECT
WHEREAS, Section 33676 of the California Health and Safety
Code provides for the San Bernardino Community College District,
an affected taxing agency, to make certain elections regarding
the receipt of incremental property tax revenues to be derived
from a proposed redevelopment area; and
WHEREAS, the City of San Bernardino and the Redevelopment
Agency for the City of San Bernardino are considering adopting a
Redevelopment Plan and have designated a project area for the Mt.
Vernon Corridor Redevelopment Project and said Plan provides for
tax increment financing pursuant to Section 33670 of the
California Health and Safety Code; and
WHEREAS, Section 33676 of the California
Code requires said election to be made by
Community College District prior to the City
and the Redevelopment Agency adopting the Plan
Corridor Redevelopment Project; and
WHEREAS, the San Bernardino Community College District has
not entered into an agreement with the City of San Bernardino and
the Redevelopment Agency for the City of San Bernardino pursuant
to Section 33401 of the California Health and Safety Code;

San Bernardino Community College District Board of Trustees, in
regular session assembled on April 12 ,1990, that:

WHEREAS, Section 33676 of the California Health and Safety
Code provides for the San Bernardino County Superintendent of
Schools, an affected taxing agency, to make certain elections
regarding the receipt of incremental property tax revenues to be
derived from a proposed redevelopment area; and
WHEREAS, the City of San Bernardino and the Redevelopment
Agency for the City of San Bernardino are considering adopting a
Redevelopment Plan and have designated a project area for the
Mt. Vernon Corridor Redevelopment Project and said Plan provides
for tax increment financing pursuant to Section 33670 of the
California Health and Safety Code; and
WHEREAS, Section 33676 of the California Health and Safety
Code reQuires said election to be made by the San Bernardino
County Superintendent of Schools prior to the City of San
Bernardino and the Redevelopment Agency adopting the Plan for the
Mt. Vernon Corridor Redevelopment Project; and
WHEREAS, the San Bernardino County Superintendent of SChools
has not entered into an agreement with the City of San Bernardino
and the Redevelopment Agency for the City of San Bernardino
pursuant to Section 33401 of the California Health and Safety
Code;
NOW, THEREFORE, BE IT RESOLVED that:
The San Bernardino County Superintendent of SChools elects
to receive that portion of property tax revenues that would
otherwise be allocated to the Redevelopment Agency of the City of
San Bernardio pursuant to subdivision (b) of Section 33670 of the
California Health and Safety Code for the Mt. Vernon Corridor
Redevelopment Project that are attributable to the fOllowing:

9 WHEREAS, the Community Development Commission of the City
of San Bernardino (the .Community Development Commission") is
10 considering the adoption of a proposed Mt. Vernon Corridor
Redevelopment Plan (the "Redevelopment Plan"), and has prepared
11 a Preliminary Report, as provided for by statute, in connection
therewith; and

WHEREAS, pursuant to the California Environmental Quality
13 Act, the State CEQA Guidelines and the Community Development
____Commission procedures adopted pursuant thereto, the Development
14 Commission has prepared and completed the proposed final EIR
for the Mt. Vernon Corridor Redevelopment Project (the

WHEREAS, pursuant to Sections 33458 and 33355 of the
California Health and Safety Code, a joint public hearing of
the Common Council and the Community Development Commission may
be conducted at which the adoption of the proposed
Redevelopment Plan and the proposed final EIR prepared in
conjunction therewith will be considered; and
WHEREAS, the Community Development Commission has consented
to the holding of such hearing and has requested that the Mayor
and Common Council set the time, date and place for such
hearing; and
WHEREAS, the Community Development Commission has submitted
to the Common Council its report concerning the Redevelopment
Plan (the "Report"), receipt of which is hereby acknowledged;
NOW, THEREFORE, the Mayor and Common Council of the City of
San Bernardino does hereby resolve as follows:
SECTION 1. The Mayor and Common Council consent to and,

the spread of recurrence of conditions of blight. Such activities
include the revitalization of the area, housing rehabilitation,
construction of needed traffic and circulation improvements,
school, cultural and recreation improvements: the rehabilitation
and conversion of existing structures that are consistent with the
Plan: the redevelopment of properties that are inconsistent with
the Plan: and the construction of other public improvements and
facilities. The Community Development Commission proposes ,to
reserve the right to use the power of eminent domain within the
Project Area (see the attached Statement Regarding Acquisition).

STATEMENT REGARDING ACQUISITION
In accordance with section 33350 of the Health and Safety Code of
the State of California, this statement is being attached to each
notice of hearing mailed to the last known assessee of each parcel
of land in the area designated in the Mt. Vernon' Corridor
Redevelopment Plan (the "Plan") for the Mt. Vernon Corridor
Redevelopment Project of the Community Development Commission of
the City of San Bernardino.
The purpose of this statement is to give notice that the property
of each assessee described above is subject to acquisition under
the following conditions as set forth in Section 403 of the
Redevelopment Plan:
"The Agency may purchase, lease, obtain option upon or
otherwise acquire any interest in real property located
in the Project Area by gift, devise, exchange, purchase,
or any other means authorized by law including the use of
eminent domain for the purpose of redevelopment.
Acquisition of property will generally be achieved by
cooperative negotiations between the owner of such
property and the Agency."
The power of purchase and condemnation is general and the proposed
Plan has no specific list or description of property to be
acquired by purchase or condemnation because no such specific
property is known at this time and should such acquisition become
necessary in the future to carry out a project, the Redevelopment
Agency of the City of San Bernardino will meet all requirements of
law, including notification as to intent at that time.

En conformidad con la Seccion 33350 del Codigo de Salubridad y Seguridad del Estado de
Califomia, esta declaracion es Iigada a cada aviso de audiencia enviada al ultimo conocido
propietario/asesorado de cada porcion de terreno en el Plan de Reurbanizacion del Corredor
de Mt. Vernon (Mt. Vernon Corridor Redevelopment Plan) para el proyecto de Reurbanizacion

EI proposito de esta declaracion es para avisar, que, la propiedad de cada propietariol

Honorable Members:
This letter is submitted to you as members of the governing bodies considering the
subject redevelopment plan for adoption at the public hearing scheduled for June
11, 1990. The following objections are made by the County Administrative Office to
the referenced redevelopment plan.
Section 33367, Health and Safety Code, State of California, mandates that the
ordinance adopting a redevelopment plan include certain findings and
determinations. The legislature intended that the Redevelopment
Agency/governing body have before it clear, specific and substantial evidence and
documentation substantiating its findings. Minimum documentation and
perfunctory reference to provisions of the enabling legislation is insufficient. In
general, the findings contained in the ordinance are not based on substantial
evidence.. The following are specific objections of the County:
1, Neither the plan, the EIR, the Preliminary Report nor the supplementary
material adequately supports the conclusion that the entirety of the project
area is blighted and requires the use of redevelopment authority to achieve
the public purposes declared in the redevelopment law. Large tracts of land
owned by the Flood Control District and lying within the flood plain are
included within the proposed project boundary. No documentation is
included in the plan documents to establish a condition of blight on that
land nor do the plan documents indicate specific benefits to said property
which would result from project activities.
2. No substantial and specific evidence or documentation is provided to
support a finding that the redevelopment plan would redevelop the area in
the interest of the public peace, health, safety and welfare.
3. Neither narrative information, financial plans, or budgets are included in
the plan or supporting material to support any finding that adoption and
carrying out of the plan is economically sound and feasible.

4. Substantial evidence is not provided to sustain the finding that the
redevelopment plan conforms to the general plan of the city. The plan's
finding appears to be based solely on the undocumented assertion in the
plan that its implementation will be in accordance with the general plan
and zoning ordinances as may be amended from time to time.
5. No substantial evidence or documentation specific to the area proposed for
redevelopment is supplied to warrant the conclusion that carrying out the
redevelopment plan would promote the public peace, health, safety and
welfare of the community.
6. The plan and related material contains only minimum reference to the role
that condemnation of real property will play in project implementation.
Insufficient evidence and documentation are included to support the
finding that condemnation is necessary to the execution of the plan.
Further, the plan lacks substantial evidence, or any evidence at all, to
warrant the conclusion that adequate provisions have been made for
payment for property so acquired.
7. Neither the plan nor supporting documents provide sufficient evidence to
conclude that a feasible plan exists for the temporary or permanent
relocation of facilities and persons displaced from the project area. The
redevelopment plan, in fact, indicates that such a relocation plan does not
yet exist but is to be prepared.
8. No evidence is provided that there are or are being provided in the project
area or in other areas not generally less desirable in regard to public utilities
and publiC and commercial facilities and at rents or prices within the
financial means of the families and persons displaced from the project area,
decent, safe and sanitary dwellings equal in number to the numbers of and
available to the displaced families and persons, and reasonably accessible to
their places of employment. The proposal set forth in the plan to evaluate
this problem after adoption of the plan is legally inadequate.
9. Neither the plan nor supporting documents includes substantial evidence or
documentation that the non contiguous portions of the project (shown as
sub-area B and sub-area C) are either blighted or necessary for effective
redevelopment and are not included for the purpose of obtaining tax
increment without other substantial justification fortheir inclusion.
10. Insufficient information is included in the plan and supporting material to
justify inclusion of all of the properties in the plan. The project area
includes many lands, buildings and improvements that are not detrimental
to the public health, safety or welfare. Only generalized information is
provided to support the conclusion that all properties included in the
project boundary are necessary for effective redevelopment. A substantial
number of properties have apparently been included solely to obtain the
allocation of tax increment and not because they are a detriment to the
publiC health, safety or welfare or necessary for effective redevelopment.

1 1. Neither the plan nor any other materials presented provide substantial
evidence, or any evidence at all, upon which to base a finding that
redevelopment could not reasonably be expected to be accomplished by
private enterprise acting alone without the aid and assistance of the
agency.
12. The information provided by the agency does not support the conclusion
that the use of tax increment revenues for project financing will not cause
significant financial burden or detriment to affected taxing entities.
Analysis by the county staff indicates that allocation of tax increment to the
agency for project purposes will create a substantial burden on the County
General Fund, County Flood Control District and County Library District.
Loss of tax increment by these agencies will severely impair their ability to
provide for the current level of service and meet those service demands,
both in quality and quantity, created by project activities. Further
information concerning this matter is contained in the report of the Fiscal
Review Committee, which is incorporated herein by this reference.
The above information is provided for the consideration of the governing bodies
empowered to adopt the Mt. Vernon Corridor Redevelopment Plan. The provisions
of Section 33367, Health and Safety Code, have n t been met and that the plan is
not suitable for adoption.
