RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO, A MUNICIPAL CORPORATION, GRANTING AN EASEMENT BY THE
CITY OF SAN BERNARDINO TO SOUTHERN CALIFORNIA EDISON COMPANY.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:

SECTION 1. The City of San Bernardino does hereby authorize
7 the Mayor to execute and deliver on behalf of the City of San
8 Bernardino an Easement and Right of Way to construct, use,
9 maintain, operate, alter, add to, repair, replace, reconstruct,
10 inspect, and remove at any time and from time to time, underground
11 electrical supply systems and communication systems to Southern
12 California Edison Company; for a parcel of property located in the
13 City of San Bernardino, described as follows:
14 A strip of land, 6 feet wide, lying within a portion
of the Muscupiabe Rancho, as per plat recorded in Book
15 7 of Maps, page 23, including a portion of Lot 66 of
the Lands of Irvington Land and Water Company, as per
16 plat recorded in Book 1 of Records of Survey, page 32,
all records of said County, the Northerly, Easterly
17 and Southerly lines of said 6-foot wide strip of land
being described as follows:

COMMENCING at the centerline intersection of Kendall
Drive and Palm Avenue, as shown on map recorded in
Book 6 of Records of Survey, page 79, records of said
County, thence South 27039'30" West along said
centerline of Palm Avenue 1367.28 feet to a point in
the Southerly line of said survey recorded in Book 6
of Records of Survey, page 79; thence North 34024'50"
West along said last mentioned Southerly line 561.01
feet to an angle point therein; thence continuing
along said last mentioned Southerly line, North
24022'50" West, 759.75 feet to a point therein; thence
North 84023'00" East, 211.64 feet to the TRUE POINT OF
BEGINNING of this strip description; thence North
84034'00" East, 115 feet; thence South 11009'00" East,
210 feet; thence South 84034'00" West, 10 feet.

It is understood and agreed that the above description
is approximate only, it being the intention of the
Grantor to grant an easement for said systems as
constructed. The centerline of the easement shall be

coincidental with the centerline of said systems as
constructed in, on, over, under, across and along the
Grantor's property.

3 and that the granting of this Easement is necessary to provide
4 Southern California Edison the necessary space required to connect
5 to Water Department facilities.

SECTION 2. A copy of said Easement, containing an
7 appropriate legal description of the parcel of real property, is
8 attached, marked Exhibit "1", and made a part hereof as fully as
9 though set forth at length herein.

11 adopted by the Hayor and Common Council of the City of San

a corporation (hereinafter referred to as "Grantor"), hereby grants to SOUTHERN CALlFOfu'l;IA EDISON COMPANY. a
corporation. its successors and assigns (hereinafter referred to as "Grantee"), an easement and right of way to construct, use,
maintain, operate, alter, add to, repair, replace, reconstruct, inspect and remove at any time and from time to time
underground electrical supply systems and communication systems (hereinafter referred to as "systems"), consisting of wires,
underground conduits~ cables~ vaults~ manholes, handholes, and including above-ground enclosures, markers and concrete
pads and other appurtenant fixtures and equipment necessary or useful for distributing electrical energy and for transmitting
intelligence by electrical means, in, on, over, under, across and along that certain real property in the County of
San Bernardi no ,State of California, described as follows:
SEE ATTACHED EXHIBIT "A" FOR LEGAL DESCRI PTION AND ADDITIONAL PROVISIONS,
TERMS AND CONDITIONS WHICH ARE INCORPORATED HEREIN AS AN INTEGRAL PART
OF THIS GRANT OF EASEMENT.
The Grantor agrees for itself, its successors and assigns not to erect, place or maintain, nor to permit the erection,
placement or maintenance of any building, planter boxes, earth fill or other structures except walls and fences on the above
described real property. The Grantee, and its contractors, agents and employees, shall have the right to trim or cut tree roots
as may endanger or interfere \\;th said systems and shall have free access to said systems and every part thereof, at all times,
for the purpose of exercising the rights herein granted; provided, however, that in making any excavation on said property of
the Grantor(s), the Grantee shall make the same in such a manner as will cause the least injury to the surface of the ground
around such excavation, and shall replace the earth so removed by it and restore the surface of the ground to as near the same
condition as it was prior to such excavation as is practicable.

plat recorded in Book 7 of Haps, page 23, including a portion of Lot 66 of the Lands
of Irvington Land and \,ater Company, as per plat -recorded in Book I of Records of
Survey, page 32, all records of said County, the Northerly, Easterly and Southerly
lines of said 6-foot wide strip of land being described as follows:
