HomeMy WebLinkAbout1983-136 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 RESOLUTION NO. 83-136 A RESOLUTION OF THE CITY OF SAN BERNARDINO RESCINDING THE NECESSITY OF ADHERING TO A PORTION OF THE LABOR CODE OF THE STATE OF CALIFORNIA RELATIVE TO ASSESSMENT DISTRICTS FOR THE MAINTENANCE OF LANDSCAPING. WHEREAS, the City of San Bernardino has and will establish special Assessment Districts for the maintenance of landscaping within the public right of way; and WHEREAS, the City of San Bernardino lets the work of said maintenance to private contract under competitive bidding; and WHEREAS, said contract work is within the sphere of the City's municipal affairs; and WHEREAS, the City of San Bernardino is interested in obtaining as reasonable a price as possible for said maintenance so as not place any extraordinary burden upon the property owners who are assessed to pay the cost of such maintenance; and WHEREAS, the City of San Bernardino.contemplates only the use of local funds for the projects affected hereby, with no state or federal funds to be involved; NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO THAT: SECTION 1. In an exercise of its municipal affairs powers, the City of San Bernardino does hereby determine that the prevailing rate of per diem wages in accordance with the standards as set forth in the Labor Code of the State of California, starting with Section 1770 shall not apply to maintenance of landscaping contracts undertaken in conjunction with Assess- ment Districts created by the City of San Bernardino, where no state or federal funds are involved but that federal minimum wage laws shall be the sole determinant of minimum wages to be paid by any contractor engaged in 27 such contracts. This provision shall apply only to those contracts not 28 involving any matter of state concern, and is specifically limited to those - 1 - 1 contracts pre-funded by City funds. Any state and/or federally funded 2 projects and any projects considered to be of state concern are specifically 3 excluded from the provisions of this Resolution. 4 I HEREBY CERTIFY that the foregoing resol ution was duly adopted 5 by the Mayor and Common Council of the City of San Bernardino at an adjour ed 6 7 8 9 10 ~1 12 ~3 14 15 16 .17 18 19 20 21 22 23 24 2S 26 27 28 regular 23rd day meeting thereof, held on the of May , 1983, by the following vote, to wit: AYES: COUNCIL MEMBERS Reilly, Quiel, Hobbs, strickler NAYS: Council Members Castaneda, Hernandez, Marks ABSENT: None ~I-?//ff' fkp .
