RESOLUTION NO. 84-278
RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING THE SALE
OF LAND AND IMPROVEMENTS ON REAL PROPERTY IDENTIFIED AS\APN.134-
131-10 LOCATED AT 556-568 WEST FOURTH STREET, WITHIN THE CENTRAL
CITY NORTH PROJECT AREA TO SAN BERNARDINO CIVIC LIGHT OPERA
ASSOCIATION (HEALTH AND SAFETY CODE SECTION 33433).
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
SECTION 1. Recitals.
(a) The Redevelopment Agency of the City of San Bernardino
("Agency") proposes to sell to the San Bernardino Civic Light
Opera Association ("Developer"), land and improvements on real
property identified as APN 134-131-10 located at 556-568 West
Fourth Street, within the Central City North Project Area,
described in Exhibit "A", attached hereto and incorporated
herein by reference as though set forth in full, for the sum of
$150,000.00 which will be paid by the Developer in cash.
(b) Notice of the time and place of hearing has been given
as required by law.
(c) Agency has made available for public inspection and
copying a summary of financial aspects of the proposed sale.
(d) The summary of financial aspects represents that the
fair market value of the interest to be conveyed by Agency,
determined at the highest use permitted under the plan, is
$500,000.00. Because the offerors are a non-profit corporation
and the sale will be conditioned upon use in perpetuity for the
preservation and encouragement of fine arts for the cultural arts
community, the Agency represents that the sale is in the public
interest.
(e) All hearings have been heard as required by Health and

SECTION 2. Determination. Based upon the representations of
Agency, it is found and declared that the consideration for the
real property described in Exhibit "A", in accordance with
covenants and conditions governing the sale, is less than the fair
market value of the property determined at the highest use
permitted under the plan for the Central City North Project
Area, but that the use in perpetuity of the property for the
preservation and encouragement of fine arts for the cultural arts
community satisfies this body that the proposed sale is in the
public interest.
SECTION 3. Approval. The Mayor and Common Council of the
City of San Bernardino hereby approve the sale of said property
upon the terms and conditions set forth in this resolution and
the summary of financial aspects.
I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Mayor and Common Council of the City of San
Bernardino at a reqular meeting thereof, held on
the 16th day of Julv , 1984, by the following vote,
to wit:
AYES: Council Members Castaneda, Reilly, Hernandez,
Marks, Quiel, Frazier, Strickler
NAYS: None
ABSENT: None
