BE IT RESOLVED BY THE MAYOR AND THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Recitals (a) The General Plan for the City of San Bernardino was adopted by the Mayor and Common Council by Resolution No. 89- 159 on June 2, 1989. (b) General Plan Amendment No. 91-04(E) to the General Plan of the City of San Bernardino was considered by the Planning commission on March 6, 1991, after a noticed public hearing, and the Planning commission's recommendation of approval has been considered by the Mayor and Common Council. (c) An Initial Study was prepared on February 28, 1991 and reviewed by the Environmental Review Committee and the Planning commission who both determined that General Plan Amendment No. 91-04(E) would not have a significant effect on the environment and therefore, recommended that a Negative Declaration be adopted. (d) The proposed Negative Declaration received a 21 day public review period from March 7, 1991 through March 27, 1991 and all comments relative thereto have been reviewed by the Planning commission and the Mayor and Common Council in compliance with the California Environmental Quality Act and local regulations. 28 IIII 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 ~ 21 ~ ~ 24 25 26 27 28 RESOLUTION...ADOPTING THE NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AND APPROVING GENERAL PLAN AMENDMENT NO. 9l-04(E) TO THE GENERAL PLAN OF THE CITY OF SAN BERNARDINO. (e) The Mayor and Common Council held a noticed public hearing and fully reviewed and considered proposed General Plan Amendment No. 9l-04(E) and the Planning Division Staff Report on April 1, 1991. (f) The adoption of General Plan Amendment No. 9l-04(E) is deemed in the interest of the orderly development of the city and is consistent with the goals, objectives and policies of the existing General Plan. SECTION 2. Neqative Declaration NOW, THEREFORE BE IT RESOLVED, FOUND AND DETERMINED by the Mayor and Common Council that the proposed amendment to the General Plan of the City of San Bernardino will have no significant effect on the environment, and the Negative Declaration heretofore prepared by the Environmental Review Committee as to the effect of this proposed amendment is hereby ratified, affirmed and adopted. SECTION 3. Findinqs BE IT FURTHER RESOLVED by the Mayor and Common Council of the City of San Bernardino that: A. The proposed amendment is internally consistent with the General Plan in that the policy has been changed in a manner which maintains the intent of the General Plan and no other policies relate to the retail standard in the Commercial Regional-Downtown (CR-2) land use designation.. C. that: The proposed amendment would not be detrimental to the public interest, health, safety, convenience or welfare of the City in that the minor text amendment is for clarification purposes enable adoption of the to Development Code to implement the General Plan which ensures the public interest, health, safety, convenience and welfare of the city. The proposed amendment would maintain the appropriate balance of land uses within the City in that text amendment proposed does not affect the balance of land uses. SECTION 4. Amendment BE IT FURTHER RESOLVED by the Mayor and Common Council A. The text of the General Plan of the city of San Bernardino is amended by changing Policy 1.16.16, p. 1- 72, entitled Attachment A, and is more specifically relative to ground floor retail uses in the CR-2, Commercial Regional Dowtown District. This amendment is designated as General Plan Amendment No. 91-04(E) a copy of which is and incorporated herein by attached reference. B. General Plan Amendment No. 91-04(E) shall be effective immediately upon adoption of this resolution. SECTION 5. Text Notation This resolution and the amendment affected by it shall be noted on the appropriate General Plan page that has been previously adopted and approved by the Mayor and Common Council and which is on file in the office of the City Clerk. SECTION 6. Notice of Determination The Planning Division is hereby directed to file a 12 Notice of Determination with the County Clerk of the county 13 14 15 16 17 18 19 20 21 ~ ~ 24 ~ 26 27 28 of San Bernardino certifying the city's compliance with CEQA in preparing the Negative Declaration. Allow for the development of sites exclusively for residential uses provided that: a. a minimum contiguous area of one acre is committed to residential use; b. walls, landscape, horizontal and vertical setbacks, and other elements are used to buffer the use from adjacent commercial uses; c noise, traffic, and lighting impacts of adjacent commercial uses are mitigated; d. passive recreation open space is provided on-site; e. the project is adequately secured; and f. its location will not impact the integrity and continuity of other downtown uses (financial, offices, etc.) au, 11.4, 11.6, and 11.7).
