RESOLUTION NO. 86-488
2 RESOLUTION OF THE CITY OF SAN BERNARDINO REQUESTING THE
INTERSTATE COMMERCE COMMISSION TO REOPEN THE RECORD IN THE MERGER
3 CASE OF SANTA FE RAILWAY AND SOUTHERN PACIFIC TRANSPORTATION
COMPANY, AND URGING ITS SUPPORT TO APPROVE THIS MERGER.

5 WHEREAS, on July 24, 1986, the Interstate Commerce Commission
6 (ICC) rejected the proposed merger of The Atchison, Topeka and
7 santa Fe Railway Co. and Southern Pacific Transportation Company
8 by a vote of 4 to 1; and
9 WHEREAS, in the past two decades, the ICC has approved
]0 mergers which resulted in the creation of three mega-railroads in
]] the East and two in the West; and
]2 WHEREAS, these mergers have caused a significant decline in
]3 employment and carload capacity to both Santa Fe and Southern
]4 pacific; and
]5 WHEREAS, California and communities such as San Bernardino
]6 have sustained substantial financial setbacks by the operation
]7 decline in Santa Fe and Southern Pacific due to their inability to
]8 compete on an equal basis with the larger, merged and integrated
19 companies; and
20 WHEREAS, the merger will result in a company having a better
2] capacity to compete in the transportation industry,
22 NOW, THEREFORE, BE IT RESOLVED that the Mayor and Common
23 Council of the City of San Bernardino do hereby urge the
24 Interstate Commerce Commission to reopen the case so that new
25 facts can be placed on the record, and further urge the support of
26 the merger of The Atchison, Topeka and Santa Fe Railway Co. and
27 Southern Pacific Transportation Company in order that the rail
28 industry in San Bernardino remains strong and continues to be a

1 viable financial and employment resource to the Inland Empire and
2 provides a competitive market for the transportation needs of
3 Southern California and the Western United States.
4 NOW, THEREFORE, BE IT FURTHER RESOLVED that the Mayor and
5 Common Council of the City of San Bernardino do hereby urge
6 united States Senators Alan Cranston and Pete Wilson and united
7 states Representatives George Brown and Jerry Lewis to encourage
8 the ICC to reopen the record in this case.
9 NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Clerk is
10 hereby authorized and directed to forward certified copies of this
11 resolution to the Interstate Commerce Commission and to united
12 States Senators Alan Cranston and Pete Wilson, and to united
13 states Representatives George Brown and Jerry Lewis.
