i BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:

SECTION 1. Recitals.

A. The Mayor and Common Council hereby determine that
9 certain property owned by the City located generally west of Del
10 Rosa Avenue between Sixth Street and Baseline Avenue in the City
II of San Bernardino is surplus to the needs of the City. This
12 property was acquired from the State of California for development
13 as low income housing, and the Mayor and Common Council determine
14 that development for such purpose can best be effected by the
15 Community Development Commission of the City of San Bernardino.

B. Pursuant to the authority granted to the City by Health
17 and Safety Code Section 33220 and to the Community Development
18 Commission by Section 33396 of that code, the Mayor and Common
19 Council are satisfied that it is in the best interest of the City
20 and of the Community Development Commission that such property be
21 conveyed by the City to the Community Development Commission
22 without consideration, and that such conveyance will foster and
23 promote the policy contained in Health and Safety Code Section
24 33037 relating to community development programs.

SECTION 2. Implementation.

A. The Mayor of the City of San Bernardino is authorized and
27 directed to execute on behalf of the City a grant deed conveying
28 that certain surplus property, as described therein, to the
1 Community Development Commission of the City of San Bernardino,
2 without consideration. A copy of the deed is attached hereto,
3 marked Exhibit "A" and incorporated herein by reference as fully
4 as though set forth at length.

B. The deed shall be recorded and delivered to the Community
6 Development Commission forthwith.

Those portions of Lots 3, 4, and 5, Block 51, Rancho San Bernardino as
per olat thereof recorded in Book 7 of Maps, page 2, records of the County
Recorder of San Bernardino County, State llf California, described as follows:
Beginning at the intersection of the South line of Ninth Street and the
West line of Lot 31, Tract No. 4268 as oer plat thereof recorded in Book 58 of
Maps, page 45, records of the Countv Recorder of said County; thence South along
the West line of said Tract 4268 and along the West line of Elmwood Road, 40.00
feet wide, to the North line of Sixth Street, 82.50 feet wide; thence West along
the North line of said Sixth Street to a pOint which is 2,208.17 feet East of the
intersection of the centerline of Tippecanoe Street and the Westerly Drolongation
of the North line of said Sixth Street, said point being the Southeast corner of
that certain Darcel described in the document recorded Mav 12, 1965, Document
No. 18, in Book 6389, page 24 Official Records of said County; thence North along
the East line of said parcel, a distance of 894.36 feet to the Northeast corner
thereof; thence West along the North line of said Darcel, a distance of 974.73
feet to the Northwest corner thereof; thence North along the West line of that
certain parcel described in the Deed recorded November 22, 1923, Document No. 39
in Book 826 of Deeds, page 70, Records of said County to a point which is 905.2
feet South of the North line of said Lot 5; thence along a North line of said
land, East a distance of 92.3 feet to an angle point therein; thence North along
a West line of said land, a distance of 855.2 feet, more or less to the South
line of said Ninth street; thence East along the South line of said Ninth Street
to the Point of Beginning.

Rancho San Bernardino as per plat thereof recorded in Book 7 of Maps, page 2,
records of the County Recorder of San Bernardino County, State of California.
Excepting therefrom those portions lying within Ninth Street.
ALSO EXCEPTING THEREFROM that portion lying Northerly of the following described
line;
Beginning at a point in the East 1 ine of said Lot 9, said point being South
00 20' 24" West (recorded South 00 15' 20" East) thereon, a distance of 365.30
feet from the intersection of the Northel'lv nrolongation of said East line with
the centerline of Baseline Street, 82.50 feet wide; thence North 890 16' 16" West,
a distance of 10.50 feet to the beginning of a tangent curve, concave Southeasterly
and having a radius of 1,575 feet; thence Southwesterly and having a radius of
1,575 feet; thence Southwesterly along said curve through a central angle of 210
50' 51", a distance of 600.57 feet; thence South 680 52' 53" West to the East line
of the West 470.25 feet to said Lilt 8 and the Point of Termination.

EXCEPTING AND RESERVING to the State of California from Parcels 1 and 2 all
mineral deposits, as defined by Section 6407 of the Public Resources Code,
together with the right to prospect for, mine and remove such deposits
from the following described locations only:
One ISO' x ISO' site, with ingress and egress thereto, to be
located on the portion of the property on the North side of
Ninth Street and one ISO' x ISO' site, with ingress and egress
thereto, to be located on the portion of the property on the
South side of Ninth Street. Said sites to be located by the
State so as not to interfere with reasonable development or
use of the property.
Also reserving an easement for street and highway purposes in, over, under
and across that portion of the following described parcel lying within the
property hereinabove described.
A strip of land 88.00 feet wide and being 44.00 feet on each side of
the following described centerline;
Commencing at the intersection of the centerline of Sixth Street, 82.50
feet wide and the centerline of Elmwood Road, 40.00 feet wide as delineated
on the map of Tract No. 2996 as per plat thereof recorded in Book 40 of Maps,
page 80, records of the County Recorder of said County; thence South 890 47'
44" West along said centerline of Sixth Street, a distance of 60.26 feet to the
True Point of Beginning; thence North 250 38' 53" West, a distance of 149.55
feet to the beginning of a tangent curve, concave Easterly and having a radius
of 1500.00 feet; thence Northerly along said curve through a central angle
of 250 13' 38", a distance of 660.45 feet to its point of tangency with a 1 ine
which is parallel with and 44.00 feet West of and measured at right angles to
the West line of said Lot 3; thence North 0025' 15" West along said parallel
line, a distance of 1,249.83 feet; thence North 00 30' 30" West along a line
which is parallel with and 44.00 feet West of and measured at right angles to
the West line of Tract No. 2856 as ner plat thereof recorded in Book 39 of
Maps, pages 78 and 79, records of the County Recorder of said County, a distance
of 2,023.80 feet to the centerline of Baseline Street and the Point of Termination.
EXCEPTING therefrom those portions as previously dedicated for Sixth
Street, Ninth Street and Base Line Street.
This deed is subject to the express conditions as set forth in the Quitcl aim
Deed recorded July 12, 1982, Document Number 82-134965.
