I~')-' '.' \ .f\~ ,,\ (" L'~ ,)V, 1 J' '-I.e' \ Q' 2 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1';; RESOLUTION NO. 84-289 3 RESOLUTION OF"THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO REQUESTING REDESIGNATION OF RIVERSIDE COUNTY AND SAN BERNARDINO COt1NTY TO ATTAINMENT AREAS FOR FEDERAL AMBIENT AIR QUALITY STANDARD FOR NITROGEN DIOXIDE. 4 5 6 WHEREAS, all portions of a designated air quality control area are considered by the Environmental Protection Agency to be 7 8 non attainment areas for a federal ambient air quality standard if one portion is not in attainment of the standard; and 9 WHEREAS, designated areas which are in attainment of the 10 federal ambient air quality standards are not subject to the imposition of a construction ban or other sanctions; and WHEREAS, Riverside and San Bernardino Counties are now in attainment of the federal ambient air quality standard for nitrogen dioxide and have been since 1981; and WHEREAS, areas which are in attainment of the federal air quality standards may be redesignated from nonattainment to attainment areas by the provisions of the Clean Air Act; and WHEREAS, the South Coast Air Quality Management District, which is the duly constituted air quality control agency for the South Coast Air Basin has, as required by the provisions of the Clean Air Act, requested the State of California Air Resources Board to recommend to the Environmental Protection Agency that the Riverside and San Bernardino County portions of the South Coast Air Basin be redesignated to attainment of the federal air quality standard for nitrogen dioxide; and WHEREAS, the Environmental Protection Agency has stated its intention to consider imposition in the near future of a construction ban on major new and modified stationary sources of 1 air emissions and consider federal funding limitations on the 2 entire South Coast Air Basin even though only one county area 3 within this basin continues to be in nonattainment of the federal 4 air quality standard for nitrogen dioxide; and 5 WHEREAS, emission control programs adopted and implemented 6 by the South Coast Air Quality Management District, Riverside 7 County, San Bernardino County and the cities therein have been an 8 integral part of the attainment of the federal air quality 9 standard for nitrogen dioxide in these counties and cities; and 10 WHEREAS, the entire South Coast Air Basin has been projected 11 to be in attainment of the federal nitrogen dioxide standard by 12 1987; and 13 WHEREAS, in its passage of the Clean Air Act, Congress did ]4 not intend to impose sanctions on an area which is making 15 reasonable progress and good faith efforts towards attainment of 16 the air quality standards; and 17 WHEREAS, a construction ban would seriously hinder the 18 construction of cogeneration and other energy conservation projec s 19 thus increasing our dependence on foreign energy sources and 20 decreasing our national security; and 21 WHEREAS, a construction ban and funding limitations could 22 hinder the present economic recovery in Riverside and San 23 Bernardino Counties and impair the well-being of the citizens of 24 these areas; and 25 WHEREAS, a construction ban would hinder development of new 26 and better air pollution emission control technology and delay 27 the installation of improved emission controls and could impede 28 the rate of emissions reductions in these counties; and -2- 1 WHEREAS, imposition of a construction ban thus could be 2 counterproductive to the improvement in air quality in the 3 counties of Riverside and San Bernardino; and 4 WHEREAS, redesignation to attainment of the federal air 5 quality standard for nitrogen dioxide for the Counties of 6 Riverside and San Bernardino would prevent the imposition of a 7 construction ban and funding restrictions and resulting 8 detrimental effects of such sanctions on air quality and the local 9 economy, 10 NOW, THEREFORE, BE IT RESOLVED that the California Air 11 Resources Board is requested to immediately approve the pending 12 request to redesignate the Counties of Riverside and San 13 Bernardino to be attainment areas for the federal ambient air 14 quality standard for nitrogen dioxide and promptly forward this 15 request and approval to the Environmental Protection Agency; and 16 BE IT FURTHER RESOLVED, upon receipt from the Air Resources 17 Board of the redesignation request and approval for the Counties 18 of Riverside and San Bernardino, that the Regional Administrator 19 for Region IX of the Environmental Protection Agency promptly 20 approve the redesignation of the Counties of Riverside and San 21 Bernardino to attainment areas for the federal ambient air 22 quality standard for nitrogen dioxide; and 23 BE IT FURTHER RESOLVED, that the City Clerk of the City of 24 San Bernardino be directed, and she is hereby directed, to 25 mail certified copies of this resolution to the following: 26 Mr. Gordon Duffy, Chairman, California Air Resources Board, 27 P.O. Box 2815, Sacramento, CA 95812; Ms. Judith Ayres, Regional 28 Administrator, U.S. Environmental Protection Agency, Region IX, -3- 1 215 Fremont Street, San Francisco, CA 94105; Ms. Faye Myers 2 Dastrup, South Coast Air Quality Management District, 9150 Flair I Drive, El Monte, CA 91731.
