2 RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING
RESOLUTION NO. 83-201 ENTITLED IN PART "RESOLUTION . . .
3 MODIFYING FEES FOR . . . USES OF BUILDINGS, SPORTS
FACILITIES. . .", AND INCREASING FEES FOR RECREATIONAL
4 FACILITIES.
5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Findings. The Mayor and Common Council hereby
8 find:

A. A hearing has been held by the Mayor and Common Council
10 pursuant to the provisions of Government Code Section 54990, et
I] seq., to consider the levy of new and additional fees and service
]2 charges for various services provided by the Parks, Recreation
]3 and Community Services Department, and for uses of certain
]4 buildings, facilities, and equipment, which hearing was held
]5 following public notice published in a newspaper of general
]6 circulation in the City of San Bernardino.

B. None of the proposed increases exceed the actual cost
]8 of providing such services and facilities, and, for those
]9 services, which are not completely paid for by the proposed fees,
20 the additional expense to the City of providing the services
2] shall be borne by the general fund of the City of San Bernardino.

C. The proposed fees and charges are reasonable and
23 necessary to enable the City of San Bernardino to more nearly
24 meet the actual costs of providing such services and facilities.

SECTION 2. Implementation. Effective November 3, 1986,
26 Resolution No. 83-201 Section 2 Subsection III is amended to
27 read:

11 C. prioritv of Use: The priorities of use shall be in the
12 following order:
13 1. Parks, Recreation and Community Services Department
14 sponsored activities
15 2. Parks, Recreation and Community Services Department
16 cosponsored activities and tax-supported groups
17 3. Non-profit, youth-servicing organizations located
18 permanently in and serving the City of San Bernardino
19 4. Civic and social groups (resident and nonprofit)
20 5. Civic and social groups (nonresident or commercial)
21 D. Nonprofit, youth-serving organizations located
22 permanently in and serving the City of San Bernardino are those
23 organizations whose principal purpose is to provide a service or
24 program to participants, generally under the age of 18, of which
25 at least fifty-one percent (51%) reside in the City of San
26 Bernardino. Groups in this classification shall pay no fee for
27 use of outdoor athletic facilities and fifty percent (50%) of the
28 stated rate for all other facilities and equipment.

E. A non-residency surcharge of ten percent (10%) for all
2 facility or equipment rentals, class registration fees, and
3 excursion fees, and a five dollar ($5.00) per non-resident player
4 surcharge for adults sports programs shall be charged.

F. The Mayor and Common Council may exempt nonprofit
associations or corporations organized primarily for patriotic,
civic betterment or charitable purposes or any local civic or
charitable organization from the foregoing rates and fees
schedule for the use of park and recreation buildings and
facilities upon a finding that the rental fee would create a
financial hardship jeopardizing the activity or event planned for
such use and that the activity or event will be of unusual
13 benefit to the inhabitants of the City and should be supported

with public funds.
The word 'local' as used herein is defined to
15 mean an organization whose membership is comprised of more than
16

fifty percent of City residents."
