G3-2~5 2 RESOLUTION OF THE CITY OF SAN BERNARDINO FIXING AND DETERMINING THE FEES AND CHARGES TO BE CHARGED FOR THE COLLECTION 3 AND DISPOSAL OF GARBAGE AND RUBBISH, AND REPEALING RESOLUTION NO. 13570 AND AMENDMENTS THERETO. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF 5 SAN BERNARDINO AS FOLLOWS: 6 SECTION 1. The fees and charges set forth herein shall apply 7 to all rubbish and garbage collection services provided by the 8 City. 9 SECTION 2. A twenty-five dollar ($25.00) deposit shall be ]0 required for each new commercial refuse account. Said deposit 11 must be paid prior to the City commencing refuse collection 12 service. This deposit shall be retained by City and applied to 13 any closing bill upon termination of service. Any excess amount 14 above the closing bill shall be refunded. 15 SECTION 3. Collection and Disposal of Garbage or Rubbish _ 16 Single Family Residences. For collection and disposal of garbage 17 or rubbish, the owner, or authorized agent, of any single-family 18 residential premises, or portions thereof, located within the 19 territorial limits of the City of San Bernardino, shall pay the 20 following fees: 21 $6.10 per month for regular curb side or alley service, 22 $6.60 per month for service where containers must be 23 removed from below ground level. 24 SECTION 4. Collection and Disposal of Garbage or Rubbish _ 25 Multiple Dwellings, Apartments, Etc. For collection and disposal of garbage or rubbish the owner, or authorized agent, of any 26 27 apartment houses, courts, mobile homes, trailer courts, duplexes 28 and other multiple dwelling units shall pay the following fees: 1 NU~lIlER OF UNITS AND TOTAL FEE PER MONTH 2 units $ 7.54 3 units $10.98 4 units $14.31 5 units $17.47 More than 5 units: $17.47 plus $3.05 for each unit over 5 . 2 3 4 5 6 7 8 It shall be the duty of the Superintendent of Public 9 Services to determine the number of units actually used, or 10 capable of being used, for housekeeping purposes and to adjust the 11 assessment for such use accordingly. 12 13 Hotels, Offices, Etc. SECTION 5. Collection and Disposal of Garbage or Rubbish _ 14 (a) For collection of garbage or rubbish, the owner, or 15 authorized agent, of any hotel, office building, restaurant, ]6 shop, store, hospital, auto court, motel or other similar places 17 shall pay the following fees, based on actual pick-up time: ]8 RATES PER MONTH 19 20 21 22 23 24 25 26 27 Less Than Six Man-Minutes Each Week $ 4.45 six or More Man-Minutes Each Week Man-Minutes Per Week: 6 to 8 inclusive $ 5.80 9 to 13 inclusive $ 8.90 14 to 17 inclusive $14.70 Where more than 17 man-minutes per week are required, 25 cents per man-minute for each man-minute per month shall be charged, based upon periodic review. (b) All new account fees pursuant to this section shall be 28 based on an estimate and then adjusted to actual time and cost at -2- 1 the end of one month's period of use. 2 (c) All fees pursuant to this section shall be periodically 3 reviewed, and on basis of findings, monthly charges shall be 4 adjusted to maintain conformance with the rate schedule set forth 5 in Subsection (a) above, except that monthly charges shall not be 6 adjusted in relation to temporary variations of rubbish due to 7 seasonal factors where such variations from the average do not 8 extend beyond a three-month period. 9 SECTION 6. (a) When the service performed by the City is 10 the collection and disposal of refuse placed for collection in 11 City-approved compaction-type containers, the fee for such service 12 for each time of collection, shall be at the rate of two dollars 13 and thirty-five cents ($2.35) per cubic yard of capacity of each 14 container. 15 (b) When any garbage or rubbish service lS performed by 16 means of bins and automatic-loading City equipment, the fee shall 17 be one dollar and seventy-five cents ($1.75) per cubic yard of 18 container size for each time of collection. In addition, the ]9 monthly rental of bins shall be paid as per schedule below, except 20 when City-approved bins are furnished by the place of business 21 being serviced: 22 23 24 25 26 27 28 MONTHLY BIN RENTAL RATES Container Rate 1 to 3 cubic yards $ 8.00 4 cubic yards $ 9.00 5 cubic yards $10.00 6 cubic yards $12.00 8 cubic yards $15.00 -3- ~ II 1 30 cubic yards $50.00 2 40 cubic yards $65.00 3 (c) When the service performed by the City is for the 4 collection and disposal of construction, remodeling or hard-to- 5 handle material, in commercial drop bodies of 30 or 40 cubic yard 6 capacity, the fee for such service for each time of collection 7 shall be at the rate of $3.00 per cubic yard of capacity of each 8 container containing said material, plus the monthly rental of 9 bins as per schedule under Section 6 Subsection (b), except when 10 City-approved bins are furnished by the place of business being 11 serviced. ]2 (d) Whenever the City is required to pay a dumping charge 13 for construction material or other rubbish which is classified as ]4 "hard to handle", the additional amount of the dumping charge over 15 eight tons for commercial drop bodies shall be a debt of the ]6 customer and shall be added to said total fee due to the City. 17 (e) Whenever a three or four cubic yard bin is requested for ]8 use on a temporary basis, a special delivery charge of ten dollars ]9 ($10.00) shall be made in addition to the regular monthly bin 20 rental rate, which said rental rate shall be prorated for the 21 Iperiod of such use in increments of not less than one week. A 22 service fee of ten dollars ($10.00) per pickup shall be charged 23 for each time said bin is serviced. 24 25 for the special collection and removal of garbage or rubbish from SECTION 7. The Public Services Superintendent may provide 26 any place or premises at any time in addition to or beyond the 27 regular collection service schedule, or in a manner different from 28 normal collection practice and procedures. The rate for any such -4- 1 ,special service shall be thirty dollars ($30.00) per hour with a Iminimum charge of seven dollars and fifty cents ($7.501. 2 3 SECTION 8. All fees and charges as set forth in this 4 resolution shall be collected monthly. 5 SECTION 9. Any service for the collection and disposal of 6 garbage or rubbish as set forth in this resolution may be 7 discontinued by the Public Services Superintendent if any fees or 8 charges, as levied herein, are not paid within 90 days from the 9 date said assessment is billed. 10 SECTION 10. The Mayor and Common Council may exempt from the 11 rate provisions and charges of this resolution certain nonprofit 12 events in the public interest. The exemption shall be subject to 13 any conditions imposed by the Superintendent of Public Services. 14 SBCTION 11. The Superintendent of Public Services may 15 provide emergency service without charge in emergency situations 16 when necessary to correct fire or health hazards or other 17 emergencies. 18 SECTION 12. Resolution No. 13570 and amendments thereto and 19 any other resolution in conflict herewith are hereby repealed. 20 SECTION 13.
