USES OF BUILDINGS, SPORTS FACILITIES . INCREASING FEES FOR RECREATIONAL FACILITIES," AND SETTING FEES FOR CERTAIN RECREATION CENTER FACILITIES AND FOR ALCOHOL PERMITS. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Findings. The Mayor and Common Council hereby find: A. A hearing has been held by the Mayor and Common Council 11 pursuant to the provisions of Government Code Section 54990, et 12 seq., to consider the levy of new and additional fees and service 13 charges for various services provided by the Parks, Recreation 14 and Community Services Department, and for uses of certain 15 buildings, facilities, and equipment, which hearing was held 16 following public notice published in a newspaper of general 17 circulation in the City of San Bernardino. 18 19 20 21 22 23 24 25 26 27 28 B. None of the proposed increases exceed the actual cost of providing such services and facilities, and, for those services, which are not completely paid for by the proposed fees, the additional expense to the City of providing services shall be borne by the general fund of the City of San Bernardino. C. The proposed fees and charges are reasonable and necessary to enable the City of San Bernardino to more nearly meet the actual costs of providing such services and facilities. SECTION 2. Alcohol Permit Fees (on City Parks, Recreation and Community Service Facilities). 1. Special Events, Athletic Events, Fundraisers Sponsor must be an established, non-profit organization. Beverages are restricted to beer and wine. A. Alcohol Permit Fee: $50.00 - when ABC Permit is not required and participation is 150 or less; $100.00 - when ABC Permit is required or participation exceeds 150. (This fee is in addition to any rental or staffing fees.) 2. Private Gatherings A. Alcohol Permit Fee: $50.00 (0-150 participants); $100.00 (151 or more participants). This fee is in addition to any rental or staffing fees. D. Parks, Recreation and Community Services Department sponsored activities. 2. Parks, Recreation and Community Services Department cosponsored activities and tax- supported groups. 3. Non-profit, youth-servicing organizations located permanently in and serving the City of San Bernardino. 4. Civic and social groups (resident and non-profit). 5. Civic and social groups (non-resident or com- mercial ) . E. Non-profit, youth-serving organizations located 14 permanently in and serving the City of San Bernardino are those 15 organizations whose principal purpose is to provide a service or 16 program to participants, generally under the age of 18, of which 17 at least fifty-one percent (51%) reside in the City of San 18 Bernardino. Groups in this classification shall pay no fee for 19 use of outdoor athletic facilities and fifty percent (50%) of the 20 stated rate for all other facilities and equipment. 21 F. A non-residency surcharge of ten percent (10%) for all 22 facility or equipment rentals, class registration fees, and 23 excursion fees, and a five dollar ($5.00) per non-resident player 24 surcharge for adults sports programs shall be charged. 25 G. The Mayor and Common Council may exempt non-profit 26 associations or corporations organized primarily for patriotic, 27 civic betterment or charitable purposes or any local civic or 28 charitable organization from the foregoing rates and fees 4 . , 1 RE:. INCREASING FEES FOR RECREATIONAL FACILITIES," AND SETTING FEES FOR CERTAIN RECREATION CENTER FACILITIES AND FOR ALCOHOL PERMITS. 2 schedule for the use of park and recreation buildings and 3 facilities upon a finding that the rental fee would create a 4 financial hardship jeopardizing the activity or event planned for 5 such use and that the activity or event will be of unusual 6 benefit to the inhabitants of the City and should be supported 7 with public funds. The word 'local' as used herein is defined to 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 mean an organization whose membership is comprised of more than fifty percent (50%) of City residents."
