WITHIN THE AFFECTED TERRITORIES AND TO THE COR~ITIONS CONTAINED
IN RESOLUTION NO. 1918 OF THE LOCAL AGENCY FO~IOH COMMISSION,
CALLING A SPECIAL ELECTION AND REQUESTING CONSOLIDATION WITH THE
GENERAL ELECTION ON NOVEMBER 6, 1984.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Recitals.
(A) Pursuant to Section 35220 Government Code, proceedings
were initiated by the Mayor and Common Council in Resolution No.
84-225 on June 18, 1984, for the annexation of 12 unincorporated
areas of inhabited territory which are legally described in
Exhibit -A-, which is attached hereto and incorporated herein as
though fully set forth.
(B) Notice of a hearing on the proposed annexations to be
held on July 23, 1984 in the City Council Chambers at City Hall,
300 North -D- Street, in the City of San Bernardino at 9:00 a.m.
was duly publiShed by the City Clerk, together with notice that
protests could be filed with the City Clerk by "any owner of land
or registered voter within the territories proposed for
annexation.
(C) A hearing of protests having been held as noticed on

July 23,1984, it is determined that 13' "written protests have
been filed against the annexations. Of these written protests,
9~ were filed by registered voters residing within the areas
to be annexed. The Registrar of Voters has determined that

(D) Pursuant to Resolution No. 1918, Condition No.4, of
the Local Agency Formation Commission of San Bernardino County
(LAFCO), an election shall be called and held on the question of
this municipal reorganization unless protests are filed by fifty
percent (50%) or more of the registered voters within the
affected areas.
SECTION 2. Value of Written Protests.
The value of the written protests filed up until the close
of the hearing on July 23, 1984, is less than fifty percent (50%)
of the registered voters residing within the territories to be
annexed.
SECTION 3. Annexation Ordered.
Subject to confirmation of the voters within the affected
territory, annexation of the unincorporated areas legally
described in Exhibit -A- attached hereto is hereby ordered. A
map showing the areas to be annexed is attached hereto as Exhibit
-B- and incorporated herein as though fully set forth. Pursuant
to Condition No. 5 of LAFCO Resolution No. 1918, the effective
date of this municipal reorganization shall be July 1, 1985.
This reorganization shall be subject to the conditions contained
in LAFCO Resolution No. 1918 including the following conditions:
(A) In the City's final action there shall be detachment of
County Service Area SL-l (street lighting), County Service Area
38 (fire protection), Improvement Zone G of CSA 38, County
Service Area 70 (countywide), and Improvement Zone A of CSA 70
(weed abatement) without split of assets or liabilities except as
otherwise provided herein.
(B) The California Division of Forestry --County Service

1 Area 38 fire station on Baseline Avenue shall be purchased by the
2 City at its present County depreciated value or the original land
3 purchase and construction costs, whichever is lower, or if the
4 County wishes to retain ownership of this facility, the City
5 shall lease the station at a cost of $1.00 per year until a
6 proposed East Highlands Station is constructed.
7 (C) Library service shall be continued at the County branch
8 library on Baseline at Palm Avenue until a proposed new City
9 library is constructed. The City will either assume the County
10 lease or contract with the County for continued operation.
11 (D) All employees of the County and County Special
12 Districts who may be displaced by this municipal reorganization
13 shall be given first preference by the City for employment to
14 perform comparable services now assumed by the City provided
15 that:
16 1. Employee applicants are qualified for the employment
17 considered, in the sole judgment of the City.
18 2. Employees hired by the City will retain accumulated
19 sick leave and vacation time.
20 3. In all other respects, such employees hired by the
21 City would be under the same employee benefit program as other
22 City employees.
23 (E) The amount of property tax revenues to be exchanged
24 between the County and the City resulting from the jurisdictional
25 change shall be settled pursuant to Resolution No. 84-209 of the
26 ~ayor and Common Council.
27 SECTION 4. Special Election Called.
28 A special election is called and will be held on Tuesday,

1 November 6, 1984, in those unincorporated areas legally described
2 in Exhibit -A-, hereto and shown on the map attached as Exhibit
3 -B- hereto for the purpose of submitting to the registered voters
4 within said areas, for their approval or disapproval, the order
5 adopted on July 23, 1984 by the Mayor and Common Council of the
6 City of San Bernardino ordering the annexation to said City of
7 the territories described in said order and designated as LAFC
8 2260B. The order shall be confirmed if approved by a majority of
9 the voters voting thereon.

SECTION 5. Request for Consolidation.
11 Pursuant to Section 23302 Elections Code, the Mayor and
12 Common Council of the City of San Bernardino request that the
13 Board of Supervisors of the County of San Bernardino consolidate
14 the City's special annexation election with the general election
15 to be held on November 6, 1984.

17 The measure to be voted on at the special election as it is
18 to appear on the ballot shall be as follows:

27 The measure shall be designated on the ballot by a letter
28 printed on the left margin of the square containing the

1 description of the measure as provided in the Elections Code of
2 the State of California.
3 SECTION 7. Canvass of Returns by Board of Supervisors.
4 The Board of Supervisors of the County of San Bernardino is
5 hereby authorized to canvass the returns of the special annexation
6 election called by this resolution and to conduct the special ~,'
7 election and the consolidated election of the County of San
8 Bernardino in all respects as if there were only one election with
9 only one form of ballot. Results of the election shall be
10 certified to the Mayor and Common Council of the City of San
11 Bernardino.
12 SECTION 8. Notice of Election.
13 Pursuant to Section 35D67 Government Code, the City Clerk
14 is hereby directed to publish a notice of the annexation election
15 which shall contain the following:
16 (A) The date of the election7
17 (b) That the last day for receipt of primary arguments for
18 or against the measure has been established as 4:30 p.m. on
19 August 14, 1984, in the City Clerk's Office, Second Floor, City
20 Hall, 300 North -D- Street, San Bernardino, CA7
21 (C) That the last day for receipt of rebuttal arguments is
22 4:30 p.m. on August 21, 1984, in the City Clerk's Office at the
23 above location7
24 (D) A statement of the proposition to be voted on and a
25 general description of the boundaries of the territories to be
26 annexed as set forth in Exhibits -A- and -B- hereto7
27 (E) That the Mayor and Common Councilor any member
28 authorized by Councilor any registered voter or bona fide

1 association of citizens entitled to vote on the proposal is
2 invited to submit and file with the City Clerk for printing and
3 distribution in the ballot pamphlet an argument for or against
4 the proposal, and
5 (F) That only one argument for and one argument against
6 shall be selected by the City Clerk and printed; that such
7 argument shall not exceed three hundred (300) words in length,
8 shall be accompanied by not more than three (3) signatures, and
9 shall be accompanied by the statement in Section 5350 Elections
10 Codel and
11 (G) Such other information as may be required by law.
12 SECTION 9. Territory, Precincts, and POlling Places for
13 Election.
14 The special election c~lled by this resolution shall be held
15 wi thin those 12 unincorporated territories described in Exhibit
16 -A- and shown on the map which is Exhibit -B- hereto and shall be
17 held in such precincts and at such polling places as shall be
18 determined by the Registrar of Voters of the County of San
19 Bernardino. The Board of Supervisors of the County of San
20 Bernardino is hereby requested to issue instructions to the
21 Registrar of Voters to take all steps necessary for the holding
22 of the consolidated election. The Mayor is hereby authorized to
23 execute a contract for the services necessary for conducting the
24 election.
25 SECTION 10. Proposed Charter Amendment to Provide Council
26 Representation.
27 " If this municipal reorganization is confirmed, the Mayor and
28 Common Council may propose a City Charter amendment to add two

1 additional council members te provide for representation from the
2 areas annexed.

SECTION 11. Filing by City Clerk with Local Agency
4 Formation Commission and Board of Supervisors.
5 The City Clerk is hereby directed to file a certified copy
6 of this resolution with the Executive Officer of the Local Agency
7 Formation Commission of the County of San Bernardino by certified
8 mail within five (5) days of the adoption hereof. The City Clerk
9 is further directed to file a certified copy of this resolution
10 with the Board of Supervisors of the County of San Bernardino.

Spanish translation by Candidate will double the cost.) It will be the respon-

and/Dr'Argume~ts/AnaJyses.
ITEM #10. ABSENTEE BALLOTS

Registrar of Voters will handle all absentee b~llots. including the checking of
applications and ballot mailing. Appropriate applications will be provided to
City Clerks for use when the sample ballot application is not available or is
not applicable.
The undersigned requests the above election services to be performed by the Registrar of
Voters and, pursuant to Elections Code Section 22003. agrees eimburse the Registrar
of Voters in full for services requested upon presentatio bill.
